This draft Commission Implementing Regulation provides that the approval of the active substance benfluralin is not renewed in accordance with Regulation (EC) No 1107/2009. EU Member States shall withdraw authorisations for plant protection products containing benfluralin as an active substance. The non-renewal of approval is based on the first evaluation of the substance for use as a pesticide active substance in the EU under Regulation (EC) No 1107/2009. The substance was formerly assessed and approved under Directive 91/414/ EEC.This decision only concerns the placing on the market of this substance and plant protection products containing it. Following non-approval and the expiry of all grace periods for stocks of products containing this substance, separate action will be taken on MRLs and a separate notification will be made in accordance with SPS procedures. In the proposal notified in G/SPS/N/EU/384 (24 April 2020) the description of content should read:This draft Commission Implementing Regulation provides that the approval of the active substance mancozeb is not renewed in accordance with Regulation (EC) No 1107/2009. The proposal notified in G/SPS/N/EU/327 (26 June 2019) was adopted as Commission Regulation (EU) 2020/354 of 4 March 2020 establishing a list of intended uses of feed intended for particular nutritional purposes and repealing Directive 2008/38/EC (Text with EEA relevance) [OJ L 67, 5 March 2020, p.1].This Regulation shall apply from 25 December 2020.

MRLs for these substances in certain commodities are changed: either increased or lowered. Lower MRLs are set after updating the limits of determination and/or deleting old uses which are not authorised any more in the European Union or for which a human health concern may not be excluded. This Regulation: Authorises 4 new substances; updates and adds limits to the general list of migration limits applicable to all plastics in point 1 of Annex II, including on lead, cadmium and mercury; lowers detection limits for primary aromatic amines; strengthens the information requirements under point 6 of Annex IV; adds testing rules for food processing equipment and appliances; requires that specific migration does not increase between subsequent tests for repeated use materials and articles; adds a new standard testing condition for overall migration; and,corrects some of the wording related to overall migration testing.

The draft Regulation establishes maximum levels for perchlorate in fruits and vegetables, tea, herbal and fruit infusions, infant formula, follow-on formula, foods for special medical purposes intended for infants and young children, young child formula, babyfood, processed cereal based foods for infants and young children.

The draft Regulation establishes maximum levels for glycidyl esters in fish oil and oils from other marine organisms and young child formula  (in addition to the already existing maximum levels for glycidyl esters for vegetable oils and infant formula and follow-on formula) and for 3-MCPD and 3-MCPD esters in vegetable oils, fish oils and oils from other marine organisms, infant formula , follow-on formula and young child formula.
