The draft Order provides for amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 391 "On Approval of the Requirements for Fruit Jams, Jellies, Marmalades and Sweetened Chestnut Purée" of 14 February 2024 (notified in document G/SPS/N/UKR/217/Add.1) and to the Requirements by setting them out in a new version. The proposed new version of the Requirements provides, in particular, for the following supplements: - the possibility of using the names 'marmalade' and 'marmalade extra' instead of the names of food products "jam" and “jam extra” respectively, except in cases where jam and jam extra are made from citrus fruits; - an increase in the minimum total fruit content in the production of jam and extra jam, thereby reducing the amount of added sugar needed to achieve the minimum soluble dry matter content in these products, and contributing to healthier nutrition; - the possibility of adding appropriate concentrated juices in the production of jam, jelly, as well as the addition of food additives that comply with the Requirements for Food Additives, approved by the Order of the Ministry of Health of Ukraine No. 45 "On Approval of Requirements for Food Flavours, Requirements for Food Additives and Requirements for Food Enzymes" of 8 January 2024 (notified in document G/SPS/N/UKR/200/Rev.1/Add.1). The draft Order also proposes to exclude provisions regarding the use of sulphur dioxide (E 220) or its salts (E 221, E 222, E 223, E 224, E 226 and E 227) in the processing of fruit raw materials.Furthermore, pursuant to the amendments proposed to paragraph 3 of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 391 of 14 February 2024, the words “may be placed on the market for three years” shall be replaced with the words “may be produced and/or placed on the market for three years”.The draft Order was developed in order to implement EU legislation. The draft Order provides for amendments to the List of food products of non-animal origin and feedstuffs of non-animal origin, the consignments of which are subject to enhanced state control when imported (sent) into the customs territory of Ukraine, as approved by Order of the Ministry of Agrarian Policy and Food of Ukraine No. 158 of 26 March 2018 (as amended by Order of the Ministry of Economy, Environment and Agriculture of Ukraine No. 952 of 30 October 2025).The draft Order proposes to replace the existing List with a new version to update the countries of origin and the scope of products subject to this control.The draft Order has been developed based on Commission Implementing Regulation (EU) 2026/194 of 28 January 2026 amending Implementing Regulation (EU) 2019/1793 on the temporary increase of official controls and emergency measures governing the entry into the Union of certain goods from certain third countriesimplementing Regulations (EU) 2017/625 and (EC) No 178/2002 of the European Parliament and of the Council.
Ukraine notifies the adoption of Order of the Ministry of Health of Ukraine No. 55 "On Approval of the Requirements Restricting the Use of Certain Epoxy Derivatives in Materials and Articles Intended to Come into Contact with Food" of 15 January 2026.The Order was registered in the Ministry of Justice on 29 January 2026 and published on 17 February 2026.The Order will enter into force on 17 May 2026.
Ukraine notifies the adoption of the Order of the Ministry of Economy, Environment and Agriculture of Ukraine of 15 December 2025 No. 3166 “On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1450 of 31 July 2023" (concerning the approval of requirements for fruit juices and certain similar products, previously notified in documents G/SPS/N/UKR/249 and G/SPS/N/UKR/249/Add.1).The Order was registered in the Ministry of Justice of Ukraine on 30 December 2025.This Order was published on 26 January 2026 and will enter into force six months after its official publication, i.е. on 26 July 2026.
The Law introduces amendments to Ukraine's legislation aimed at aligning sanitary and veterinary measures with the European Union acquis in the fields of animal health, animal welfare, food and feed safety and official veterinary controls. In particular, the Law provides for: - improving measures to ensure animal health, including the modernization of financing mechanisms for veterinary and sanitary measures and enhancement of epizootic surveillance and biosecurity systems; - improving state veterinary and sanitary control (supervision) over the production, registration, circulation and use of veterinary drugs; - introduction of EU-aligned animal welfare standards, including requirements related to keeping, transport and humane slaughter of farm animals; - regulation of feed and feed additives in order to ensure a high level of protection of animal and human health; - restrictions on the use of antimicrobial veterinary drugs, including the prohibition of their use for growth promotion and routine prophylactic purposes, in line with EU approaches. The adopted measures aim to protect human and animal health, prevent the spread of animal diseases, ensure the safe circulation of products subject to sanitary and veterinary control, and facilitate international trade through alignment with EU sanitary and phytosanitary rules.
