Approval of the List of substances (ingredients, components) that are allowed to be used in organic production process and allowed to be used in maximum permissible quantities. This list includes their description, composition requirements and conditions of use, which are in compliance with EU legislation in this field.

The draft Resolution is approved and contains the following: - the Procedure of inspection, survey, phytosanitary examination, supervision, monitoring, disinfection of regulated objects, issuance of certificates in accordance with the Law of Ukraine "On Plant Quarantine", control of inspections in terms of sampling and selective control over the conduct of phytosanitary examination; - the Procedure for maintaining the Register of authorized phytosanitary laboratories; - the Procedure for maintaining the Register of issued phytosanitary certificates; - a list of objects of regulation for the purposes of control over the movement through the territory of Ukraine; - a list of objects of regulation for the purpose of import, export and re-export; - a list of objects of regulation of any origin, subject to state control on the basis of a risk-oriented approach and criteria of selectivity of control. The draft Resolution is developed to increase the flexibility and efficiency of the phytosanitary control system in the terms of increasing volume of production and export of plant products as well as to improve phytosanitary procedures for import of regulated objects in the field of quarantine.

The Procedure: - establishes circumstances under which the special conditions for import of food and feed may be imposed; - increases the effectiveness of state control over their movement across the border; - eliminates or reduces the level of threat associated with the risk of the presence of a dangerous factor in the cargo being imported (shipped) to the customs territory of Ukraine.

Amendments to the List of regulated pests approved by Order No. 716 of the Ministry of Agrarian Policy of Ukraine dated 29 November 2006.

The amendments are made with regard to the maximum levels for certain contaminants in foodstuffs and the list of products in which the content of nitrates is determined. According to the amendments the maximum content of nitrates specified in paragraphs 7 - 23 of Section 1 of the Annex "Maximum permitted level for certain contaminants in food products" to the State Hygiene Regulations and Norms shall be revised three years after the entry into force of this draft order, on the basis of scientific evidence.Food products that meet the requirements that were in force before the entry into force of this draft order, but do not meet the requirements of this draft order, may be in circulation in the market before their expiry date.The amendments will come into force in 6 months after the official publication, except for paragraph 2 of Section 4 and Section 8 of the Annex "The maximum permitted level for certain contaminants in food products", which will come into force in 3 years after the entry into force of this draft order.

The Order contains requirements for importing (sending) into the customs territory of Ukraine of live animals, their reproductive material, food products of animal origin, feed, hay, straw, as well as by-products of animal origin and products of their processing. The Order defines requirements to the imported consignments based on risk-oriented approach referring to international standards. In particular, the principles of regionalization (zoning), compartmentalisation and equivalence for the purposes of international trade.

The Resolution aims to optimize the implementation of control procedures while moving goods across the customs border of Ukraine to ensure the objectivity, transparency and impartiality of the implementation of the state supervision (control) for compliance with the legislation in the field of seed and seedlings.The Regulation also provides favorable conditions for the verification of the documents by the state phytosanitary inspector prior to implementation of the phytosanitary control of seeds and planting material while its import and/or export using "single window" mechanism. Such documents are:- certificates of the exporting country certifying the quality of the seeds and/or planting material, OECD certificate and ISTA certificate for seeds and planting material, if it belongs to a variety included to the Ukrainian Register of Plant Varieties and/or to the List of OECD plant varieties of those agricultural plants, schemes of varietal certification which Ukraine has acceded. - confirmation on import of seeds and planting material for selection, research and exhibition, confirmation (notification) on import of experimental samples of plant varieties for examination of the application.

The Law establishes:- legal and organizational principles for providing consumers with information on food products in order to ensure a high level of protection of public health and meet their social and economic interests; - general principles and requirements on food information, in particular regarding food labeling, and the obligations of market operators to inform other market operators and consumers.

The draft Law regulates public relations in the areas of animal health, animal welfare, veterinary practice, production and circulation of veterinary medicines, substances, medicated feeds and premixes for such feeds, as well as substances with anabolic, antimicrobial, antiparasitic, anti-inflammatory, hormonal or psychotropic properties which can be used as veterinary drugs. The draft provides for amendments to several laws of Ukraine in the sphere of implementation of state control on veterinary medicine, including the import and export operations.

The Resolution of the Cabinet of Ministers of Ukraine "On certain issues of carrying out measures of official control of goods, which are imported into the customs territory of Ukraine (including for the purpose of transit)" provides: - a list of goods which, in case of import into the customs territory of Ukraine (including for the purpose of transit), are subject to official control; - a list of documents and data to be checked during the preliminary documentary control. According to this Resolution, 27 Resolutions of the Cabinet of Ministers of Ukraine have become invalid, including the Resolution No. 1031 of 5 October 2011 "On certain issues of carrying out of state control of goods transferred though the customs border of Ukraine".

The draft Resolution establishes the special requirements for: import of food products and feed; strengthened control over their movements via the state border of Ukraine; and decreasing the level of human health and animal health danger due to consignments imported into the custom territory of Ukraine.

The Law of Ukraine establishes the legal and organizational norms for feed safety guarantees during production, circulation and use, in particular requirement for hygiene, labelling, packing of feeds.

The Order establishes the list of the products subject to state control in the designated inspection points. The meaning of the listed groups names of commodities are compliant in accordance to the Law of Ukraine "On the Customs tariff of Ukraine".

This procedure defines the mechanism for the implementation of state control in countries that are planning to import (entry) products, food of non-animal origin or feed of non-animal origin to the customs territory of Ukraine, in order to verify conformity (equivalence) the system of state control of the exporting country to the legislation of Ukraine.

The draft Law of Ukraine "On Amending Certain Legislative Acts of Ukraine concerning the Regulation of carrying out Certain Phytosanitary Procedures" provides for:- the establishment of a procedure for the authorization of laboratories for the implementation of phytosanitary examination (tests), whose functioning will create an effective system of traceability of the conclusions of laboratories and phytosanitary certificates; - the implementation of the Register of Authorized Phytosanitary Laboratories;the legal regulation of the conduct of phytosanitary examination and arbitration of phytosanitary examination; - the determination of the validity period of phytosanitary certificates in the territory of Ukraine - 14 days; - the establishment of administrative responsibility of officials of phytosanitary laboratories for improper observance of the legislation on quarantine of plants during phytosanitary examination; - taking into account the phytosanitary requirements of the importing country when issuing a phytosanitary certificate for export and re-export.

The Draft Order establishes the maximum levels for certain contaminants in foodstuffs.

The Law of Ukraine regulates the legal and organizational affairs of state control to check compliance with: the legislation on food, feed, animal health and welfare by food business operators; and the legislation on imports of animal by-products into Ukraine.

The draft Order establishes requirements for:- the manufacturing of veterinary drugs, produced in Ukraine; - the circulation of veterinary drugs on the internal market; and - the export of veterinary drugs, as well as those that have been imported into Ukraine.

The draft Resolution establishes the procedure for conducting:  - audits of the state control system of the exporting country, from which the import (entry) of food of animal origin into Ukraine is permitted, and the maintenance of the register of such countries; and - inspections of facilities that produce food of animal origin for import (entry) into Ukraine, and the maintenance of the register of such facilities.

The draft Resolution establishes the form of the common veterinary entry document for imports and the form of the common entry document for imports with the aim to facilitate the strengthened control over the movement of food through the state border of Ukraine and the appropriate level of control activities.
