Notifications for European Union (1104 notifications)
Animal health protection measures for intra-Union trade in consignments of salamanders and the introduction of such consignments into the Union on the taxonomic order of Caudata, in order to ensure that the fungus Batrachochytrium salamandrivorans (Bsal) is not spread by such international trade in those animals. These measures take into account risk mitigation measures referred to in an EFSA Assistance (see below under point 9) and in particular provide for the appropriate quarantine, diagnostic testing and treatment of salamanders as well as for certification of their health status for their trade in and introduction into the Union. These measures are of temporary and emergency nature. A list of non-EU countries authorised for introduction into the Union of consignments of salamanders is also established.
The proposal notified in G/SPS/N/EU/228 (4 October 2017) was adopted as Commission Regulation (EU) 2018/290 of 26 February 2018 amending Regulation (EC) No 1881/2006 as regards maximum levels of glycidyl fatty acid esters in vegetable oils and fats, infant formula, follow-on formula and foods for special medical purposes intended for infants and young children (Text with EEA relevance) [OJ L 55, 27 February 2018, p. 27]. This Regulation shall enter into force on 19 March 2018.
The proposal notified in G/SPS/N/EU/159 (14 March 2016) was adopted as Commission Regulation (EU) 2018/213 of 12 February 2018 on the use of bisphenol A in varnishes and coatings intended to come into contact with food and amending Regulation (EU) No. 10/2011 as regards the use of that substance in plastic food contact materials (Text with EEA relevance) [OJ L 41, 14 February 2018, p. 6].This Regulation shall apply from 6 September 2018.
The proposal notified in G/SPS/N/EU/204 (29 March 2017) was adopted as Commission Regulation (EU) 2018/73 of 16 January 2018 amending Annexes II and III to Regulation (EC) No. 396/2005 of the European Parliament and of the Council as regards maximum residue levels for mercury compounds in or on certain products (Text with EEA relevance) [OJ L 13, 18 January 2018, p. 8].This Regulation applies since 7 February 2018.
The Union list of flavourings and source materials is laid down in Annex I to Regulation (EC) No 1334/3008. It was established by Commission Implementing Regulation (EU) No 872/2012 of 1 October 2012 adopting the list of flavouring substances notified in G/SPS/N/EU/13/Add.1 (12 October 2012). This is now amended by the draft "Commission Regulation (EU) amending Annex I to Regulation (EC) No 1334/2008 of the European Parliament and of the Council amending Annex I to Regulation (EC) No 1334/2008 of the European Parliament and of the Council as regards removal from the Union list of certain flavouring substances".This addendum concerns the withdrawal of the following three substances: p-Mentha-1,4(8)-dien-3-one (FL No. 07.127), 2-Aminoacetophenone (FL No. 09.821) and (FL No. 13.175) from the list of authorised flavouring substances.The European Food Safety Authority requested additional scientific data to be provided for completion of the pending evaluation as flavourings of these substances. The persons responsible for their placing on the market have withdrawn the application.The measure includes transitional measures for food to which any of these substances has been added.
The proposed Commission Regulation would amend Commission Regulation (EU) No. 10/2011 on plastic materials and articles intended to come into contact with food. Regulation (EU) No. 10/2011 is a specific Regulation within the framework Regulation (EC) No. 1935/2004. The latter sets out principles and procedures applicable to food contact materials. This amendment authorizes two new substances, extends the authorized use of a previously authorized substance, and decreases the specific migration limits for a previously authorized substance on the basis of new evidence, for materials intended to be in contact with foods.
The proposal notified in G/SPS/N/EU/202 (6 March 2017) was adopted as Commission Regulation (EU) 2018/98 of 22 January 2018 amending Annexes II and III to Regulation (EC) No 1333/2008 of the European Parliament and of the Council and the Annex to Commission Regulation (EU) No 231/2012 as regards calcium sorbate (E 203) (Text with EEA relevance) [OJ L 17, 23 January 2018, p. 14].This Regulation shall apply from 12 August 2018.
The proposal notified in G/SPS/N/EU/225 (31 August 2017) was adopted as Commission Regulation (EU) 2018/79 of 18 January 2018 amending Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food (Text with EEA relevance) [OJ L 14, 19 January 2018, p. 31]. This Regulation shall enter into force on 8 February 2018.
