The notified Resolution amends Resolution No. 7.675 of 2016 by replacing the text of clause 2 of the Resolution with the following: "For each seed species specified in clause 1 of this Resolution, an alternative additional declaration stating that the pest/s is/are not present in the country of origin will be accepted. However, in the case of Tomato brown rugose fruit virus (ToBRFV), it cannot be certified by means of an alternative additional declaration that the pest is not present in the country of origin, as certification by sampling and official laboratory analysis is mandatory". It should also be noted that shipments en route to Chile with a certification dated prior to the entry into force of this standard shall be exempt from this requirement. The draft measure lays down sanitary requirements, including requirements concerning the country or area of origin, flock of origin, animals, meat and edible offal, packaging and transport and the corresponding health certification. The requirements include: 1. Edible offal is included in this draft, the scope of the measure is identified and product definitions provided; 2. The country or area of origin must be declared free of avian influenza and Newcastle disease, as established by the OIE, and must be approved by Chile; 3. The country or area of origin must have a permanent surveillance programme for avian influenza and Newcastle disease, in accordance with the requirements established by the OIE, that is approved by SAG; 4. The flock of origin of the poultry from which the consignment of meat and edible offal originates must be incorporated into a sanitary and production programme. It must also have an official Salmonella control and reduction programme that is approved and supervised by the official Service; 5. The poultry must have hatched or been imported as day-old chicks and been reared and slaughtered in the country or exporting area free of avian influenza and Newcastle disease. Furthermore, they cannot have been vaccinated against avian influenza with live vaccines, and must have been slaughtered, processed and stored in an establishment that is approved by SAG, and inspected pre- and post-mortem under the permanent monitoring of an official veterinarian; 6. The meat and edible offal must be covered by an official health certificate, issued by the competent health authority of the country of origin, in the language of the country of origin and in Spanish. It is necessary to update the phytosanitary requirements for underground structures for the vegetative propagation of ornamental species, in accordance with the latest scientific evidence and pest risk analysis. This draft Resolution updates the following phytosanitary requirements for the importation of underground structures for the vegetative propagation of ornamental species. Attention is drawn to the following points in its content: 1. For the purposes of this measure, underground structures for vegetative propagation shall be understood to mean all plant organs that develop under the surface of the soil and are used to multiply and propagate plants, such as bulbs, pseudo-bulbs, corms, tubers, rhizomes and tuberous roots; 2. The consignment must be covered by an official phytosanitary certificate issued by the phytosanitary authority of the country of origin, including the following general requirements: provenance, species identification, container identification and seals; It also specifies the additional declarations for the species/genus; 3. Indications and their registration in the phytosanitary certificate, effective disinfestation treatments for the control of insects and mites, through immersion or spraying, with products authorized in the country of origin, and a broad-spectrum fungicidal treatment through immersion or spraying for the products shipped; 4. Other requirements for consignments such as: being free from soil, substrates, accompanying elements designed to provide cushioning or maintain moisture, suitable packaging material for possible quarantine treatments at entry points, wood G/SPS/N/CHL/727 - 2 - packaging, waxed underground structures and conditions for their inspection by the SAG, requirements for packaging and information contained therein; 5. Quarantine treatments must be supervised by the National Plant Protection Organization (NPPO) of the country of origin; 6. The importer must declare the genetic status of materials genetically modified by modern biotechnology and comply with SAG regulations; 7. Ornamental species that must undergo post-entry quarantine must have authorization from the place of quarantine, which must be presented at the port of entry, at the time of arrival of the goods in the country; 8. Instructions concerning SAG inspection at the point of entry for physical and documentary verification of phytosanitary requirements established for their importation and actions in the event of detection of quarantine pests other than those required by this Resolution, listed in Resolution No. 3.080 of 2003 and amendments thereto, or not listed that are potentially quarantine pests; 9. Other conditions for rejection of materials regulated by the presence of structures such as leaves, flowers or roots or other plant remains, such as soil. Due to the need to periodically update phytosanitary import requirements for regulated items on the basis of