This Normative Instruction establishes the lists of nutrients, bioactive substances, enzymes and probiotics, limits of use, claims and supplementary labeling of food supplements. Annex I defines the list of probiotics and source ingredients of nutrients, bioactive substances and enzymes authorized for use in food supplements. Annex II sets out the list of minimum levels of nutrients, bioactive substances, enzymes and probiotics to be provided by dietary supplements in the daily recommendation for consumption and by the population group indicated by the manufacturer. Annex III sets out the list of maximum levels of nutrients, bioactive substances, enzymes and probiotics which can not be exceeded by food supplements in the daily recommendation for consumption and by the population group indicated by the manufacturer. Annex IV sets out the list of claims authorized for use on the labeling of food supplements and their composition and labeling requirements. Annex V sets out the list of supplementary labeling requirements for food supplements. Annex VI defines the list of essential amino acid quantities of the reference protein.

This Resolution establishes the requirements for proving the safety and health benefits of probiotics. This Resolution covers probiotics for use in foods, including food supplements.It does not apply to evidence of the safety and health benefits of probiotics added in infant formulas. Demonstration of the health benefits of probiotics should be performed by proving allegation of general functional property or specific functional property. In the case of a mixture of probiotics, the demonstration of health benefits should be performed by substantiating evidence of specific functional property. The requirement to prove the claim of functional property does not apply if all lineages of the mixture claim general functional property or if all lineages have the same claim of specific functional property. Requests for registration not yet decided by Anvisa upon the entry into force of this Resolution may be added within 6 (six) months in order to meet the new requirements established by it.

This Resolution provides for food additives and technology adjuvants authorized for use in food supplements. Food additives authorized for use in food supplements, their respective functions, ceilings and conditions of use are listed in Annex I to this Resolution. Food additives and technology adjuvants shall meet the most current specifications set forth by the Joint FAO / WHO Expert Committee on Food Additives (JECFA) or Food Chemicals Codex (FCC) Food Chemicals. The period of 24 (twenty four) months is established for the adequacy of the products covered by this Resolution that, at the date of their publication, are regularized with the National Health Surveillance System.

This Resolution amends Resolution RDC No. 27 of 6 August 2010, which provides for categories of food and packaging exempt and with mandatory sanitary registration. This Resolution amends the list of food and packaging exempted from mandatory sanitary registration on the Annex I and the list of food and packaging with mandatory sanitary registration on the Annex II of Resolution RDC No. 27, of 2010.