The proposal notified in G/SPS/N/EU/227 (4 October 2017) was adopted as Commission Regulation (EU) 2018/97 of 22 January 2018 amending Annex II to Regulation (EC) No 1333/2008 of the European Parliament and of the Council as regards the use of sweeteners in fine bakery wares (Text with EEA relevance) [OJ L 17, 23 January 2018, p. 11]. This Regulation shall apply from 11 February 2018.
The proposal notified in G/SPS/N/EU/197 (17 February 2017) was adopted as Commission Regulation (EU) 2017/1237 of 7 July 2017 amending Regulation (EC) No 1881/2006 as regards a maximum level of hydrocyanic acid in unprocessed whole, ground, milled, cracked, chopped apricot kernels placed on the market for the final consumer (Text with EEA relevance) [OJ L 177, 8 July 2017, p. 36].This Regulation entered into force on 28 July 2017.
The proposal notified in G/SPS/N/EU/223 (7 August 2017) has been adopted as "Commission Implementing Regulation (EU) 2017/2468 of 20 December 2017 laying down administrative and scientific requirements concerning traditional foods from third countries in accordance with Regulation (EU) 2015/2283 of the European Parliament and of the Council on novel foods" (Text with EEA relevance) [OJ L 351, 30.12.2017, p. 55].The Regulation will enter into force on 19 January 2018.
The proposal notified in G/SPS/N/EU/229 (24 October 2017) has been adopted as "Commission Implementing Regulation (EU) 2017/2470 of 20 December 2017 establishing the Union list of novel foods in accordance with Regulation (EU) 2015/2283 of the European Parliament and of the Council on novel foods" (Text with EEA relevance) [OJ L 351, 30.12.2017, p. 72].The Regulation will enter into force on 19 January 2018.
The proposal notified in G/SPS/N/EU/222 (7 August 2017) has been adopted as "Commission Implementing Regulation (EU) 2017/2469 of 20 December 2017 laying down administrative and scientific requirements for applications referred to in Article 10 of Regulation (EU) 2015/2283 of the European Parliament and of the Council on novel foods" (Text with EEA relevance) [OJ L 351, 30.12.2017, p. 64].The Regulation will enter into force on 19 January 2018.
New elements:On 14 December 2017 the European Commission adopted a Decision amending some elements of Commission Implementing Decision (EU) 2015/789 as regards measures to prevent the introduction into and the spread within the Union of Xylella fastidiosa (Wells et al.).Specific legal provisions have been introduced for the introduction into the Union territory of Coffea, Lavandula dentata L., Nerium oleander L., Olea europaea L., Polygala myrtifolia L., and Prunus dulcis (Mill.) D.A. Webb originating in a third country where Xylella fastidiosa is not present (Article 16, second subparagraph).Furthermore, the conditions to fulfil for production sites located in an area where Xylella fastidiosa is present have been updated (Article 17(4) points (c), (d) and (e)). Lastly, additional specified plants have been added to Annex I of the Decision as being found susceptible to Xylella fastidiosa and therefore subject to restrictions when introduced into and moved within the Union territory.
This draft Regulation sets proposed maximum residue levels (MRLs) for the substance lambda-cyhalothrin. MRLs for this substance in certain commodities are changed: either increased or lowered. Lower MRLs are set after updating the limits of determination and/or deleting old uses which are not authorised any more in the European Union or for which a human health concern may not be excluded. The residue definition of the substance has also been updated.
This Regulation reviews the list of imports of feed and food of non-animal origin which are subject to an increased level of official controls. The changes concern: (i) the listing of the following items: peppers (other than sweet) (Capsicum spp.) from India, Pakistan, Thailand and Viet Nam and roasted pistachios from the United States; (ii) the de-listing of the following items: table grapes from Egypt and aubergines (Solanum melongena) from Thailand. This Regulation also amends Regulation (EC) No 669/2009 to provide that the derogation from checks at the designated point of entry referred to in Article 9 thereof may be established in respect of existing entries in the list and not only in respect of new entries.
