Chile hereby advises that Exempt Resolution No. 5.123/2021 "establishing phytosanitary requirements governing the importation into Chile of fresh Tahiti limes (Citrus latifolia) and Key limes (Citrus aurantifolia) produced in Peru, and repeal of Resolution No. 4.914/2004" was published in the Official Journal of Chile on 24 August 2021 and will enter into force 30 days from this date. https://members.wto.org/crnattachments/2021/SPS/CHL/21_5429_00_s.pdf
This measure amends Resolution No. 4.912 of 2004 as follows: 1.1. The additional declaration for Actinidia spp. pollen has been replaced with the following in the table in Resolve 1.1.: SPECIES: Actinidia spp. Additional declaration to be specified in the phytosanitary certificate: Pseudomonas syringae pv. actinidiae, excluding biovar 3, is not present in (insert country of origin). 1.2. Resolve 2 has been replaced by the following: "2. An alternative additional declaration stating that the pollen comes from a country free from the pest will also be accepted." 1.3. Resolve 5 has been replaced by the following: "5. For countries in which Pseudomonas syringae pv. actinidiae, excluding biovar 3, is present and that wish to export Actinidia spp. pollen to Chile, the exporting country's national plant protection organization (NPPO) shall be required to send, in advance, official information on the control measures, monitoring and regulations relating to the pest in the country, and specifications on the method of obtaining the pollen and on phytosanitary treatments to control the disease, if any are applied. Following the assessment of the information sent by the NPPO and, if it is sufficient and meets the requirements, the SAG will authorize the importation of pollen from that origin by issuing a resolution on a case-by-case basis, upon request by the importer." Chile advises that the Servicio Agrícola y Ganadero, SAG (Agriculture and Livestock Service) has amended Resolution No. 7.186 of 2020 by extending the period of effect for the 2021-2022 season (i.e. the period between 1 July 2021 and 30 June 2022). This measure may also be extended automatically for another season, should the global health emergency caused by the COVID-19 pandemic still exist on 29 June 2022, not only in Chile but also in the exporting country. The measure approves the coordinated and consolidated text of the Resolutions establishing phytosanitary requirements for the importation of kiln-dried sawn timber, of a thickness exceeding 6 mm, and quarantine regulations for the importation of sawn timber and logs, as follows: 1. Definitions of the types of timber covered by the Resolution, including the terms "unused sawn timber" and "used sawn timber", to facilitate certification by the phytosanitary authority of the country of origin and verification of the timber, according to material species and type, at the points of entry; 2. Phytosanitary requirements that must be included in the official phytosanitary certificate, identifying the additional declarations that the certificate must contain according to the type of wood and origin, and indicating the approved treatments and those responsible for carrying out and/or supervising the treatment; 3. Requirements for wood to be used to manufacture packaging in Chile; 4. Timber that is not covered by the Resolution because it is covered by other measures, such as wood packaging material used to support, protect or transport an imported product (including dunnage), which is covered by International Standards for Phytosanitary Measures (ISPM) No. 15. Wooden sleepers and sawn timber for sleepers are not covered, as their requirements are set according to origin and species; 5. Requirements for sealing the various means transport; 6. Inspection carried out by SAG at the point of entry to ensure physical and documentary compliance with the phytosanitary requirements established for the imported shipment and actions in the event of detection of listed pests or non-listed pests that are potentially quarantine pests. This measure establishes phytosanitary requirements for the importation of cereal seeds, as follows: 1. Phytosanitary requirements that must be included in the official phytosanitary certificate, the additional declarations that the certificate must contain according to species, and the types of treatments accepted; 2. Other phytosanitary requirements, such as that the shipment must be free of soil and plant remains, and requirements for packaging and its labelling or marking; 3. Seeds must comply with the requirements of Decree Law No. 1.764 of 1977, which sets standards for research, production and trade in seeds, and its Regulations, and with the regulations for the control of plant species considered to be weeds, in shipments of seeds of any species or origin entering the country; 4. For materials modified genetically by modern biotechnology, the importer must declare their genetic status and comply with SAG regulations establishing requirements for their importation and release into the environment; 5. Germplasms and samples must be subject to the same requirements as commercial consignments. Exceptionally, special conditions for the importation of these materials may be considered and at the express request of the interested parties; 6. Inspection carried out by SAG at the point of entry to ensure physical and documentary compliance with the phytosanitary requirements established for the imported shipment and actions in the event of detection of listed pests or non-listed pests that are potentially quarantine pests; 7. The phytosanitary requirements for the importation of seeds of the following species: Triticum monococcum L. and Hordeum chilense, shall enter into force upon publication of this Resolution in the Official Journal; 8. The phytosanitary requirements for the importation of seeds of species covered by this Resolution, not listed