The regulation provides for a coordinated approach to ensuring the traceability of quarantined products (freights, goods, materials) of high phytosanitary risk. The draft regulation applies to the products in the List of quarantined products subject to quarantine phytosanitary control (supervision) at the customs border of the EAEU and imported into the customs territory of the EAEU and moved through the customs territory of the EAEU, approved by the Customs Union Commission Decision as of 18 June 2010 No. 318.

The draft provides for the establishment in the Common sanitary-epidemiological and hygienic requirements for products subject to sanitary-epidemiological supervision (control) of the standards for veterinary medicinal preparations in foodstuffs of animal origin. The standards have been developed on the basis of the residue limits of veterinary medicinal preparations established in the international standard of the Codex Alimentarius Commission – CX/MRL 2-2018 and the regional standard of the European Commission – Regulation No 37/2010 of 22 December 2009 on pharmacologically active substances and their classification regarding maximum residue limits in foodstuffs of animal origin.

The Draft provides for the amendment of the List of quarantined products (quarantined freights, quarantined materials, quarantined goods) subject to quarantine phytosanitary control (supervision) at the customs border of the Eurasian Economic Union and in the customs territory of the Eurasian Economic Union (hereinafter "the List") approved by the Customs Union Commission Decision dated 18 June 2010 No. 318 in terms of transferring the position "Unmanufactured tobacco and tobacco refuse" (the HS code 2401 of the Common Commodity Nomenclature of Foreign Economic Activity of the Eurasian Economic Union) from Part II of the List "Quarantined products (quarantined freights, quarantined materials, quarantined goods) with a low phytosanitary risk" to Part I of the List "Quarantined products (quarantined freights, quarantined materials, quarantined goods) with a high phytosanitary risk". The amendment does not provide for the increase of the list of goods. The Draft also provides for the following quarantine phytosanitary requirements for the above mentioned products: "must come from places and (or) production sites free from the polyphagous humpback fly (Megaselia scalaris (Loew))" due to the fact that this type of plant product can potentially serve as a pathway for the introduction and spread of harmful organisms in the customs territory of the Eurasian Economic Union.

The draft provides for the quarantine phytosanitary requirements for mushroom spawn.

The draft provides for few changes in the use of electronic form of commercial, transport (shipping) documents and phytosanitary certificates by the competent authorities within the framework of quarantine phytosanitary control (supervision), as well as in conveying the results of quarantine phytosanitary control (supervision) in electronic form via information systems of the competent authorities.

The drafts provide for expansion of the list of goods subject to veterinary control on goods from HS Code 3823 of the EAEU Commodity Nomenclature of Foreign Economic Activity, as well as specification of veterinary measures applied for goods from HS code 3823 of EAEU CN of FEA.

The draft amends the form of a veterinary health certificate No. 28 for milk and dairy products exported to the customs territory of the EAEU and provides for the use of this veterinary certificate for goods made from milk in which animal fat is replaced by vegetable fat by more than 50%.

The draft provides for maximum residue levels of veterinary medicinal preparations (pharmacologically active substances) in unprocessed and processed food products of animal origin.

This draft provides for the amendment of the existing requirements with the following:- provisions allowing the movement of quarantine products between the Member States of the EAEU in hand luggage and passengers' luggage without a phytosanitary certificate;- provisions allowing to import into the customs territory of the EAEU and move through its territory fruits and berries infected with quarantine species of lecanium, scale insects, bacteria, viruses, viroids, nematodes and phytoplasmas;- requirements for carrot seeds, seeds, micro-plants and minitubers of potato, raw sugar beet seeds for sowing, seedlings, stocks and cuttings of cherry (Prunus mahaleb), peach (Prunus persica), sweet cherry (Prunus avium) and olive (Olea europaea), seedlings of fuchsia (Fuchsia), carnations (Dianthus), pumpkin crops, onion species (Allium spp.) and asparagus rhizomes;- clarification of the requirements for seed and planting material for a wide range of agricultural and forestry crops;- clarification of the requirements for fresh vegetables, fruits and berries; - special quarantine phytosanitary requirements for peat in relation to its production in areas free of the polyphagous humpbacked fly (Megaselia scalaris).

The Draft includes mushroom spawn to the List of quarantined products with a high phytosanitary risk.

The Draft provides for the addition of tomato brown rugose fruit virus (ToBRFV), pepino mosaic virus (PepMV), and tomato spotted wilt virus (TSWV) to the Common list of plant quarantine objects of the Eurasian Economic Union,  and of relevant requirements to the Common quarantine phytosanitary requirements for quarantine products and quarantined objects on the Customs Border and the Customs Territory of the Eurasian Economic Union.

The drafts determine veterinary requirements and forms of veterinary certificates for non-food raw materials obtained from fish, crustaceans, molluscs or other aquatic animals, as well as for fertilizers of animal origin or containing components of animal origin.

The Draft provides for the possibility to use veterinary certificates issued in electronic form for mutual and foreign trade by competent authorities.

The draft provides for the establishing a procedure for recognition by the authorized bodies of the Member States of the Eurasian Economic Union in the field of veterinary medicine of the results of regionalization of the territory of a third country, carried out by the competent authority of this third country or by the World Organization for Animal Health.

The Draft provides for the addition of the Decision No. 318 with provisions allowing designated officials of the authorized plant quarantine bodies of the Member States of the Eurasian Economic Union to recognize the phytosanitary certificate as not confirming the necessary phytosanitary condition of the imported consignment of quarantined products. The Draft provides for a decision by the authorized body on the return of wood packaging materials in the case of absence of a special internationally recognized mark confirming that heating is applied throughout the wood or fumigation or in the case of non-compliance with the quarantine phytosanitary requirements specified to them.

The drafts provide for the change in the conditions for importation of hides, horn and hoof, intestines, furs, sheep pelt, lambskin, wool, goat down hair, bristle, horsehair, and chicken, duck, goose and other poultry feathers and down feathers to the Eurasian Economic Union.

The draft lifts certain veterinary measures applied to imported goods subject to veterinary control into the territory of the Eurasian Economic Union.

This technical regulation establishes uniform mandatory requirements for free circulation of grain within the customs territory of the Eurasian Economic Union. In addition to mentioned above it sets Maximum Residual Levels (MRLs) for pesticides, contaminants, toxins, heavy metals.
