This Regulation is an amendment of few Regulations of the Minister of Marine Affairs and Fishery (MMAF) such as Number PER.09/MEN/2007 regarding Requirements of Importation of Live Fish by Baggage to The Territory of The Republic of Indonesia, Number PER.20/MEN/2007 regarding Quarantine Action to Importation and to Domestic Movement of Quarantine Pests and Diseases of Fish Carrying Media; and Decree of the Minister of Marine Affairs and Fishery Number KEP.06/MEN/2002 regarding Requirements and Examination Procedure of Quality of Fishery Product Imported Into the Territory of the Republic of Indonesia.This regulation covers requirements and procedures for entry of carrier media and fishery product into the territory of Indonesia and from one area to another within the country. By the stipulation of this regulation, the Regulation of the Minister of Marine Affairs and Fishery Number PER.09/MEN/2007 regarding Requirements of Importation of Live Fish by Baggage to The Territory of The Republic of Indonesia, Regulation of the Minister of Marine Affairs and Fishery Number PER.20/MEN/2007 regarding Quarantine Action to Importation and to Domestic Movement of Quarantine Pests and Diseases of Fish Carrying Media; and Decree of the Minister of Marine Affairs and Fishery Number KEP.06/MEN/2002 regarding Requirements and Examination Procedure of Quality of Fishery Product Imported Into the Territory of the Republic of Indonesia are no longer effective.

This decree is intended to appoint designation of place of entry and place of exit for carrier media of animal quarantine diseases and quarantine pest (plant, plant product, animal, animal product and other biologic material and other material). The designation of port of enty and port of exit is including seaport, airport, cross border port, dry port and post office throughout the territory of Indonesia.

The types of Quarantine Pest Category A1 (pests and diseases that are not in the territory of Indonesia). List of Quarantine Pest Group I and Group II (Category A1), as follows:- Category A1 is quarantine pest that has not occurred in the territory of Indonesia  - "Plant Quarantine Pest Category I" means Plant Quarantine Pest which could not be released by treatment;  - "Plant Quarantine Pest Category II" means Plant Quarantine Pest which could be released by treatment.

The maximum level requirement for microbiological and chemical contaminants in food has previously been regulated in the Regulation of the Head of NADFC No. HK.00.06.1.52.4011 in 2009. Due to developments in food science and technology, and also the amendment of regulations by other countries regarding the maximum level of heavy metal contaminant requirements, NADFC has now finished amending the requirements of heavy metal contaminants in Annex II of the 2009 regulation. The NADFC will revoke Annex II of the 2009 regulation and replace it with the draft regulation of the Head of NADFC of Indonesia on the Maximum Level of Heavy Metal Contaminant in Processed Food.This regulation sets out the maximum levels of specified heavy metals, i.e. arsenic, cadmium, mercury, lead and tin, in processed food by food category.Once this new regulation is issued, the previous 2009 regulation (Regulation of the Head of NADFC No. HK.00.06.1.52.4011) regarding the requirements of heavy metal contaminants in processed food is declared to be invalid.

This Regulation specifically regulates the radiation source, types of food, maximum absorbed doses, irradiation purposes, re-irradiation, packaging requirements, irradiation facility, and labelling for irradiated food. a. Radiation sources Irradiated foods must use radiation sources as follows: - Gamma rays from radionuclides 60Co and 137Cs; - X-rays generated from machine sources operated at or below an energy level of 7.5 MeV; - Electrons generated from machine sources operated at or below an energy level of 10 MeV. b. Type of food, maximun absorbed doses, and irradiation purposes regulated in Appendix I. c. Re-Irradiation - Irradiated foods shall not be re-irradiated, except for foods with low moisture content, and irradiated for purpose of controlling insects; - Food is not considered as having been re-irradiated when :   i. the irradiated food is prepared from materials which have been irradiated at low dose levels for quarantine control, prevention of sprouting, maturation inhibition;  ii. the food, containing less than 5% of irradiated ingredient, is irradiated; or when iii. the full dose of ionizing radiation required to achieve the desired effect is applied to the food in more than one increment as part of processing for a specific technological purpose; - The cumulative maximum absorbed dose delivered to a food should not exceed the maximum dose regulated in Appendix I. d. Packaging - Absorbed doses of packaging used for irradiated food must be suitable for absorbed doses of food; - Types of packaging regulated in Appendix II. e. Irradiation facility - Radiation treatment of foods shall be carried out in licensed and registered facilities issued by BAPETEN; - The facilities shall meet the requirements of good practices for irradiated food; - The facilities shall make records for every batch of irradiated food, and keep for five years; - Every six months, the facilities shall report the records to the Head of NADFC RI and/or to the Minister of Agriculture of Indonesia, Ministry of Marine Affairs and Fisheries of Indonesia. f. Labelling - The labelling of irradiated food must contain the following information: i. Statement of "Irradiated Food"; ii. Statement "Should not be re-irradiated"; iii. Date of treatment; iv. Name of country where treatment has been done; v. Symbol for irradiated food.