The proposal notified in G/SPS/N/EU/195 (6 February 2017) was adopted as Commission Regulation (EU) 2017/1973 of 30 October 2017 amending Regulation (EC) No 2074/2005 as regards official controls on fishery products caught by vessels flying the flag of a member State and introduced into Union after being transferred in third countries and establishing a model health certificate for those products (Text with EEA relevance) [OJ L 281, 31 October 2017, p. 21]. This Regulation shall apply from 1 July 2018.
The proposal notified in G/SPS/N/EU/224 (9 August 2017) was adopted as Commission Regulation (EU) 2017/2158 of 20 November 2017 establishing mitigation measures and benchmark levels for the reduction of the presence of acrylamide in food (Text with EEA relevance) [OJ L 304, 21 November 2017, p. 24]. This Regulation shall apply from 11 December 2017.
The proposal notified in G/SPS/N/EU/127 (29 April 2015) was adopted as "Commission Regulation (EU) 2016/1416 of 24 August 2016 amending and correcting Regulation (EU) No 10/2011 on plastic materials and articles intended to come into contact with food" [OJ L 230, 25 August 2016, p. 22].This Regulation entered into force on 14 September 2016.
The proposal notified in G/SPS/N/EU/196 (13 February 2017) was adopted as Commission Implementing Directive (EU) 2017/1279 of 14 July 2017 amending Annexes I to V to Council Directive 2000/29/EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community [OJ L 184].An addendum to this notification was published on 4 August 2017, in which the European Union informed about the adoption of the above measures. In addition, the European Union reminded trading partners the obligation to submit certain information to the European Union prior to 1 January 2018. In case the information is not provided by this date, the import into the EU territory of certain commodities will not be allowed.In G/SPS/N/EU/196/Add.1, Prunus persica (L.) Batsch was accidentally not mentioned in the 6th indent on page 1, amongst those commodities that would not be allowed to be imported into the EU territory if the requested information was not provided. Therefore, the text of notification G/SPS/N/EU/196/Add.1 should be amended and it should read as follows:NEW PROCEDURE:The European Commission invites non-EU trading countries to communicate prior to 1 January 2018, the date of the application of the above mentioned Directive, the following information:- for the import requirements for the bacterial causative agent of the citrus canker disease, whether the country is free from the harmful organism or the pest free areas of the country recognized in accordance with the relevant International Standards for Phytosanitary Measures. In the case of the export of fruits subjected to a treatment, the details of the treatment applied need to be communicated and its efficacy documented (see the new point (16.2) and point (18.4) of Annex IV Part A Section I of Council Directive 2000/29/EC regarding the import requirements for Xanthomonas citri pv. citri and Xanthomonas citri pv. aurantifolii)- for the import requirements for Cercospora angolensis, whether the country is free from the harmful organism or the pest free areas of the country recognized in accordance with the relevant International Standards for Phytosanitary Measures (see the new point (16.3) of Annex IV Part A Section I of Council Directive 2000/29/EC); - for the import requirements for citrus black spot, whether the country is free from the harmful organism or the pest free areas of the country recognized in accordance with the relevant International Standards for Phytosanitary Measures (see the new point (16.4) of Annex IV Part A Section I of Council Directive 2000/29/EC of Phyllosticta citricarpa)- for the import requirements for false codling moth, the treatment applied to the fruits. In addition, the effectiveness of the mentioned treatment needs to be documented (see the new point (16.6) of Annex IV Part A Section I of Thaumatotibia leucotreta). The requested information should be sent to the plant health contact point of the European Commission, Directorate General for Health and Food Safety:SANTE-G1-PLANT-HEALTH@ec.europa.eu. As of 1 January 2018, the import into the EU territory of the following commodities will not be allowed, if that information is not provided. Fruits of Citrus L., Fortunella Swingle, Poncirus Raf., Microcitrus Swingle, Naringi Adans., Swinglea Merr., and their hybrids originating in all non-EU countries; Fruits of Capsicum (L.), Prunus persica (L.) BatschPunicagranatum L. originating in countries of the African continent, Cabo Verde, Saint Helena, Madagascar, La Réunion, Mauritius and Israel; Plants of Microcitrus Swingle, Naringi Adans. and Swinglea Merr., other than fruits and seeds originating in all non-EU countries. The received information will be shared by the Commission with the competent authorities of the member States of the European Union. In addition, an overview of the submitted information will be uploaded in the Commission web site (https://ec.europa.eu/food/plant/plant_health_biosecurity_en).
