The Draft is aimed at ensuring uniform application of the provisions of the Procedure for Conducting Quarantine Phytosanitary Control (Supervision) at the Customs Border of the Eurasian Economic Union and the Procedure for Conducting Quarantine Phytosanitary Control (Supervision) on the Customs Territory of the Eurasian Economic Union, established by the Customs Union Commission Decision as of 18 June 2010, No. 318, as well as correcting a technical inaccuracy in paragraph 4.1.6 of the Procedure applicable at the customs border.

The draft decisions amend the common veterinary (sanitary and veterinary) requirements of the Eurasian Economic Union by: introducing a requirement to certify the freedom of the territory of origin from Chronic Wasting Disease (CWD) for all imported animals of the deer (Cervidae) family; establishing veterinary requirements and the corresponding veterinary certificate for the importation of non-human primates intended for use as laboratory animals.

The draft amends the Common Quarantine Phytosanitary Requirements for Regulated Products and Pests at the Customs Border and in the Customs Territory of the EAEU with requirements for certain types of regulated products, including for new items subject to phytisanitary requirements, with regard to the causal agent of potato brown rot (Ralstonia solanacearum (Smith) Yabuuchi et al.). It also establishes requirements for fresh or dried grapes to ensure the absence of Pseudococcus comstocki (Kuwana).

The draft provides for the update of Section 3 of the Chapter II of the Common sanitary-epidemiological and hygienic requirements for products subject to sanitary-epidemiological supervision (control), which regulates the requirements for materials, reagents, equipment for water treatment and water purification.

The Draft Decision amends Common Sanitary-Epidemiological and Hygienic Requirements for Products Subject to Sanitary-Epidemiological Supervision (Control) with a requirement for maximum residues level (MRL) for cadmium (Cd) in sunflower kernels not to exceed 0.20 mg/kg.It also updates the existing MRLs for cadmium regarding specific confectionery products as follows:– Sunflower halva: 0.11 mg/kg;– Sunflower gozinaki (confectionery made of sunflower seeds): 0.14 mg/kg.The Technical Regulation TR CU 021/2011 “On Food Safety” will be updated accordingly.

The draft Decision withdraws the requirement for fresh or chilled tomatoes, peppers and aubergines (eggplants) to be free from Pepino mosaic virus (PepMV) as currently indicated in the Common Quarantine Phytosanitary Requirements for Regulated Products and Pests at the Customs Border and in the Customs Territory of the Eurasian Economic Union.

The draft Decision enables imports to, and transportation within the customs territory of  the Eurasian Economic Union (EAEU) of wood packaging and dunnage material without a phytosanitary certificate, if the goods indicated have been treated and marked in accordance with the Common Quarantine Phytosanitary Requirements for Regulated Products and Pests at the Customs Border and in the Customs Territory of the EAEU (approved by Decision of the Council of the Eurasian Economic Commission No. 157 of 30 November 2016).

The Draft Decision softens the requirements regarding maximum level for cadmium, contained in seeds of food poppy not intended for retail sale and used as an ingredient in bakery and confectionery products, compared to those currently applied as indicated in Section 1 of Chapter II of the Common Sanitary-Epidemiological and Hygienic Requirements for Products Subject to Sanitary-Epidemiological Supervision (Control).

The draft decisions amend the common veterinary (sanitary and veterinary) requirements with provisions on conditions for the importation of the controlled goods into the territory of the EAEU and revise specific chapters of the requirements regarding live animals and contagious animal diseases. They also imply updating the relevant acts of the Commission as follows:Corrections of legal and technical nature;Addition of new terms and definitions used in the text;Harmonization of nosological names of animal diseases;Standardization of wording for certain provisions that are repeated multiple times in the text;Repeal of the “Final and Transitional Provisions” section of the Requirements. Additionally, the draft decisions amend the corresponding veterinary certificates accordingly.