This draft of regulation requires the kind of products, country of origin, establishment unit, packaging, labelling and transportation.

This draft of the Agricultural Ministerial Decree regulates the requirements for importation of food products from animal origin, the requirements for exportation of food products from animal origin, inspection and assistance and also provision of sanction.

This Decree stipulates kinds of quarantine pests and diseases of fish, with their categories, carrier, and dissemination area as listed in the annex that is an integral part of this Decree. By the stipulation of this Decree, the importation, exportation and domestic movement of carrier into and within the territory of Indonesia shall be free from QPDF.As used in this regulation:a. Quarantine pests and diseases of fish means all pests and diseases of fish which have not been introduced and/or have been established in certain area within the territory of Indonesia, which can spread rapidly in short period and cause social-economic losses or harmfulness to community health; b. Quarantine pests and diseases of fish class I means all Quarantine Pests and Diseases of Fish which can not be free from its carrier because the treatment's technologies has not been mastered; c. Quarantine pests and diseases of fish class II means all Quarantine Pests and Diseases of Fish which can be free from its carrier because the treatment's technologies have been mastered; d. Carrier of QPDF means fish and/or other material capable of carrying Quarantine Pests and Diseases of Fish and/or Certain Fish Pest and Diseases; e. Fish means all aquatic biota the life cycle of which takes place whole or partly in water, whether alive or dead, including parts thereof.

This regulation has been issued in connection with the development of science and technology where animal quarantine documents and certificates that have been used are no longer appropriate and need to be reviewed. This regulation is intended as a basis for the implementation of the issuance of quarantine documents, and aims at a common understanding and uniformity and orderly administration of the implementation of quarantine measures. The scope of this regulation covers the types and forms of documents, the procedures for filling and using quarantine documents, and quarantine document printing.

This regulation specifies the requirements on the use of flavouring as food additive in processed food as follows: - Flavouring food additives referred to in this regulation are classified as natural flavouring, naturally identical flavouring, and artificial flavouring. The classification is based on the source and the process of flavouring production. For labeling purposes, naturally identical and artificial flavouring must be stated in the label as artificial flavouring; - The allowed substances used in flavouring are listed in Annex 1. The use of flavouring substances other than those listed in Annex 1 should only be used after obtaining approval from the Chairperson of NADFC; - The allowed adjunct flavouring are listed in Annex 3; - The maximum residue for extraction solvent flavouring in food product are listed in Annex 4; - The flavourings allowed to be used in follow up formula are listed in Annex 5; - The flavourings allowed to be used in complementary foods for infants and young children are listed in Annex 6. Flavouring and processed food containing flavourings which have obtained a marketing approval must adhere to this regulation no later than 24 months from the enactment of this regulation. Flavouring and processed food containing flavourings which are submitted before the enactment of this regulation will be processed based on the Indonesia's National Standard on flavouring.

This Regulation is substitutes of Regulation of the Minister of Agriculture No. 04/Permentan/PP.340/2/2015 concerning Food Safety Control on Importation and Exportation of Fresh Food of Plant Origin, and Regulation of the Minister of Agriculture No. 13/Permentan/Kr.040/4/2016 concerning Revision to the Regulation of the Minister of Agriculture No. 04/Permentan/PP.340/2/2015 concerning Food Safety Control on Importation and Exportation of Fresh Food of Plant Origin. This Regulation has been stipulated and enforced on 18 November 2016. This regulation covers: a. Types of FFPO commodities an contaminants; b. Import requirements; c. Recognition of food safety control system and registration of food safety testing laboratories of a country; d. Import control; e. Monitoring; f. Suspension and revocation of recognition, revocation of registration, and closure of Fresh Food of Plant Origin (FFPO) importation from countries with food safety control system has not been recognized and laboratory has not been registered; g. Food Safety Emergency Situation This regulation regulate some specifies changes of the Regulation of the Minister of Agriculture No.04/2015 as follows: a. Reduction the type of regulated FFPO from 103 into 100 commodities. Dates, cocoa beans, and olives are excluded; b. The mechanisms of FFPO Safety Control as follows: - Recognition of food safety control system of origin country; - Registration of food safety testing laboratory/ies in exporting country; - Food safety inspection of FFPO importation from countries with food safety control system has not been recognize and laboratory has not been registered. c. Changes on format and issuance of requirement documents; d. Provisions of food safety control on exportation of FFPO will be regulated on separate regulation Country recognition of food safety control system and registration of testing laboratories for FFPO that have been approved before the entry into force of this Regulation, remains valid until it expires. Once this regulation has been enforced, the Regulation of Minister of Agriculture No. 04 of 2015 and No. 13 of 2016 will be revoked.

