The Order approves the Procedure for Conducting Periodic Research (Testing) of Feed by Market Operators for the Content of Substances that are Restricted or Prohibited. This Procedure applies to market operators engaged in activities related to the processing of crude vegetable fats and oils, production or processing of animal fats, production of feed mixtures for productive animals and other animals. Market operators engaged in the sale of fats, oils, and/or products derived therefrom intended for use in feed, including feed mixtures, shall conduct periodic laboratory research (testing) of samples of such fats, oils, and products in accredited laboratories to determine the total content of dioxins and dioxin-like polychlorinated biphenyls. According to the provisions of the Procedure the laboratory tests shall be carried out by market operators - importers who place feed on the market — in relation to: - 100% of imported consignments of crude coconut oil, animal fats, fish oil, oils and fats, received from food market operators, mixed fats and oils, tocopherols extracted from vegetable oils and their acetate derivatives, as well as products derived from oils and fats, excluding glycerin, lycetin, phospholipids; - acidic oils obtained as a result of chemical refining, crude fatty acids and pure distilled fatty acids obtained from decoupling, and soap-alkaline mixture in accordance with ongoing procedures based on the principles of the Hazard Analysis and Critical Control Points System (HACCP).
Ukraine notifies the adoption of the draft Resolution of the Cabinet of Ministers of Ukraine “On Amendment to Clause 3 of the Resolution of the Cabinet of Ministers of Ukraine No. 537 of 7 May 2022” as the Resolution of the Cabinet of Ministers of Ukraine No. 831 "On Amendment to the Resolution of the Cabinet of Ministers of Ukraine No. 537 of 7 May 2022” of 14 July 2025.The Resolution was published and entered into force on 16 July 2025.
Ukraine notifies the adoption of the Order of the Ministry of Health of Ukraine No. 685 "On Amendments to the Order of the Ministry of Health of Ukraine No. 1084 of of 26 June 2022" of 21 April 2025. The Order was registered in the Ministry of Justice of Ukraine on 5 June 2025 and published on 9 July 2025.The Order will enter into force on 9 October 2025.
The draft Order proposes amendments to the preamble of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1450 of 31 July 2023 "On Approval of Requirements for Fruit Juices and Certain Similar Products" (notified in the document G/SPS/N/UKR/204/Add.1) and to the Requirements, by setting them out in a new version that introduces the following updates: - the introduction of a new category of products for fruit juices, namely fruit juice with reduced sugar content, concentrated fruit juice with reduced sugar content and fruit juice from concentrate with reduced sugar content. These products have a reduced level of naturally occurring sugars while maintaining the essential physical, chemical, organoleptic, and nutritional characteristics typical of juice derived from the respective fruits; - the inclusion of sunflower seed protein in the list of permitted processing methods and substances used for clarifying fruit juices and certain similar food products; - the addition of analytical methods to ensure compliance with the compositional characteristics of certain types of fruit juices; - the addition of the term "coconut water" as a synonym for "coconut juice" to the special names for fruit juices and certain similar food products. It is also established that fruit juices and certain similar food products that complied with the requirements in effect prior to the entry into force of this Order, but do not meet the provisions of the updated Requirements, may continue to be produced and/or placed on the market for a period of three years from the date this Order enters into force, and may remain on the market until the end of their consumption date or the expiry of their minimum shelf life. The draft Order has been developed to align national legislation with relevant EU law. It is also notified under the TBT Agreement.
The draft Order proposes to amend the List of food products of non-animal origin and feedstuffs of non-animal origin, the consignments of which are subject to enhanced state control when imported (sent) into the customs territory of Ukraine, as approved by the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 158 of 26 March 2018 (as amended), by setting it out in a new version.The previous version of the List was notified in document G/SPS/N/UKR/231. The updated List is based on risks and other factors associated with types of food products and feedstuffs, importation history of the relevant consignments into Ukraine, control measures implemented by the food and/or feed business operator importing such products into Ukraine and guarantees provided by the competent authority of the exporting country (country of origin).The draft Order has also been developed taking into account Commission Implementing Regulation (EU) 2019/1793 of 22 October 2019 on the temporary increase of official controls and emergency measures governing the entry into the Union of certain goods from certain third countries, implementing Regulations (EU) 2017/625 and (EC) No 178/2002 of the European Parliament and of the Council and repealing Commission Regulations (EC) No 669/2009, (EU) No 884/2014, (EU) 2015/175, (EU) 2017/186 and (EU) 2018/1660 (entered into force on 8 January 2025).
