The proposed amendments seek to: 1. Revise the terms of "adding the functional ingredient in this code"; 2. Establish the standards of Food additives for "health functional food for children"; 3. Revise the application of the standards and specification of health functional food.
The Republic of Korea is proposing to amend the "Standards and Specifications for the Food Additives": 1) The standards and specifications of the following food additive are newly established: Ammonia (as an acidity regulator, manufacturing agent); 2) Test methods of specifications for the following 12 food additives are revised: Sodium metaphosphate, Sodium bisulfite, Smoke flavours, Cyclodextrin, Cyclodextrin syrup, Sodium nitrite, Sodium sulfite, Sodium hypochlorite, Hypochlorous acid water, Calcium hypochlorite, Tannic acid, Oleoresin paprika.
The Animal and Plant Quarantine Agency (APQA), Ministry of Agriculture, Food and Rural Affairs (MAFRA) in the Republic of Korea, has amended the quarantine pest list which is based on the result of a Pest Risk Analysis (PRA) and in accordance with the provisions of Articles 4 and 6 of the Ministerial Ordinance of the Plant Protection Act. The Animal and Plant Quarantine Agency (APQA), Ministry of Agriculture, Food and Rural Affairs (MAFRA) in the Republic of Korea, has added host plants of Radopholus similis, one of the prohibited quarantine pest of the Republic of Korea, which is based on the result of Pest Risk Analysis (PRA). The Ministry of Oceans and Fisheries of the Republic of Korea is in the process of amendment to Article 2 and Article 28 of Enforcement Rule of Aquatic Life Disease Control Act. The detailed amendment is as follows: (1) Three diseases of aquatic animal, such as "Acute hepatopancreatic necrosis disease", "Necrotising hepatopancreatitis" and "Infection with salmonid alphavirus" will be added to aquatic organism disease; (2) Eel fry for aquaculture and zebrafish for research and development to be imported will be added to those exempted from accompanying health certificate.
Since major nuclear power plant accidents, Korea has strengthened testing of Cs-134, Cs-137 and I-131 for imported food at the border. Based on the analysis of test data for recent five years, inspectors will collect the double amount of samples for radionuclides testing at the border. The products under increased sampling are limited to the food categories which have been returned from the customs after Cs-134 or Cs-137 was detected. Currently inspectors collect 1 kg of samples from each lot by random sampling plans. Inspectors will collect 2 kg of samples from each lot to assure representativeness of the sample.
The proposed amendment seeks to: 1. Revise the Standards for Safety Manufacture: - Include "Good Import Food Company" and "Good Foreign Food Facility" as Certification target; 2. Revise the Standards for Food Nutrition: - Limit the highly caffeinated food and lower the standard of protein and vitamin etc.; 3. Revise the Standards for Food Additives: - Expand the list of food additives that are not available such as Food Red No. 2.
This notification is to clarify renewal procedures of Good Importer and Good Foreign Food Facility at the expiration of the period of validity.
The proposed draft is designed to clarity the details of Article22 (Orders to Undergo Inspection) of the "Special Act on Imported Food Safety Control" and to ease concerns of unfavourable treatment applied to imported foods without a separate regulation. The proposed draft provides specification of the scope of imported food, etc. subject to inspection orders prescribes procedures for designation and removal of inspection order and describes detailed procedures that importers are required to follow.
The Republic of Korea is proposing the amendment of the "Special Act on Safety management of Children's Dietary Lifestyle". It is to prepare the basis for disclosing information by the Minister of Food and Drug Safety about restriction on advertising of sales of high-calories, low-nutrient foods and highly caffeinated foods on internet, newspaper, etc.
The Republic of Korea is adding changes to the "Special Act on Imported Food Safety Control". Foreign food facilities that comply with ‘Food safety management certification standards' of the Food Sanitation Act will be acknowledged as ‘Facilities adopting food safety management certification standards'. The items prescribed by Ordinance of the Prime minister will be allowed for importation to the extent that these items are produced, manufactured, processed, treated, packaged, stored from facilities adopting imported food safety management certification standards.
The proposed amendment seeks to: 1. Revise the limit for 3-MCPD in acid-hydrolysed soy sauce and blended soy sauce; 2. Establish a standard for amnesic shellfish poison (domoic acid) in shellfish and crustaceans; 3. Revise the limit for heavy metal (lead) in ‘Candies'; 4. Establish "Foods containing milk or milk products" as a new food type for foods mainly made of milk or milk products which do not meet the definition of "Milk products"; 5. Revise the maximum residual limits of pesticides for agricultural products: - 70 pesticides including Glyphosate.