in Resolve No. 9, shall enter into force three months after publication in the Official Journal. The notified draft measure establishes health requirements governing the importation into Chile of raw hides and skins from bovine animals, horses, goats, sheep and swine: 1. It considers that SAG recognizes the country's health authority with regard to a number of aspects; 2. On the health status of the country or area of origin of the hides or skins in relation to the following diseases: foot-and-mouth disease, lumpy skin disease, African swine fever (ASF), classical swine fever (CSF), sheep pox and goat pox, peste des petits ruminants virus and anthrax; 3. Treatment options are identified that products must undergo if they do not come from countries free from those diseases; 4. Requirements for rearing, slaughtering, infrastructure and recognition of abattoirs and ante- and post-mortem inspection; 5. Not contain elements other than hide or the products used in its preparation or treatment; 6. It states that transport must be carried out in such a way as to ensure that health and hygiene conditions are maintained; 7. Information to be contained in the official certificate issued by the health authority at the time of shipment; 8. Requirements for checks and inspections of hides or skins on arrival in the country; 9. Tanned, semi-tanned, wet-blue or pickled hides or skins of all species shall be exempt from inspection by SAG upon arrival at the corresponding border control, and health certification shall not be required. The notified draft measure establishes phytosanitary requirements for the importation of in-shell and shelled pecan (Carya illinoinensis) nuts from Argentina, as follows: 1. It states that the official phytosanitary certificate accompanying the shipment must contain an additional declaration of treatment for Amyelois transitella (Lep.: Pyralidae), as described in the document. It also states the requirements regarding recognition of methyl bromide treatment and the need for the Servicio Nacional de Sanidad Agraria, SENASA (National Agrarian Health Service) to supervise phosphine treatment; 2. The notified draft measure establishes health requirements governing the importation into Chile of dairy produce, for animal and human consumption: 1. The requirements are applicable to all dairy produce, except for that listed in Resolution No. 3.081/2006 or the Resolution replacing it; 2. Health status favourably assessed by Chile regarding Rift Valley fever and lumpy skin disease or product subjected to pasteurization or another mitigation treatment; 3. Requirements for establishments of origin, including: - The establishment in which the dairy produce is processed must be authorized by the competent health authority of the country of origin and must be authorized by SAG, and must have a properly implemented traceability programme; - Additionally, in the case of products for animal feed, the provisions of Resolution No. 5.025/2009, which establishes the scope of the quality assurance programme for factories or manufacturers producing foodstuffs and supplements for animals and for factories producing ingredients of animal origin for animal feed, must be fulfilled; 4. Health requirements for the establishments of origin of the raw material, in relation to foot-and-mouth disease, freedom from brucellosis (Brucella spp.) and tuberculosis (Mycobacterium tuberculosis) or pasteurized or subjected to another mitigation treatment; 5. Specific heat treatments for milk or maturation treatments for milk used to manufacture dairy produce, as appropriate. In addition, maintaining the health and safety conditions of the treated product; 6. Products for animal feed must comply with the requirements established in Resolution No. 7.885/2017, which establishes maximum levels of contaminants in inputs for animal feed; 7. Requirements for the packaging to be used and the information it must contain; 8. Conditions for washing and disinfecting means of transport, verified by the competent authority; 9. On certification that complies with the requirements indicated in the draft Resolution and in the language of the country of origin and destination. Requirements for containers or means of transport using official seals from the exporting country's NPPO and conditions for loading them with the product. 12. Information on inspection upon arrival in the country by SAG officials and the possibility of splitting open the fruit to verify the absence of Opogona sacchari. 13. Actions in the event of detection of any stage of development, live or dead, of Bactrocera spp. during inspections by SAG of the consignment. In addition, actions in the event of detection of a live quarantine insect, listed in Resolution No. 3080 and its amendments or absent and that is a potentially live quarantine insect, not covered by this Resolution. 14. Given the restrictions resulting from the COVID-19 pandemic, and the need to maintain the smooth flow of trade between Brazil and Chile, it has been decided to temporarily suspend the in-person checks carried out by the Agriculture and Livestock Service (SAG). These checks will be assigned to the Ministry of Agriculture, Livestock and Food Supply (MAPA) of Brazil. For enabling resolutions to be issued, MAPA must send SAG a list of the production sites and packing companies that wish to participate for the first time in the programme for exporting fresh melons (Cucumis melo) and watermelons (Citrullus lanatus) to Chile. The notified text establishes specific sanitary requirements for the importation into Chile of viscera meal, meat and bone meal, feather meal and oils and fats of poultry, swine and horses, whether pure or blended. This is in view of the need to update domestic regulations by adopting measures aimed at preventing the introduction of infectious or contagious agents that can affect animal