Department of Agriculture Memorandum Order No. 45 Series of 2022, Lifting the Temporary Ban on the Importation of Domestic and Wild Birds and their Products Including Poultry Meat, Day-old Chicks, Eggs and Semen Originating from Denmark.

The Order, signed on 17 June 2022, institutes the following emergency measures for the importation of FMD-susceptible animals and their products from Indonesia: 1) Banning the importation of FMD-susceptible animals, their products and by-products;2) Immediate suspension of the processing, evaluation of the application and issuance of Sanitary and Phytosanitary (SPS) import clearance for the above-stated commodities;3) All shipments coming from Indonesia that are IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the official communication of this Order to the Indonesian authorities shall be allowed provided the products were slaughtered/produced before 29 March 2022.

Department of Agriculture Memorandum Order No. 26 Series of 2022, lifting the ban on the importation of live cattle, meat and meat products derived from cattle from the United Kingdom.

The measure revised DOST-DA-DENR-DOH-DILG Joint Department Circular (JDC) No.1, Series of 2016, previously notified as G/SPS/N/PHL/373. Changes include the creation of a Joint Assessment Group (JAG) tasked to evaluate biosafety permit applications and make recommendations on the approval of a biosafety permit application. The Circular reiterates the function of the Bureau of Plant Industry (BPI) in the processing of biosafety application permits. In compliance to the Ease of Doing Business (EODB) Law, the application procedure for securing a biosafety permit was shortened from 85 working days to 40 working days. The new JDC provides that application for permits for regulated articles developed in other countries may be filed directly for a Biosafety Permit for Field Trial if BPI determines data set generated in other countries is applicable to the local setting. The JDC also only requires an applicant to publish a copy of the approved Public Information Sheet (PIS) in one newspaper of general circulation and in the official website of the applicant and of the Bureau of Plant Industry.All biosafety permits for Commercial Propagation and Direct Use for Food and Feed or for Processing to be issued shall be valid unless revoked for:1. Provision of misleading information in the Application; 2. Discovery of new, relevant, and significant information that the regulated article poses greater risks to human health and the environment compared to its conventional counterpart; 3. Non-compliance with the conditions of the permit; and 4. Other grounds that the regulatory agencies may deem necessary to protect human health and the environment.The JDC includes a provision stating plants produced through conventional breeding of approved genetically modified parental lines and their derived products are not considered novel.  Payment of fees is possible to cover the cost of re-evaluation of the decision made on applications. The Circular also provides regulated articles with existing original and renewed Biosafety Permits under the 2016 version of the document for Commercial Propagation and Direct Use shall remain valid unless otherwise revoked under conditions enumerated in Sections 15.J and Sections 18.J.

The Order, signed on 7 March 2022, institutes the following emergency measures for the importation of domestic and wild birds and their products from Nova Scotia, Canada: 1) Banning the importation of domestic and wild birds and their products, including poultry meat, day-old chicks, eggs and semen from Nova Scotia, Canada; 2) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance for the above-stated commodities; 3) All shipments coming from Nova Scotia, Canada that are IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the official communication of this Order to the Canadian authorities shall be allowed provided the products were slaughtered/produced before 16 January 2022; 4) Shipments which have not complied with the conditions set forth in Item 3 shall be dealt with as per DA AO9 S. 2010 Section VII D.

The Order, signed on 7 March 2022, hereby institutes the following emergency measures for the importation of domestic and wild birds and their products from Italy: 1) Banning the importation of domestic and wild birds and their products, including poultry meat, day-old chicks, eggs and semen; 2) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance for the above-stated commodities; 3) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance of poultry processed animal proteins; 4) All shipments IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the official communication of this Order to the Italian authorities shall be allowed provided the products were produced before 4 October 2021; 5) Shipments which have not complied with the conditions set forth in Item 3 shall be dealt wiht as per DA AO 9 S. 2010 Section VII.D.

The Order, signed on 31 January 2022, hereby institutes the following emergency measures for the importation of domestic and wild pigs and their products from Italy:  (1) Banning the importation of live swine and their products, including pork meat, pig skin, processed animal proteins and semen; (2) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance for the above-stated commodities; (3) All shipments IN TRANSIT/ LOADED/ ACCEPTED INTO PORT before the official communication of this Order to the Italian authorities shall be allowed provided the products were slaughtered/produced before 23 December 2021; (4) Shipments which have not complied with the provisions set forth in Item 3 shall be dealt with as per DA AO 9 s.2010 Section VII.D.

The Order, signed on 31 January 2022, insitutes the following measures for the importation of domestic and wild pigs and their products from Thailand: (1) Banning the importation of live swine and their products, including pork meat, pig skin, porcine processed animal proteins and semen; (2) Stoppage and confiscation of all shipments of the above-stated commodities into the country by all DA Veterinary Quarantine Officers/Inspectors at all major ports.

The Order, signed on 31 January 2022, institutes the following emergency measures for the importatin of domestic and wild birds and their products from Croatia: (1) Banning the importation of domestic and wild birds and their products, including poultry meat, day-old chicks, eggs and semen; (2) Stoppage and confiscation of all shipments of the above stated commodities into the country by all DA Veterinary Quarantine Officers/Inspectors at all major ports.

Department of Agriculture Memorandum No. 03 Series of 2022 Lifting the Temporary Ban on the Importation of Live Cattle Meat and Meat Products and Bovine Processed Animal Proteins Derived From Cattle From Germany.

Department of Agriculture Memorandum Order No. 04 Series of 2022 Lifting the Temporary Ban on the Importation of Live Cattle, Meat and Meat Products and Bovine Processed Animal Proteins Derived from Cattle from Canada.