This regulation is an amendment of several provisions in the Regulation of the Minister of Agriculture No. 58/Permentan/PK.210/11/2015 concerning Importation of Carcasses, Meat, and/or Its Processed Products Into the Territory of the Republic of Indonesia (notified as G/SPS/N/IDN/105). This regulation covers Import Requirements, Import Procedures, Control, and Penalties. This regulation specifies some provisions of the Regulation of the Minister of Agriculture No. 58/2015 that were amended as follows: a. Business operators, national state owned enterprises, local state owned enterprises, social institutions, or representatives of foreign countries/international institutions should carry out importation in accordance with the recommendation of the Directorate General of Livestock and Animal Services acting on behalf of the Minister; b. The provisions on the amount of local beef absorption is no longer regulated; c. Any type of carcass, meat, and/or its processed products derived from bovine or from meat other than bovine that is not listed in Annex I and Annex II can be given recommendations as long as it meets the requirements of safe, healthy, wholesome and Halal products; d. The timeframe for submission of recommendations by business operators, national state owned enterprises, local state owned enterprises, social institution, or representatives of foreign countries/international institutions is no longer regulated. Applications of recommendations can be submitted at any time on working days; e. Recommendations proposed by business operators, national state owned enterprises, local state owned enterprises no longer require evidence that local beef absorption has been verified by provincial agencies and/or district/city of local beef origin. Recommendations have to be accompanied by the distribution plan of carcasses and bovine meat according to the format-2; f. The issuance of recommendations by the Director General for carcasses and/or bovine meat will take into consideration the realization of previous importation and the distribution plan; g. After receiving the recommendation (submitted online) from the Director General, the Director of the Center for Plant Variety Protection and Agriculture Licensing will then submit this recommendation to the Minister in charge of government affairs in the trade sector. This recommendation will be submitted through the portal of the Indonesian National Single Window (INSW); h. The period for the issuance of recommendation is no longer regulated; i. HS code and description of the products, including the number of kilograms (kg) per HS code, must be included in the recommendation; j. The recommendation number contained in the recommendation should be listed in the certificate of health that accompanies the product at each shipment; k. The validity period of recommendation is six months, starting from the date of issuance; l. Business operators, national state owned enterprises, local state owned enterprises, social institution, or representatives of foreign countries/international institutions which carry out importation should report their imports of carcasses and bovine meat listed in Annex I every month. This should be reported online by the 15th of the following month to the Director General according to format-3. Scans of the import declarations for the types of products that have been affected by the provisions related to electronic recording of imports should be attached; m. Business operators, national state owned enterprises, and local state owned enterprises which carry out importation should report online the distribution of carcasses and bovine meat to the Director General according to format-4 every Thursday; n. Business operators, national state owned enterprises, local state owned enterprises, social institution, or representatives of foreign countries/international institutions which violate the provisions related to import permits, the shelf life of carcass and meat, and recommendation requirements, shall be penalized in the form of a written warning, temporary suspension of the activities of importation and/or distribution, or not given a recommendation for six months; o. Provision for the inclusion of the recommendation number in the certificate of health will enter into force after three months from the date of promulgation of this regulation; p. This regulation comes into force on the date of promulgation.

The Maximum Level Requirement of Microbiological and Chemical Contaminant in Processed Food are regulated in the Regulation of the Chairman of NADFC No. HK.00.06.1.52.4011 Year 2009. Due to some regulation development from another countries regarding the maximum microbiological contaminant requirements; and certain requirements from the regulation are not applicable for the last six years, NADFC amends the requirement of microbiological contaminant in Annex part A of the regulation and will revoke and replace with this Draft Regulation of The Chairman of NADFC RI on Microbiological Criteria in Processed Food. This draft regulates and specifies the microbiological criteria: 1. The type of food category; 2. the type of microorganism and the microbiological limits (m,M); and 3. how to control it by guiding the sampling plan to the laboratory test defining the number of sample units to be taken (n), the size of the analytical unit and where appropriate, and the acceptance number (c). As this new regulation is issued, therefore the regulation of the Chairman of NADFC No. HK.00.06.1.52.4011 Year 2009, regarding the requirement of Microbiological Contaminants and microbiological criteria in food declared to be invalid.
