The proposal notified in G/SPS/N/EU/289 (19 December 2018) was adopted as Commission Implementing Regulation (EU) 2019/1013 of 16 April 2019 on prior notification of consignments of certain categories of animals and goods entering the Union (Text with EEA relevance) [OJ L 165, 21 June 2019, p.8]. This Regulation shall apply from 14 December 2019.
The Commission implementing Decision lays down temporary animal health requirements for consignments of products of animal origin for human consumption originating from and returning to the Union following refusal of entry by third country. It aims to ensure that unloading, storage and re-loading of these products in third countries would not lead to risks for the spread and introduction into the Union of pathogens of certain listed animal diseases. It does not lay down import requirements for products of animal origin for human consumption, which were produced in and by third countries themselves.The animal health requirements in the Decision are close to, and largely replace in more specific terms, already existing requirements (which are more general and which are repealed as from 14 December 2019 by Regulation (EU) 2017/625 of the European Parliament and of the Council). The Decision is temporary in its nature bridging only the period from 14 December 2019 until 21 April 2021. From 21 April 2021 new animal health requirements for live animals and certain products of animal origin originating from and returning to the Union following refusal of entry by third country will be applicable. Those are laid down as part of a Commission Delegated Regulation supplementing Regulation (EU) 2016/429 of the European Parliament and of Council as regards rules for the entry into the Union, movement and handling after the entry of certain animals, germinal products and products of animal origin from third countries or territories. That Delegated Regulation was notified earlier as G/SPS/N/EU/329.
The proposed draft Regulation concerns the review of the existing maximum residue levels (MRLs) for the substances chlorpyrifos and chlorpyrifos-methyl. MRLs for these substances are lowered. Lower MRLs are set after updating the limits of determination and/or deleting old uses which are not authorised any more in the European Union or for which a human health concern may not be excluded.
It follows from Regulation (EU) 2017/625 on official controls and other official activities performed to ensure the application of food and feed law, animal health and welfare, plant health and plant protection products, that certain categories of animals and goods coming from third countries must be subject to specific official controls at the border control posts.Based on Articles 77(1)(h) of Regulation (EU) 2017/625 this draft Delegated Regulation lays down: the rules for the performance of specific official controls at border control posts on consignments of the categories of animals and goods referred to in Article 47(1)(a), (b) and (c) of regulation (EU) 2017/625 originating from and returning to the Union following refusal of entry by third country, additional rules on specific official control on consignments of products of animal origin and composite products. The requirements in Regulation replacing existing requirements. There are less strict conditions for transport as in existing requirements and it is relevant to the animals and goods of the Union origin.
The current measure prolongs the application of Implementing Decision (EU) 2018/320/EU until 20 April 2021, originally applicable until 31 December 2019.
The proposal notified in G/SPS/N/EU/339 (7 August 2019) was adopted as Commission Regulation (EU) 2019/1870 of 7 November 2019 amending and correcting Regulation (EC) No 1881/2006 as regards maximum levels of erucic acid and hydrocyanic acid in certain foodstuffs (Text with EEA relevance) [OJ L 289, 8 November 2019, p.37].This Regulation shall enter into force on 28 November 2019.
The proposal notified in G/SPS/N/EU/320 (10 April 2019) was adopted as Commission Regulation (EU) 2019/1559 of 16 September 2019 amending Annexes II and III to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for cyflufenamid, fenbuconazole, fluquinconazole and tembotrione in or on certain products [OJ L 239, 17 September 2019, p.1].This Regulation shall apply from 7 April 2020.
The proposal notified in G/SPS/N/EU/343 (9 September 2019) was adopted as Commission Implementing Regulation (EU) 2019/1881 of 8 November 2019 amending Regulation (EU) No 37/2010 to classify the substance diflubenzuron as regards its maximum residue limit (Text with EEA relevance) [OJ L 290, 11 November 2019, p.10].This Regulation shall apply from 10 January 2020.
The proposal notified in G/SPS/N/EU/338 (7 August 2019) was adopted as Commission Regulation (EU) 2019/1901 of 7 November 2019 amending Regulation (EC) No 1881/2006 as regards maximum levels of citrinin in food supplements based on rice fermented with red yeast Monascus purpureus (Text with EEA relevance) [OJ L 293, 14 November 2019, p.2].This Regulation shall apply from 1 April 2020.
The proposal notified in G/SPS/N/EU/316 (2 April 2019) was adopted as Commission Regulation (EU) 2019/1871 of 7 November 2019 on reference points for action for non-allowed pharmacologically active substances present in food of animal origin and repealing Decision 2005/34/EC [OJ L 289, 8 November 2019, p.41].This Regulation shall enter into force on 28 November 2019.
The proposal notified in G/SPS/N/EU/313 (20 March 2019) was adopted as Commission Regulation (EU) 2019/1792 of 17 October 2019 amending Annexes II, III and V to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for amitrole, fipronil, flupyrsulfuron-methyl, imazosulfuron, isoproturon, orthosulfamuron and triasulfuron in or on certain products (Text with EEA relevance) [OJ L 277, 29 October 2019, p.66].This Regulation shall apply from 18 May 2020.
Import requirements are put in place in relation to Rose Rosette Virus (RRV).