The draft amends the common list of goods subject to veterinary control (surveillance) with respect to group 3501 of the Common Commodity Nomenclature of Foreign Economic Activity of the Eurasian Economic Union.

The draft decisions provide for the establishment in the law of the Eurasian Economic Union of a requirement to confirm the disease-free status of the territory with respect to tropylelapsosis when importing and/or transporting honey bees (queen bees and bee packages).

The draft provides for amendments to the Common Quarantine Phytosanitary Requirements for Quarantine Products and Quarantine Objects at the Customs Border and in the Customs Territory of the EAEU in terms of establishment of quarantine phytosanitary requirements for seedlings, rootstocks, cuttings and fruits of apple and pear trees with regard to the pathogen of strawberry black spot (Colletotrichum acutatum), as well as editorial changes aimed at improving the Common Quarantine Phytosanitary Requirements.

The draft provides for a change in the effective date of the Rules to regulate the circulation of veterinary diagnostic tools on the customs territory of the Eurasian Economic Union, approved by the Decision of the Council of the Eurasian Economic Commission No. 140 of 23 September 2022 (hereinafter the Rules), as well as for technical and clarifying adjustment of the Rules.

The draft provides for the approval of the Rules for regulation of the circulation of feed additives in the customs territory of the Eurasian Economic Union (hereinafter - the Union), which include:- a unified procedure for the registration of feed additives, as well as other procedures related to registration;- a unified procedure for assessing the quality, safety and efficiency of feed additives and criteria for their assessment;- unified principles of information interaction in organizing and conducting state control (supervision) in the sphere of feed additives circulation;- unified forms of registration documents;- a unified register of feed additives registered under unified Union rules;- a unified information database on low-quality, unsafe feed additives, falsified and (or) counterfeit feed additives detected within the framework of state control (supervision) in the sphere of feed additives circulation;- a unified information database on adverse reactions in animals detected during the use of feed additives;- a unified register of producers of feed additives, the production of which is recognized as complying with the unified requirements of the Union.

The draft provides for amendments to the actions of the inspectors conducting veterinary inspections of third countries establishments. It also authorizes competent authorities to exclude enterprises that have not supplied the goods (products) under control to the customs territory of the Eurasian Economic Union for five years from the Registry of Establishments authorized to export to the the Eurasian Economic Union. The draft also specifies the conditions under which exports of the goods (products) under control from a third-country enterprise are subject to suspension. As well, the draft determines the procedure for the initiator of a joint verification (inspection) of third-country enterprises with respect to the suspension of exports from the enterprises that refuse to carry out verification (inspection) though being selected for it.

The draft introduces amendments in terms of allowing member States of the Eurasian Economic Union to agree and initial veterinary certificates that differ from the unified forms of veterinary certificates for goods subject to veterinary control (supervision) imported into the customs territory of the Union, approved by the Decision of the Commission of the Customs Union No. 607 of 7 April 2011 in electronic form through the use of electronic mail, determining the date of entry of such certificates into the customs territory of the Union.

The draft defines a list of veterinary and sanitary measures applied to goods subject to veterinary control (supervision) when imported into the territory of the Republic of Armenia and the Kyrgyz Republic.

The drafts update veterinary requirements of the Eurasian Economic Union concerning the frequency of laboratory tests of non-food raw materials of animal origin intended for feeding fur-bearing animals without preliminary heat treatment. The drafts also approve a new chapter of veterinary requirements and the corresponding form of a veterinary certificate for gelatin, collagen and adhesives of animal origin.

The draft provides for the possibility of simplifying the procedure for bringing the registration dossier of veterinary medicinal products in line with the requirements of the Rules for certain groups of veterinary medicinal products. The draft also contains technical amendments.

The draft regulation aims at using a phytosanitary risk assessment system when selecting control procedures for quarantine phytosanitary control, as well as at uniform decision-making in relation to batches of products subject to phitosanitary control when inconsistencies are identified in the phytosanitary certificate and shipping documents and when quarantine organisms are detected.