The draft Order has been revised taking into account the results of consultations with stakeholders and now incorporates editorial amendments and clarifications, including those related to terminology. The revision clarifies the approach to the lists of substances used in dietary supplements and their safety characteristics. In order to eliminate ambiguous interpretations and ensure a unified approach, column 6 "Substances that are assessed in accordance with the requirements of permanent procedures based on the principles of the Hazard Analysis system" has been removed from List I "Plants, algae and fungi permitted for use in dietary supplements" of Annex 3 to the Hygiene Requirements for Dietary Supplements. The above-mentioned List I has also been updated by clarifying the names of plants, plant parts and the relevant warnings and restrictions, based on authoritative scientific sources and European Union practice. In List IV "Substances with a nutritional or physiological effect" of the same Annex, the substance "proanthocyanidins" has been clarified as "oligo-proanthocyanidins," which is in line with the available scientific conclusions of EFSA and other reliable sources; no separate daily intake limit has been set for this substance. The terminology related to dosage and safety parameters has been aligned with Ukrainian legislation through the use of the terms "acceptable daily intake" and "maximum permissible levels". The term "daily intake" is used as a descriptive indicator of recommended consumption within the established maximum permissible values. The final version also provides for the following: diosmin – without setting a separate maximum permissible daily level; hesperidin – 70 mg; flavonoids – 1 g, with the exception of flavonoids derived from Glycyrrhiza glabra, which are classified as novel food products. These amendments are intended to minimize the risk of products being perceived as medicines. In addition, the above–mentioned List IV has been supplemented with maltodextrin and casein hydrolysate, while List I has been supplemented with the fungus Tremella fuciformis Berk., which is permitted for use in dietary supplements. The draft Order is also notified under the TBT Agreement.
Ukraine notifies the adoption of the Order of the Ministry of Economy, Environment and Agriculture of Ukraine No. 953 "On approval of the Procedure for monitoring and reporting on antimicrobial resistance of zoonotic pathogens and commensal bacteria" of 30 October 2025.The Order was registered in the Ministry of Justice of Ukraine on 13 November 2025.This Order was published and entered into force on 12 December 2025. The Order will be applied from 1 March 2026, the same date as the Law of Ukraine No. 1206-IX “On Veterinary Medicine” (see G/SPS/N/UKR/154 and subsequent addenda).
The draft Order provides to establish requirements restricting the use of certain epoxy derivatives in materials and articles intended to come into contact with food and to implement Commission Regulation (EC) No 1895/2005 of 18 November 2005 on the restriction of use of certain epoxy derivatives in materials and articles intended to come into contact with food. The requirements apply to materials and articles, including active and intelligent food contact materials and articles, which are manufactured with or contain one or more of the following substances: 2,2-bis(4-hydroxyphenyl)propane bis(2,3-epoxypropyl) ether (hereinafter - BADGE), CAS No 001675-54-3, and some of its derivatives; bis(hydroxyphenyl)methane bis(2,3-epoxypropyl) ethers (hereinafter - BFDGE), CAS No 039817-09-9; other novolac glycidyl ethers (hereinafter - NOGE). The implementation of this Order will contribute to the protection of public health by preventing the potential harmful effects of certain epoxy resins that may be present in materials and articles intended to come into contact with food. It is also notified under the TBT Agreement.
Ukraine notifies the adoption of the Order of the Ministry of Economy, Environment and Agriculture of Ukraine No. 798 “On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 813 of 20 October 2022” of 20 October 2025.The Order was registered in the Ministry of Justice of Ukraine on 6 November 2025.This Order was published and entered into force on 2 December 2025.

The Resolution of the Cabinet of Ministers of Ukraine No. 1478 "On Amendments to Certain Resolutions of the Cabinet of Ministers of Ukraine Concerning the Establishment and Maintenance of Registers, Implementation of Customs Control and Official Control Measures" of 19 November 2025, introduces, in particular, amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 960 "On Some Issues of Official Control Measures of Goods Imported into the Customs Territory of Ukraine (including for the Purpose of Transit)" of 24 October 2018 (as amended), notified in documents G/SPS/N/UKR/130, G/SPS/N/UKR/230 and G/SPS/N/UKR/230/Corr.1.The amendments clarify certain descriptions of goods and their codes according to the UKTZED (Ukrainian Classification of Goods for Foreign Economic Activity) specified in the List of goods which, when imported into the customs territory of Ukraine (including for transit purposes), are subject to official control measures, as approved by Resolutions No. 960, in order to ensure consistency with the provisions of the Customs Tariff of Ukraine.
Ukraine notifies amendments to the previously notified text of the draft Order of the Ministry of Agrarian Policy and Food of Ukraine "On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1450 of 31 July 2023", taking into account comments received from the relevant central executive authorities. The amendments are as follows:Extension of the transitional period: fruit juices and certain similar food products that complied with the requirements in effect prior to the entry into force of this Order, but do not meet the provisions of the updated requirements, may continue to be produced and/or placed on the market for a period of six years (instead of three years in the previous version) from the date of entry into force of this Order, and may remain on the market until the end of their consumption date or the expiry of their minimum shelf life;Removal of the sampling and laboratory testing provision: the requirements for fruit juices and certain similar food products have been amended to delete the provision on sampling and laboratory testing (hereinafter referred to as the Requirements);Editorial revisions: several editorial amendments have been introduced to the draft Order, the Requirements, and Annex 3 to the requirements.These amendments are also notified under the TBT Agreement.