new information available, especially on geographical distribution, hosts and pathways of entry of a given pest: − The ornamental host species of Opogona sacchari have been updated and phytosanitary requirements have been established for this pest on the following plants for planting: Aloe arborescens, Areca spp., Bismarckia nobilis, Phoenix spp. and Washingtonia spp.; − Due to the internal feeding habit of Opogona sacchari, which makes it difficult to detect at the point of entry, and the significant economic impact that its introduction, spread and establishment can have on the domestic production of the species it affects, the ornamental material must be monitored and analysed in containment under post-entry quarantine. Resolución Exenta Nº 1.187/2022: Aprueba texto coordinado y sistematizado de la resolución que establece requisitos fitosanitarios de ingreso para semillas de cereales, agrega requisitos fitosanitarios para las especies Triticum monococcum y Hordeum chilense y deroga Resolución N° 1.012 de 2004 (Exempt Resolution No. 1.187/2022 approving the coordinated and consolidated text of the Resolution establishing phytosanitary requirements for the importation of cereal seeds, adding phytosanitary requirements for the species Triticum monococcum and Hordeum chilense, and repealing Resolution No. 1.012 of 2004) Chile hereby advises that Exempt Resolution No. 1.187/2022, approving the coordinated and consolidated text of the Resolution establishing phytosanitary requirements for the importation of cereal seeds, adding phytosanitary requirements for the species Triticum monococcum and Hordeum chilense, and repealing Resolution No. 1.012 of 2004, was published in the Official State Journal on 15 March 2022. As indicated in Articles 12 and 13 of Exempt Resolution No. 1.187/2022, the entry into force shall be as follows: − The phytosanitary requirements for the importation of Triticum monococcum L. and Hordeum chilense seeds shall enter into force on 15 March 2022; − The phytosanitary requirements for the importation of seeds of species regulated under the Resolution and not mentioned above shall enter into force 180 days after 15 March 2022. https://members.wto.org/crnattachments/2022/SPS/CHL/22_2297_00_s.pdf

The notified document amends Resolution No. 2.834 of 2003 by replacing Article 1 on the "Glycine max (soya bean)" species and its entry requirements and additional declarations to be specified in the phytosanitary certificate, to read as follows: "The consignment has been inspected and is free from Heterodera glycines. The consignment has undergone a disinfection treatment with any of the following fungicides or combinations thereof, or another suitable product: Benomyl, Benomyl+Thiram, Carbendazim, Tiabendazol. The consignment has undergone a fumigation treatment against Bruchidius spp., Callosobruchus analis, Callosobruchus chinensis and Callosobruchus maculatus (Col. Bruchidae), in accordance with the specifications established in paragraph 6 of Resolution No. 2.834 of 2003." The notified measure establishes phytosanitary requirements:for the importation of walnut (Juglans spp.) tree plants and twigs coming from the United States of America to be used as propagation materials. Some of the measures established are: − The plant material must be covered by a phytosanitary certificate issued by the official phytosanitary authority of the United States of America (USDA/APHIS); − The plant material must come from an officially certified production programme or from a germplasm nursery or repository controlled by the official plant health authority of the relevant country; − The material must have undergone disinfestation treatment against insects and mites through immersion or spraying, and the phytosanitary certificate must state, in the section on treatment, the name of the product, the type of application and the dose used. The notified measure establishes the following: - The emergency and provisional suspension of the entry into Chile of fresh mangoes (Mangifera indica) produced in and coming from Peru until the Agriculture and Livestock Service (SAG) conducts an on-site audit of the process of exporting these fruits from Peru to Chile, updates the Pest Risk Analysis for fresh mangoes (Mangifera indica) coming from Peru and establishes, together with the National Plant Protection Organization of Peru, the phytosanitary measures needed to prevent the entry of quarantine pests; - Shipments of fresh mangoes (Mangifera indica) coming from Peru that have a certification dated prior to the publication in the Official Journal of Exempt Resolution No. 1242/2022 shall be exempt from this suspension. The notified measure establishes phytosanitary requirements governing the importation of in-shell and shelled ground-nuts of any origin. Some of the measures established are: - Shipments must be covered by an official phytosanitary certificate issued by the country of origin, along with the additional declaration indicated in point 1.1 of the document attached to this notification; - Moreover, some alternative additional declarations are described in point 1.2 of the notified draft. Phytosanitary treatments are established with their respective fumigation schedules; - The seal must arrive in Chile intact, otherwise it will be cause for rejection, a situation that may be analysed by SAG, at the request