The draft Resolution provides for amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 398 of 1 April 2022 "On Some Issues of Phytosanitary Measures and Procedures under Martial Law" (hereinafter – the Resolution No. 398, notified in G/SPS/N/UKR/170) in order to restore control over the import and movement of regulated objects within the territory of Ukraine intended to prevent the entry, spread and establishment of regulated harmful organisms in Ukraine.In 2022, pursuant to Resolution No. 398, phytosanitary control procedures were temporarily simplified in response to the full-scale invasion by the Russian Federation. In particular, the mandatory sampling and phytosanitary examination (analysis) for HS commodity groups 07-12 was suspended in the course of phytosanitary control of imports of regulated goods; phytosanitary control of the accompanying wooden packaging material of HS headings 4407 and 4415 was limited exclusively to accompanying wooden packaging material for goods subject to regulation; control over the movement of regulated goods within the territory of Ukraine was minimized, including the suspension of the requirement to have a quarantine certificate for certain regulated objects exported from quarantine zones. In order to resume the implementation of phytosanitary measures and procedures in accordance with the regular phytosanitary regulatory framework, the draft Resolution provides for:1) the cancellation of clause 2 of paragraph 1 and the Annex “Information on the recording of regulated objects moved through the territory of Ukraine without a quarantine certificate” to Resolution No. 398;2) the alignment of Resolution No. 398 with the provisions and terminology of the Procedure for Inspection, Survey, Phytosanitary Examination, Supervision, Monitoring, Disinfection of Regulated Objects, Issuance of Certificates, as established by the Law of Ukraine “On Plant Quarantine”, as well as the procedures for inspection control in terms of sampling and selective supervision of phytosanitary examinations, approved by Resolution of the Cabinet of Ministers of Ukraine No. 1177 of 15 November 2019 (notified in G/SPS/N/UKR/136/Add.1).
Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1700 "On Amendments to the Order of the Ministry for Development of Economy, Trade and Agriculture of Ukraine No. 1329 of 14 July 2020" of 29 April 2025.The Order was registered in the Ministry of Justice of Ukraine on 13 May 2025 under No. 740/44146 and published on 20 June 2025.It will enter into force on 20 December 2025.
The draft Order has been developed to improve the regulatory framework governing the production and circulation of dietary supplements and food products containing added vitamins and minerals. It proposes amendments to: - Hygiene Requirements for dietary supplements, approved by the Order of the Ministry of Health of Ukraine No. 1114 of 19 December 2013; - Requirements for nutrition and health claims made on food products, approved by the Order of the Ministry of Health of Ukraine No. 1145 of 15 May 2020; - Rules on the addition of vitamins, minerals and certain other substances to foods, approved by the Order of the Ministry of Health of Ukraine No. 1613 of 16 July 2020 (notified in documents G/SPS/N/UKR/147, G/SPS/N/UKR/147/Add.1). The draft Order is also notified under the TBT Agreement.
The Order amends subparagraphs 1 and 2 of clause 2 of Annex 1 to the Requirements for Food Flavourings With Smoke Aroma (Smoke Flavourings), approved by the Order of the Ministry of Health of Ukraine No. 338 of 28 February 2025 (notified in document G/SPS/N/UKR/235/Add.1), by replacing the term “mg/kg” with “μg/kg” (mcg/kg) respectively.
Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1534 “On Approval of Hygienic Requirements for Edible Caseins and Caseinates” of 27 March 2025.The Order was published on 3 June 2025 and will enter into force on 3 December 2025.
The draft Order aims to incorporate into national legislation provisions prohibiting the use of the terms "chocolate", "white chocolate", "milk chocolate", "family milk chocolate", "chocolate a la taza" and "familiar a la taza chocolate" for food products that contain vegetable fats other than those complying with the Requirements for Cocoa and Chocolate Products, approved by the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 157 of 13 April 2016.These terms refer to specific food product names that may only be used if the relevant provisions of above-mentioned requirements are fully complied with, and they are used in trade to identify such products. These terms may also be used as part of the names of other products, provided that such use does not mislead consumers.The draft Order is also notified under the TBT Agreement.
The draft Resolution has been developed to prevent the introduction of particularly dangerous animal diseases into the territory of Ukraine and to improve the mechanisms of veterinary control over the transit of productive animals. It proposes to amend Clause 3 of the Resolution of the Cabinet of Ministers of Ukraine No. 537 of 7 May 2022 by setting it out in a revised version. The draft Resolution provides for the establishment of the legal grounds for the movement of products originating from countries subject to restrictions due to outbreaks of diseases listed by the World Organisation for Animal Health (WOAH), or other diseases that pose a threat to human and/or animal health, as defined by the legislation of Ukraine or international law. It also contains provisions for regulating imports of consignments with productive animals and reproductive material from establishments not considered compliant with the legislation of Ukraine, as well as the transit of such consignments exclusively through territories officially recognized by the competent authority of the relevant country as free from particularly dangerous animal diseases. The proposed amendments are essential, as they will ensure the effective implementation of mechanisms to prevent the import of high-risk animal products, implement veterinary and sanitary measures aimed at ensuring epizootic safety and protect the territory of Ukraine from the introduction or spread of particularly dangerous animal diseases from other countries.