health. Furthermore, given the outbreaks of classical swine fever (CSF) and African swine fever (ASF) seen throughout the world, it has become necessary to establish security measures of the highest level to prevent the entry of CSF and ASF into Chile - a country free of these diseases. The notified text establishes phytosanitary requirements in the light of the health emergency caused by COVID-19, to waive the requirement for on-site verification by SAG of processing plants and their facilities for anti-sprouting treatment of potato (Solanum tuberosum L.) tubers for consumption from Argentina, that express interest in exporting to Chile for the first time, or that have ceased shipments for two or more seasons, in order to assess the conditions for their approval. For enabling resolutions to be issued, the Servicio Nacional de Sanidad Agraria, SENASA (National Agrarian Health Service) must submit an official technical report to SAG for analysis. This provisional measure shall only cover the 2021-2022 season (i.e. the period between 20 June 2021 and 20 June 2022). Provisional measure establishing phytosanitary requirements governing the importation of fresh mangoes (Mangifera indica) from Brazil. Ensures compliance with Resolution No. 4.638 of 2004. In this respect, given the restrictions resulting from COVID-19, and the need to maintain the smooth flow of trade between Brazil and Chile, it has been decided to temporarily suspend the in-person checks carried out by the Agriculture and Livestock Service (SAG). These and other related checks will be assigned to the Ministry of Agriculture, Livestock and Food Supply (MAPA) of Brazil. In 2019, Resolution No. 7.214 of 2014 was amended by SAG Resolution No. 7.677/2019 in order to suspend shipments from Costa Rica of ornamental plants for planting that were hosts of Opogona sacchari until appropriate risk management for this pest had been assessed. The genus Bromelia spp. was inadvertently omitted from the list of hosts of Opogona sacchari and must be added. In light of the above, Exempt Resolution No. 7.214 of 2014 establishing emergency measures to prevent the entry of Opogona sacchari in plants for planting that are host species has been amended to include the following provision: "As a temporary, emergency measure, shipments from Costa Rica of the following host species of Opogona sacchari are to be suspended: Aechmea fasciata, Archontophoenix spp., Bactris spp., Bambusa spp., Begonia spp., Bouganvillea spp., Bromelia spp., Caryota spp., Chamaedorea spp., Chrysalidocarpus spp., Cocos spp., Cordyline spp., Cycas spp., Dieffenbachia spp., Dracaena spp., Echinocactus spp., Echinopsis spp., Euphorbia pulcherrima, Euphorbia trigona, Ferocactus spp., Ficus spp.(Excepto Ficus carica), Gloxinia spp., Guzmania spp., Gymnocalycium spp., Hohenbergia spp., Nidularium spp., Notocactus spp., Philodendron spp., Phoenix roebelenii, Strelitzia spp., Tillandsia spp., Vriesea spp., Wodyetia bifurcata and Yucca spp." Further details can be found in the document attached to this notification.

The notified measure amends the second article of Resolution No. 3.491 of 2020, by extending the period during which sites authorized to grow fresh tomatoes under anti-aphid netting and pack them may do so, from 1 July 2021 to 30 June 2022. The notified text establishes phytosanitary requirements governing the importation into Chile of pistachio (Pistacia spp.) plants, cuttings and twigs from the state of California, United States of America. They stipulate, inter alia, that: 1. Consignments must include a phytosanitary certificate issued by USDA/APHIS, declaring that: - The material comes from an officially certified production programme or from germplasm nurseries or repositories controlled by the official plant health authority of the exporting country; - The consignment has been inspected and is free from the following arthropods: · Brevipalpus lewisi (Ac.: Tenuipalpidae); · Tetranychus pacificus (Ac.: Tetranychidae); · Choristoneura rosaceana (Lep.: Tortricidae); · Ferrisia gilli (Hem.: Pseudococcidae); · Parlatoria oleae (Hem.: Diaspididae); · Parthenolecanium pruinosum (Hem.: Coccidae); · Pseudococcus maritimus (Hem.: Pseudococcidae); - The plant material derives from mother plants that were inspected and tested (specify diagnostic technique) at the optimal time for detecting pests and found to be free from Xylella fastidiosa and Rhodococcus facians; - The production site was inspected at the optimal time for detecting pests, and the samples extracted from roots and soil underwent official laboratory analysis and were found to be free from Phymatotrichopsis omnivora; - In addition, consignments of rooted plants or cuttings must indicate that they have been found to be free from Xiphinema americanum sensu lato (excluding Chilean populations) and Xiphinema americanum sensu stricto, based on an official laboratory analysis finding; 2. The material must have undergone disinfestation treatment against insects and mites through immersion or spraying, and the phytosanitary certificate must state, in the section on treatment, the name of the product, the type of application and the dose used. 3. In addition, the plant material must comply with the following phytosanitary requirements, which will be verified during inspection at the point of entry: free of soil; free of flowers, leaves, fruits and other plant remains; plants or rooted cuttings may only enter the country dormant and with bare roots; packed in new packaging that is resistant to handling, sealable, and labelled in accordance with the regulations in force; the packing and packaging materials designed to provide cushioning or maintain humidity must not include plant material or substrates that can carry pests, such as straws of grass, wood shavings or chips, peat, etc. Further details can be found in the document attached to this notification.