of the exporting NPPO. Shipments must be free of plant remains; - Shipments must be free of soil; this is understood to mean clods greater than or equal to 3 mm in diameter, a requirement that must be verified by the exporting NPPO prior to issuing the phytosanitary certificate; - The wood used for packaging, pallets and packing materials must comply with the quarantine regulations for importation; - Each shipment shall be inspected by SAG, at the point of entry, in order to ensure that the physical and documentary import requirements have been met. The measure lays down the requirement that the products' country of origin must be recognized by the World Organisation for Animal Health (OIE) as having a negligible risk of bovine spongiform encephalopathy (BSE) and maintain a surveillance programme for the disease in accordance with the recommendations of the OIE Terrestrial Animal Health Code. Under the measure, the raw material from which the products derive must originate from the products' country of manufacture or have been imported from countries that are recognized by the OIE as having a negligible risk of BSE and that maintain a surveillance programme for the disease. Furthermore, the raw material from which the products originate must come from animals that have been slaughtered in abattoirs approved by the competent authority. The animals must have undergone ante- and post-mortem inspections and be considered suitable for human consumption. With respect to the measure notified in document G/SPS/N/CHL/671, BSE-related requirements have been included for controlled risk countries and for microbiological product limits. The purpose of the notified draft Resolution is to combine Exempt Resolutions No. 24/2000 and No. 1.552/2008 under a new Resolution, including sheep, updating and harmonizing the sanitary requirements with the recommendations of the World Organisation for Animal Health (OIE). The draft Resolution lays down sanitary requirements for the importation into Chile of processed meat products of bovine animals, sheep, pigs and poultry. - Processed meat products are defined and divided into four categories: raw fresh, raw mature, raw acidified and cooked; - General conditions for the four categories are established, including: · Favourable assessment by the health authority of the country of origin; · Sanitary certificate; · Sanitary requirements for the animals from which the products originate; · Sanitary requirements for the raw material with which the products are processed; · Requirements for the establishments of origin; · Specific conditions are laid down for the entry of products, according to the category of product, animal species and associated risk diseases; · Sanitary requirements are established in relation to the health status of the countries of origin, or for compliance with the treatments described; · Etc. The purpose of the notified revision is to advise that, following the national public consultation process and in the SPS/WTO Committee, amendments were made to the original content as follows: - It was specified that the "diseases of concern" refer to those described in the Resolution; - The point on bovine spongiform encephalopathy (BSE) specifically concerning raw fresh bovine meat was removed and a new version of the BSE requirement was added to point 2 "General conditions for the four categories"; - All health requirements related to contagious bovine pleuropneumonia (CBPP) were removed; - Concerning raw fresh processed meat products of pigs, "...and this health condition must be favourably assessed by SAG" was added to point i; - The health declarations for African swine fever (ASF) were amended: Before: "...must be declared free of...". Now: "...must comply with the provisions laid down in the OIE Terrestrial Animal Health Code to be considered free from..."; - The requirement for swine vesicular disease was amended: Before: "country or area free of". Now: "establishment of origin free of". The specific treatment of this disease was also removed in point 4.2 "Treatment"; - "Notifiable avian influenza" has been replaced by "avian influenza", without further clarification; - Concerning raw fresh processed meat products of poultry, the following amendment was made: Before: "The establishment of origin of the poultry shall be included in a health and production programme, which shall be supervised by the competent health authority of the country of origin, and which shall be equivalent to the relevant requirements in Chile". Now: "The establishment of origin of the poultry from which the processed meat products originate shall be included in a health and production programme, which includes surveillance plans for avian influenza and Newcastle disease by the competent health authority of the country of origin. It shall also have an official Salmonella control and reduction programme, which shall be approved and supervised by the competent health authority of the country of origin."; - Under the same heading as above, the text in square brackets has been removed: "Where poultry are subject to a vaccination programme against avian influenza using inactivated vaccines, the vaccination plan shall be favourably assessed by SAG [and, on the basis of this assessment, the type of monitoring and sentinelization to be applied at the farm of origin shall be determined]".