The draft Order has been developed to improve the regulatory framework governing the production and circulation of dietary supplements and food products containing added vitamins and minerals with a view to ensuring alignment with European Union legislation and harmonizing the terminology used therein with the legislation on food safety and certain quality indicators.The draft Order proposes amendments to:- Hygiene Requirements for dietary supplements, approved by the Order of the Ministry of Health of Ukraine No. 1114 of 19 December 2013;- Requirements for nutrition and health claims made on food products, approved by the Order of the Ministry of Health of Ukraine No. 1145 of 15 May 2020;- Rules on the addition of vitamins, minerals and certain other substances to foods, approved by the Order of the Ministry of Health of Ukraine No. 1613 of 16 July 2020 (notified in documents G/SPS/N/UKR/147, G/SPS/N/UKR/147/Add.1);- Requirements for Food Flavours, Requirements for Food Additives and Requirements for Food Enzymes, approved by the Order of the Ministry of Health of Ukraine No. 45 of 8 January 2024 (notified in document G/SPS/N/UKR/200/Rev.1/Add.1). The latter has been added compared to the previous version of the draft Order, notified in document G/SPS/N/UKR/246.It is also established that dietary supplements, which complied with the requirements in force prior to the entry into effect of this Order, but do not comply with the requirements of the Law of Ukraine No. 4122-IX of 5 December 2024 "On Amendments to Certain Laws of Ukraine on Improving the Regulation of Production and Circulation of Food Supplements, and the Regulation of Other Issues in the Healthcare Sphere" (notified in documents G/SPS/N/UKR/224 and G/SPS/N/UKR/224/Add.1), may be imported into the customs territory of Ukraine, manufactured and/or placed and remain on the market for one year after the entry into force of this Law. Such dietary supplements may remain on the market until the date of minimum shelf life or use-by date, but no longer than three years from the date of entry into force of this Law. The Law of Ukraine No. 4122-IX of 5 December 2024 came into force on 27 March 2025.The draft Order is also notified under the TBT Agreement.
Currently, Ukraine does not have a procedure for assessing the impact on human health of vitamins, minerals and other substances and their maximum permissible doses in food products offered for sale as dietary supplements. The adoption of such a procedure will allow the inclusion of substances and their maximum permissible doses in the List of vitamins, minerals and other substances and their maximum permissible doses permitted for use in dietary supplements in Ukraine.
The draft Order proposes to establish a procedure for monitoring and reportong on antimicrobial resistance of zoonotic pathogens and commensal bacteria, as well as reporting, identifying their sources of origin, and eliminating discrepancies in distribution.Monitoring and reporting will cover the following bacteria:Salmonella spp.;Campylobacter coliC. ColiCampylobacter jejuniC. jejunicommensal Escherichia coliE. coliSalmonella spp. and E. coli producing enzymes such as extended-spectrum β-lactamases (ESBL), AmpC β-lactamases (AmpC) and carbapenemases (CP);Staphylococcus aureus, methicillin-resistant (MRSA).They may cover commensal Enterococcus faecalisE. Faecalis) and Enterococcus faeciumE. FaeciumThis procedure procedure will also apply to the selection of samples from cargoes imported into Ukraine.
Ukraine notifies the adoption of the Resolution No. 1020 “On Amendments to the Resolutions of the Cabinet of Ministers of Ukraine No. 751 of 18 August 2010 and No. 893 of 22 August 2011”, which set out the Regulation on State Border Crossing Points and Control Points and the Rules of Sanitary Protection of the Territory of Ukraine, respectively.Resolution No. 1020 was published in the official gazette of Ukraine on 28 August 2025.It entered into force from the date of its publication and will be applied nine months thereafter, namely on 28 May 2026.
The draft Order proposes amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 813 of 20 October 2022, which sets out hygienic requirements for the production and circulation of food products of animal origin. The proposed changes address the following areas:operation of mobile slaughterhouses;rules for meat transportation;production process of dry-aged meat (dry aging);temperature requirements for storing fish products;organoleptic standards for eggs;use of lactic acid and recirculating hot water to reduce surface microbiological contamination of carcasses.
Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1910 "On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 157 of 13 April 2016" of 1 July 2025.The Order was registered in the Ministry of Justice of Ukraine on 23 July 2025 and published on 26 August 2025. Ukraine informs that the date of enactment of the Law of Ukraine No. 1206-IX “On Veterinary Medicine” of 4 February 2021 (notified in G/SPS/N/UKR/154/Add.1, G/SPS/N/UKR/154/Add.2) has been amended to 1 March 2026.This amendment was introduced by sub-clause 5 of clause 2 of Section IX of the Law of Ukraine No. 4341-IX "On Hops and Hop Products" of 27 March 2025 (notified in G/SPS/N/UKR/203/Add.1).
The Order approves the amendments to the State Medical and Sanitary Norms for safe usage of pesticides and agrochemicals, approved by the Order of the Ministry of Health of Ukraine No. 55 of 2 February 2016 (as amended by the Order of the Ministry of Health of Ukraine No. 1276 of 28 May 2020). The amendments provide for the clarification of certain items in Table 6, as well as the clarification and addition of specific items in Table 7 to the State Medical and Sanitary Norms for safe usage of pesticides and agrochemicals.