The Republic of Korea is proposing to amend the "Standards and Specifications for the Food Additives": 1) General use level not to eat food additives itself is newly established; 2) The terms in preservation and distribution standard and the standards for the use of caffeine were revised further clearly; 3) In case of food additives made with microorganism, the provision on the kind of dossier for the toxicological data of microorganism at submission is newly established.
The proposed amendment seeks to: 1. Revise the Manufacturing/Processing Standards to allow ‘Beverage base' and ‘Processed fruit/vegetable product' to be manufactured in tablets; 2. Revise the Manufacturing/Processing Standards to allow acidic foods (pH of not more than 4.6) which require sterilization to be manufactured by pasteurization; 3. Revise the Food Irradiation Standard to allow the use of X-ray for food irradiation; 4. Exclude semi-processed bread products which are intended to be consumed after cooking from the application of limits for foodborne pathogens; 5. Remove the standard for total chlorine in ‘Edible salts'; 6. Revise the standards and specifications for prepared foods from food service business operator (including meal service facilities); 7. Revise the Annex 1 ‘Ingredients Approved for Use in Food' and Annex 2 ‘Ingredients Approved for Limited Use in Food'; 8. Revise the applicable subject of the maximum residual limits of veterinary drugs in foods by including Roxarson and Arsanolic acid in the list of substances that shall not be detected in foods; 9. Establish and revise the maximum residual limits of pesticides in agricultural products (160 pesticides including Iminoctadine); 10. Establish and revise the maximum residual limits of veterinary drugs in foods (Arsanilic acid, Fluralaner, Gamithromycin); 11. Establish the maximum residual limits of pesticides in livestock and fishery products (Pydiflumetofen); 12. Revise the General Test Methods; 13. Reflect the amendments made in other laws and clarify some wordings.
The proposed amendments seek to: 1. Add "Methyltetrahydrofolic acid, glucosamine salt" to the ingredients list of "folic acid"; 2. Revise the standard and specification of "ginseng", "Hyaluronic acid" and "billberry extract"; 3. Revise the specifications of "Green tea extract"; and 4. Revise the general testing methods.
Product subject to regulation: Bee pollen and processed pollen Substance subject to regulation: Pyrrolizidine alkaloids (PAs, 28 species) Recommended level: No more than 0.2 mg/kg Enforcement period: 1 September 2019 - 31 August 2020 Corrective measures will be taken in case a food product exceeds the recommended level: Urge to meet the recommended level and recommend actions for improvement (such as voluntary recall, labelling correction, etc.). In case actions for improvement are not executed to meet the level, relevant information will be publicly disclosed. The legal basis for this notification is The Food Sanitation Act Article 7-2 (Illustrations of Recommended Specifications, etc.).
The Ministry of Agriculture, Food and Rural Affairs (MAFRA) will enforce import requirements for used agricultural and constructional machinery. The main import requirements are as follows: - Used agricultural and constructional machinery should be inspected at the entry point, such as seaport or airport; - Regulated used machines are 18 items which is based on HSK code which contains used tractors and caterpillar type machineries; - Used machinery should not contain quarantine pest and prohibited articles of the Republic of Korea including soil; - If used machinery is intercepted with Korean quarantine pests or prohibited articles is imported, it will be treated, destroyed or returned according to the Korean Plant Protection Act. The Animal and Plant Quarantine Agency (APQA), Ministry of Agriculture, Food and Rural Affairs (MAFRA) in the Republic of Korea has updated the hosts and distributed areas of Xylella fastidiosa and the vectors, one of the prohibited quarantine pests of the Republic of Korea, which is based on the result of a Pest Risk Analysis (PRA). The comments above have been completed through the notification G/SPS/N/KOR/622. It will enter into force on 1 July 2019.
For each import declaration, submit one of the following documents: 1) Certificate of heat-treatment - Documents that indicate that pork used in the final product has been heat-treated (for at least 30 minutes at a minimum temperature of 70℃ or has gone through treatment as equivalent), and which are proved by the exporting country's government. 2) Certificate of ASF inspection - Documents that indicate that ASF virus was not detected in the final product, and which are issued by the inspection agency certified by exporting country's government or the exporting country's government. 3) ASF-free Certification - Documents that indicate that the final product is produced or processed using pork from ASF-free and healthy pig during all production and processing stages, and which are proved by the exporting country's government.
The planned importation and fast customs clearance system is to be introduced in order to allow rapid issuance of a Certificate of Confirmation of an Import Declaration at the border for imported foods that have been continuously imported from a good importer and with no record of non-compliance.