It follows from Regulation (EU) 2017/625 on official controls and other official activities performed to ensure the application of requirements of food, feed and plant health that certain consignments of food and feed of non-animal origin, plants, plant products and other objects should be subject to official controls at the border control posts. In certain cases identity checks and physical checks of these consignments may be performed at designated control points other than border control posts.This Delegated Regulation lays down specific rules for identity checks and physical checks performed at designated control points on consignments of plants, plant products, and other objects referred to in Article 47(1)(c) and (e) of Regulation (EU) 2017/625 and food and feed of non-animal origin subject to the measures provided for by the acts referred to in Article 47(1)(d)(e) and (f) of Regulation (EU) 2017/625. This Delegated Regulation also stipulates requirements for documentary checks performed at distance from the border control post on consignments of plants, plant products, and other objects referred to in Article 47(1)(c) of Regulation (EU) 2017/625.
The Official Controls Regulation (EU) 2017/625 empowers the Commission to establish, by means of delegated acts, the cases and conditions under which certain categories of animals and goods may be exempted from checks at border control posts. The Official Controls Regulation also empowers the Commission to adopt rules for the performance of specific controls and on measures in the case of non-compliance for certain categories of animals and goods.The categories of animals and goods exempted from checks at border control posts include certain categories of fishery products and certain categories of animals and goods entering the Union through certain Greek islands and through certain French territories. Specific control rules are set out for certain categories of fishery products, unskinned, furred wild game and certain categories of animals and goods entering the Union through certain Greek islands and through certain French territories.
It follows from Regulation (EU) 2017/625 on official controls and other official activities performed to ensure the application of requirements of animal health and welfare, plant health, food and feed, that certain consignments of animals, products of animal origin, animal by-products, germinal products, composite products, hay and straw, food and feed of non-animal origin, plants, plant products and other objects should be subject to specific official controls at the border control posts.This draft Delegated Regulation lays down:- the cases and conditions under which onward transportation may be authorised by the border control posts of consignments of food and feed of non-animal origin, plants, plant products and other objects to the place of final destination pending the availability of the results of physical checks;- specific time limits and control arrangements at the border control posts on consignments of animals, products of animal origin, animal by-products, germinal products, composite products, hay and straw, plants, plant products and other objects entering the Union by sea or by air transport from a third country, when those consignments are moved from a vessel or aircraft and are transported under customs supervision to another vessel or aircraft in the same port or airport in preparation for onward travel to third country or another European Union country;- the cases and conditions under which documentary checks, identity checks and physical checks should be performed at the border control posts of consignments of animals arriving by air or sea and staying on the same means of transport and which are intended for onward travel to third country or another European Union country;- the cases and conditions under which transit of consignments of animals, products of animal origin, animal by-products, germinal products, composite products, hay and straw, plants, plant products and other objects may be authorised by the border control posts and certain official controls to be performed on such consignments, including during the storage in approved warehouses or in free zones.
Certain animals and goods - based on the risk they pose to human, animal and plant health, animal welfare and the environment - must be subject to official controls at European Union (EU) borders, more specifically at the border control post of first arrival, before they can enter the Union. Those official controls are performed to ensure that consignments of animals and goods comply with the relevant import requirements and will consist of 100% documentary checks, whilst identity and physical checks will be performed at a frequency based on risk.The Official Controls Regulation (EU) 2017/625 empowers the Commission to establish, by means of delegated acts, the cases and conditions under which certain categories of animals and goods can be exempted from checks at border control post. In order not to undermine health protection, welfare and the environment, the exemptions will reflect the (low) risk associated with those animals and goods and will be subject to specific conditions and to specific controls. The Official Controls Regulation also empowers the Commission to adopt rules for the performance of specific controls. Such rules are established for passengers' personal luggage, small consignments of goods not intended to be placed on the market and pet animals entering the Union as part of a non-commercial movement.
The measure concerns the change in the specifications of the previously authorised novel food Lacto-N-neotetraose to account for a change in its purification during its synthesis from crystallisation to spray drying. The change results in minor changes in the composition of the novel food which do not affect its safety profile.
It follows from Regulation (EU) 2017/625 on official controls and other official activities performed to ensure the application of food and feed law, animal health and welfare, plant health and plant protection products, that certain categories of animals and goods coming from third countries must be subject to specific official controls at the border control posts.Based on Article 77(2) of Regulation (EU) 2017/625 this Delegated Regulation lays down rules and conditions for monitoring the transport and arrival of consignments of goods referred to in Article 47(1)(b) of Regulation (EU) 2017/625 which are intended for placing on the market in the Union, where the transport of those goods from the border control post of arrival to the establishment at the place of destination in the Union is required to be monitored in accordance with Union legislation. The requirements in Regulation replacing existing requirements. There are less strict conditions for transport as in existing requirements.
The measure concerns correction of the designation and the specific labelling requirement of the novel food Echinacea purpurea extract from cell cultures in the Union list. The measure also concerns correction of the specifications of yeast beta-glucans in the Union list and in the authorising Decision.
The proposal notified in G/SPS/N/EU/319 (5 April 2019) was adopted as Commission Regulation (EU) 2019/1582 of 25 September 2019 amending Annexes II and III to Regulation (EC) No 396/2005 of the European Parliament and of the Council as regards maximum residue levels for imazalil in or on certain products (Text with EEA relevance) [OJ L 246, 26 September 2019, p.1].This Regulation shall apply from 16 April 2020.
