For consumer protection, The Ministry of Public Health (MOPH) is proposing to revise the MOPH Notification concerning the maximum residue level of pesticides in Food through a risk-based framework; focused on either short term (acute) or long term (chronic) exposures using Thai Food consumption data and field trial data. Main elements of the draft notification as follows: (1) The MOPH notification BE 2554 (2011) on Food Containing Pesticide Residues, dated 14 April 2011 and The MOPH notification (No.361) B.E.2556 (2013) on Food Containing Pesticide Residues No 2, dated 6 August 2013, is repealed and replaced by this (Draft) MOPH Notification; (2) The Pesticide residues in food shall comply with the MRLs/EMRLs set forth in the attachment 2 and 4 to this MOPH Notification. In cases other than those specified in the attachment 2 the pesticide residues in food shall not exceed the limits as recommended by the Codex Alimentarius Commission, Joint FAO/WHO Food Standard Programme; (3) Default limit set forth in the attachment 3 to this MOPH Notification. In cases other than those specified in the attachment 3, shall not exceed defaults limit 0.01 mg/kg; (4) The method of analysis shall be prescribed in the attachment 5.

The Ministry of Public Health (MOPH) entitled "Botanicals, animals or parts of botanicals or animals prohibited when used in food" has been previously notified by the Food and Drug Administration (Thai FDA), Ministry of Public Health as G/SPS/N/THA/238 dated 13 July 2016. The Thai Agricultural Standard entitled "Good Manufacturing Practices for Milk Collection Center" has been previously notified by the National Bureau of Agricultural Commodity and Food Standards (ACFS), Ministry of Agriculture and Cooperatives in G/SPS/N/THA/228 dated 16 March 2015. This Standard has been adopted in the Official Gazette dated 17 October 2016. For consumer protection, the Ministry of Public Health (MOPH) is proposing the notification on good practice for packing houses as follows: 6.1 Annex I of the draft MOPH notification indicates a list of some types of fresh fruit or vegetables which shall be packed by proper operations; 6.2 The minimum requirements for packing house operations or good practices are summarized in Annex II of the draft MOPH notification in order to ensure that only safe fruits or vegetables shall be collected, packaged and distributed to consumers; 6.3 Importers who import such fresh fruits or vegetables as indicated in Annex I shall provide, as good practice, a certificate of satisfaction as required under this notification or otherwise meet the minimum requirements of this notification; 6.4 The minimum requirements for retail labelling are that each display must clearly show the following : 1) Name and address of producer (packing house) or importer and country of origin; 2) Registration Number; 3) Code or Number of production lot. This information should be on the label of the original container. Where such fresh fruits or vegetables are presented to the consumer without packaging, the required information must be clearly and prominently displayed on a label on the container or tray. If not, the retailer should have a record of the required information that is accessible to consumers; 6.5 Those who receive production or importing licenses for such fresh fruits or vegetables prior to the enforcement of this ministerial notification, which do not comply with this ministerial notification, shall include these identified improvements or provide certificates, as the case may be, within one year from the date of entry into force of the notification; 6.6 This notification shall come into force after one year as from the date of its publication in the Royal Gazette.
The Standard entitled "Good Aquaculture Practices For Hatchery of Disease Free Pacific White Shrimp (Litopenaeus vannamei)" has been previously notified by the National Bureau of Agricultural Commodity and Food Standards (ACFS), Ministry of Agriculture and Cooperatives in G/SPS/N/THA/227 dated 13 February 2015. For consumer protection, the Ministry of Public Health (MOPH) is proposing, based on the scientific evidence, that botanicals, animals or parts of botanicals or animals naturally which contain toxin or substance of concern for human health shall be prohibited to use in food as follows: (1) List of Botanicals, animals or parts of botanicals or animals shall be prohibited to use in food as in annex of this notification; (2) This notification shall come into force on the following date after its publication in the Royal Gazette.

The Ministry of Public Health (MOPH) is proposing to revise the MOPH notification concerning Import Requirement for Food with Risk from Bovine Spongiform Encephalopathy as follows: 1. The MOPH Notification No. 296 (B.E. 2549) (2006) entitled "Re: Foods with Risk from Bovine Spongiform Encephalopathy", dated 13 January 2006; and The MOPH Notification No. 375 (B.E. 2559) (2016) entitled "Import Requirement for Food with Risk from Bovine Spongiform Encephalopathy", dated 1 April 2016 are repealed and replaced by this (Draft) MOPH Notification; 2. Classified the BSE risk status of the bovine population of a country, zone or compartment into three categories according to the OIE criteria, as follows: - Category 1: Negligible BSE risk Country; - Category 2: Controlled BSE risk Country; and - Category 3: Undetermined BSE risk Country; 3. Described the definitions of "Meat", "Fresh Meat" and "Meat products"; 4. Prescribed the import requirement to be in compliance with the OIE criteria; 5. Prescribed the requirements of evidence or certificate or Health Certificate, to approve that the foods comply with the requirements, to present to the officer at the port of entry; 6. This notification shall come into force on 21 July 2016.