Ukraine notifies the adoption of the draft Resolution of the Cabinet of Ministers of Ukraine "On Approval of Certain Acts of the Cabinet of Ministers of Ukraine on State Registration of Genetically Modified Organisms" as the Resolution of the Cabinet of Ministers of Ukraine No. 584 "Certain Issues of the State Registration of Genetically Modified Organisms" of 21 May 2025.The Resolution was published on 24 May 2025 and will enter into force simultaneously with the entry into force of the Law of Ukraine No. 3339-IX "On State Regulation of Genetically Engineered Activities and State Control over Placing GMOs and Genetically Modified Products on the Market" of 23 August 2023, i.e. on 16 September 2026.
The Order approves the amendments to the State Medical and Sanitary Norms for safe usage of pesticides and agrochemicals, approved by the Order of the Ministry of Health of Ukraine No. 55 of 2 February 2016 (as amended by the Order of the Ministry of Health of Ukraine No. 1276 of 28 May 2020). The amendments provide for the clarification of certain items in Table 6 and the addition of Table 7 to the State Medical and Sanitary Norms for safe usage of pesticides and agrochemicals.
Ukraine notifies the adoption of the Resolution of the Cabinet of Ministers of Ukraine No. 542 “On Approval of the Procedure for Classifying Drinking Water as Natural Mineral Water” of 9 May 2025.The Resolution was published and entered into force on 14 May 2025.
This Resolution amends the Clause 2 of the Resolution of the Cabinet of Ministers of Ukraine No. 1229 "On Amendments to the Procedure of inspection, survey, phytosanitary examination, supervision, monitoring, disinfection of regulated objects, issuance of certificates in accordance with the Law of Ukraine "On Plant Quarantine", control of inspections in terms of sampling and selective control over the conduct of phytosanitary examination" of 25 October 2024. In view of the amendments introduced, Clause 2 of the Resolution No. 1229 shall be revised to read as follows: “2. It is established that: Quarantine certificate forms produced as of the date of entry into force of this Resolution may be used within three months from the date of entry into force of this Resolution. Unused forms shall be disposed of in accordance with the legislation;Phytosanitary certificate forms and phytosanitary re-export certificate forms produced as of the date of entry into force of this Resolution shall be used until 31 October 2025 for the export or re-export of regulated objects to countries that do not exchange such certificates through ePhyto HUB pursuant to the information posted on the official website of the Secretariat of the International Plant Protection Convention (IPPC). Unused forms shall be disposed of in accordance the legislation.”
Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1455 “On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 159 of 26 March 2018” of 14 March 2025.The Order was registered in the Ministry of Justice of Ukraine on 31 March 2025, and was published and entered into force on 7 May 2025.
Ukraine notifies the adoption of the draft Order of the Ministry of Health of Ukraine "On Approval of Requirements for Smoke Flavourings" as the Order of the Ministry of Health of Ukraine No 338 "On Approval of Requirements for Food Flavorings With Smoke Aroma (Smoke Flavorings)" of 28 February 2025.The Order was registered in the Ministry of Justice of Ukraine on 14 March 2025 and published on 15 April 2025.The Order will enter into force on 15 October 2025.
The Order of the Ministry of Health of Ukraine No. 1084 "On Approval of Safety Requirements and Certain Quality Indicators for Infant Food" of 23 June 2022 (G/SPS/N/UKR/166, G/SPS/N/UKR/166/Add.1) establishes a transitional period for infant food products that complied with the requirements in effect prior to the entry into force of the Order No. 1084, but do not meet the adopted Requirements set forth by this Order. According to the provisions of the Order No. 1084 such infant food may be imported to Ukraine, produced and/or put into circulation for three years after the entry into force of this Order (entered into force on 29 October 2022). It also specifies that such infant food may be in circulation until the expiration date, or the minimum shelf life or the "use before" date. Due to the full-scale invasion by the Russian Federation, domestic infant food manufacturers have faced significant challenges, including the inability to technically upgrade production facilities, which makes it impossible to meet certain safety requirements and specific quality indicators for infant food introduced by the Order 1084, in particular, regarding compliance with the docosahexaenoic acid indicator. In view of the above, the proposed amendments to the Order No. 1084 aim to extend the transitional period. The amendments also apply to Annex 1 (Clause 2 of Section II) and Annex 3 (Clause 3 of Section II) of the Requirements for the Safety and Certain Quality Indicators for Infant Food, specifically regarding the establishment of protein requirements for Groups C and D. The draft Order is also notified under the TBT Agreement.
Ukraine notifies the adoption of the Law of Ukraine No. 4341 "On Hops and Hop Products" of 27 March 2025.The Law was published on 18 April 2025 and will come into force on 18 April 2027, except for clauses 2 and 3 of the Section IX of this Law, which shall enter into force on 19 April 2025. Section IX of the Law contains provisions regarding the entry into force of the Law and the introduction of amendments to the current legislation of Ukraine to align it with international standards in the field of agriculture, particularly in such areas as plant varieties, plant quarantine, hop growing, veterinary medicine, viticulture, and other related sectors.