The Order, signed on 29 December 2021, institutes the following measures for the importation of meat and meat byproducts derived from cattle from Canada:  (1) Temporary suspeension of processing, evaluation of the application and issuance of the SPS Import Clearance of meat and meat byproducts derived from cattle includinglive cattle importation; (2) All shipments IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the officila communication of this Order to the Canadian authorities shall be allowed provided the products were slaughtered / produced before 30 November 2021; (3) All previously approved SPS Import Clearances which were not yet IN TRANSIT/LOADED/ACCEPTED UNTO PORT after the official communication of this Order to the Canadian authorities are hereby REVOKED; (4) Shipments with ship ou date after the communication of this Order to the Canadian Authorities shall be dealt with as per DA Administrative Order 9 series of 2010, Section VII.D; (5) More rigorous and tight inspection on all arrivals of meat and meat byproducts derived from cattle including live animals and bovine processed animal proteins by DA Veterinary Quarantine Officers assigned at ports of entry.

The Order, signed on 29 December 2011, hereby institutes the following emergency measures for the importation of domestc and wild birds and thier products from Ireland: (1) Banning the importation of domestic and wild birds and their products, including poultry meat, day-old chicks, eggs and semen; (2) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance for the above-stated commodities; (3) All shipments IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the official communication of this Order to the Irish auhtorities shall be allowed provided the products were slaughtered/produced before 22 November 2021; (4) Shipments which have not complied with the conditions set forth in Item 3 to Item 4 shall be deatlt with as per DA AO9 S. 2010 Section VII. D; (5) Importation of meat products of poultry is subject to the conditions provided in Article 10.4.18, 10.4.19 and 10.4.24 of OIE Terrestrial Animal Health Code (2021).

The Order, signed on 20 December 2021 institutes the following emergency measures for the importation of domestic and wild birds and their products from Belgium: 1) Banning the importation of domestic and wild birds and their products including poultry meat, day-old chicks, eggs and semen; 2) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance for the above-stated commodities; 3) All shipments IN TRANSIT / LOADED / ACCEPTED UNTO PORT before the official communication of this Order to the Belgian authorities shall be allowed provided the products were slaughtered/produced before 19 November 2021; 4) Shipments which have not complied with the conditions set forth in Item 3 to Item 4 shall be dealt with as per DA AO 9 S. 2010 Section VII.D; 5) Importation of meat products of poultry is subject to the conditions provided in Article 10.4.18, 10.4.19 and 10.4.24 of the OIE Terrestrial Animal Health Code (2021).

Department of Agriculture Bureau of Plant Industry Memorandum Updating the List of Commodities for Importation Requiring GM Declaration (1 December 2021) Pursuant to the DOST-DA-DENR-DOH-DILG Joint Department Circular No. 1 Series of 2016 Rules and Regulations for the Research and Development, Handling and Use, Transboundary Movement, release into the Environment, and Management of Genetically Modified Plant and Plant Products Derived from the Use of Modern Biotechnology, DA Memorandum Circular (MC) No. 8 series of 2003 Guidelines for the Phytosanitary Inspection of Regulated Articles for Food, Feed and Processing, DA MC No. 11 s 2003 Additional Signatories to the Declaration of GMO Content, and DA MC NO. 12 series of 2012 Annexes I, II, III Pursuant to Memorandum Circular No. 8 s 2003, all importers are required to declare GMO content of select commodities.  The said declaration should specify transformation events that are present in the shipment and may be issued by the responsible officer from the country of origin, accredited laboratories, shipper or importer. In this regard, the Memorandum is issued to update the list of commodities for importation requiring a declaration of GMO Content. The same enters into force on 28 December 2021.

The Order signed on 29 November 2021 institutes the following emergency measures for the importation of domestic and wild birds and their products from Japan: 1) Banning the importation of domestic and wild birds and their products, including poultry meat, day-old chicks, eggs and semen; 2) Immediate suspension of the processing, evaluation of the application and issuance of SPS import clearance for the above-stated commodities; 3) All shipments IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the official communication of this Order to the Japanese authorities shall be allowed provided the products were slaughtered/produced before 27 October 2021; 4) All other shipments accepted at the port of origin the day after the date of the official communication to the Japanese authorities are therefore advised not to sail; 5) Shipments which have not complied with the conditions set forth in Item 3 to Item 4 shall be dealt with as per DA AO 9 S. 2010 Section VII.D; 6) Importation of meat products of poultry is subject to the conditions provided in Articles 10.4.18, 10.4.19 and 10.4.24 of OIE Terrestrial Animal Health Code (2021).

The Order signed on 29 November 2021 institutes the following emergency measures for the importation of domestic and wild birds and their products from Hungary: 1) Banning the importation of domestic and wild birds and their products, including poultry meat, day-old-chicks, eggs and semen; 2) Immediate suspension of the processing evaluation of the application and issuance of SPS import clearance for the above-stated commodities; 3) All shipments IN TRANSIT/LOADED/ACCEPTED UNTO PORT before the official communication of this Order to the Hungarian authorities shall be allowed provided the products were slaughtered/produced before 1 November 2021; 4) All other shipments accepted at the Point of Origin the day after the date of official communication to the Hungarian authorities are therefore advised not to sail; 5) Shipments which have not complied with the conditions set forth in Item 3 to Item 4 shall be dealt with as per DA AO 9 S. 2010 Section VII. D; 6) Importation of meat products of poultry is subject to the conditions provided in Articles 10.4.18, 10.4.19 and 10.4.24 of OIE Terrestrial Animal Health Code (2021).
