The draft Order provides for approving the requirements for chicken eggs (hereinafter – the Requirements) in terms of:sorting of eggs by quality and weight;stamping of eggs, labelling of packages (containers) and transport containers for eggs, containers for industrial eggs and providing information to the consumer in the case of individual sales of eggs;packaging and repackaging of eggs, and record-keeping requirements to be maintained by market operators.Chicken eggs imported (sent) to the customs territory of Ukraine have to comply with the provisions of Sections I-IV of the Requirements, or equivalent requirements of the exporting country.The draft Order is developed taking into account the following legal acts of the European Union:Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007;Commission Regulation (EC) No 589/2008 of 23 June 2008 laying down detailed rules for implementing Council Regulation (EC) No 1234/2007 as regards marketing standards for eggs;Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin;Commission Directive 2002/4/EC of 30 January 2002 on the registration of establishments keeping laying hens, covered by Council Directive 1999/74/EC;Council Directive 1999/74/EC of 19 July 1999 laying down minimum standards for the protection of laying hens.The draft Order is also notified under the TBT Agreement.

Ukraine notifies the adoption of the Order of the Ministry of Health of Ukraine No 2199"On approval of the Requirements for materials and articles which contain vinyl chloride and are intended to come into contact with foodstuffs" on 5 December 2022.The Order was registered with the Ministry of Justice of Ukraine on 21 December 2022, published and entered into force on 18 January 2023. The Order will be fully enacted on 19 November 2025.

The draft Law is developed with the aim of unification, modernization of Ukrainian legislation in the sphere of plant protection and its approximation to relevant EU law.Key provisions of the draft Law are the following:improvement of requirements for state control over the placing on the market and use of plant protection products, taking into account the relevant EU legislation;implementation of the European traceability model provided for by Regulations (EU) No. 2016/2031 and other EU legal acts, including the use of  the "plant passport", which will ensure traceability of plant, plant products and other objects; authorization of private persons to perform certain functions of the state (in particular, conducting laboratory tests, issuing plant passports, conducting training on the safe use of plant protection products, carrying out technical inspection of equipment for the use of plant protection products);introduction of the state registration system (registers) in the sphere of plant protection;introduction of lists regarding the movement of plants, plant products, other objects and plant protection products for the purposes of state control and other official activities; setting requirements for importing (sending) into the customs territory of Ukraine, movement through the territory of Ukraine of plants, plant products, other objects, plant protection products;introduction of a document stipulated by Regulation (EU) No. 2016/2031 that is a permit for importing (sending) into the customs territory of Ukraine of regulated pests and certain plant species, products of plant origin and other objects intended for state testing, scientific or academic purposes, approbation, varietal selection or breeding;implementation of the provisions of Regulation (EU) No. 2017/625, in particular with regard to general requirements for state control, methods and techniques of implementation of state control measures and other official activities, audit of authorized persons, independent audit of the competent body.From the date of entry into force of this Law, the current Laws of Ukraine "On Plant Quarantine" and "On Plant Protection" shall cease to be valid.

Ukraine informs that the draft Order of the Ministry of Agrarian Policy and Food of Ukraine “On approval of the Requirements for the marketing of meat of bovine animals aged up to 12 months” was adopted on 5 December 2022 (Order No. 975), registered with the Ministry of Justice of Ukraine on 20 December 2022, published and entered into force on 13 January 2023. Ukraine notifies the adoption of the Law of Ukraine No. 2775-IX "On Amendments to Certain Laws of Ukraine on Improving State Regulation in the Sphere of Pesticides and Agrochemicals" of 16 November 2022.The Law was published on 28 December 2022 and will enter into force in six months from the date of its publication, namely on 28 June 2023, except:Subparagraph 8 of paragraph 1 of Section I of this Law (refers to requirements on packaging and labelling), that shall enter into force on 1 January 2024; andParagraph 3 of Section I and paragraphs 2 and 3 of section "Final and Transitional Provisions", that shall enter into force on the day following the day of publication of this Law, namely on 29 December 2022.It is also established that:Pesticides and agrochemicals placed on the market prior to the entry into force of subparagraph 8 of paragraph 1 of Section I of this Law may be placed on the market until their expiration date, provided that their packaging and labeling comply with the requirements of the legislation of Ukraine in force for the time of placing such pesticides and agrochemicals on the market;Temporarily, until the date of entry into force of this Law, the provisions of the Law of Ukraine "On Plant Quarantine" in terms of authorization of laboratories to conduct inspection, sampling and phytosanitary examination (analysis) shall be suspended.

The draft Law aims to establish the procedures for placing of plant protection products and agrochemicals on the market in accordance with the EU regulations in force. Its purpose is to define the terminology and basic concepts on the approval of active substances, antidotes and synergists contained in the preparative forms of plant protection products, to define unacceptable coformulants that cannot be contained in plant protection products, to harmonize the procedures for placing on the market of agrochemicals and to determine the procedure for handling hazardous substances.The draft Order is developed to improve the state regulation in the sphere of pesticides and agrochemicals taking into account the Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC, Regulation (EU) 2019/1009 of the European Parliament and of the Council of 5 June 2019 laying down rules on the making available on the market of EU fertilising products and amending Regulations (EC) No 1069/2009 and (EC) No 1107/2009 and repealing Regulation (EC) No 2003/2003.It is established that all existing registrations of pesticides and agrochemicals in accordance with the Law of Ukraine "On Pesticides and Agrochemicals", which will be valid as of the date of entry into force of this Law, shall remain valid until their completion without the need for approval of the active substance.The current Law of Ukraine "On Pesticides and Agrochemicals" will become invalid from the date of entry into force of this Law.The draft Law is also notified in accordance with the provisions of the TBT Agreement.

Ukraine hereby notifies the adoption and enactment of the Order of the Ministry of Agrarian Policy and Food of Ukraine of 20 October 2022 No 813 "On Approval of Hygienic Requirements for the Production and Placing on the Market of Food Products of Animal Origin". The Order was registered with the Ministry of Justice of Ukraine on 15 November 2022, published and entered into force on 25 November 2022.The Order is available at:

Ukraine notifies the adoption of the Order of the Ministry of Health of Ukraine of 24 September 2022 No. 1734 “On approval of the Criteria for release of the N-nitrosamines and N-nitrosatable substances from elastomer or rubber teats and soothers”. The Order was registered with the Ministry of Justice on 14 October 2022, published on 28 October 2022 and will enter into force on 28 April 2023.

Ukraine notifies the adoption of the Law No2718-IX"On Materials and Articles Intended to Come into Contact with Food" of 3 November 2022. The Law was published on 19 November 2022 and will enter into force on 19 November 2025, although certain provisions entered into force on 20 November 2022. The Law is available at:

Ukraine hereby notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine of 28 August 2022 No. 628 “On Approval of the Requirements for Ensuring the Welfare of Animals during Slaughter and Killing”.  The Order was registered with the Ministry of Justice of Ukraine on 14 October 2022, published and entered into force on 28 October 2022.The Order will be enacted simultaneously with the Law of Ukraine "On Veterinary Medicine" No. 1206-IX of 4 February 2021 (to be enacted one year after the termination or cancellation of the martial law).It is also established that: - until 1 January 2027, the provisions of paragraph 1 of Chapter 1 of Section III of the Requirements apply only to new slaughterhouses put into operation after the entry into force of this Order and its enforcement; - from 1 January 2027, the provisions of paragraph 1 of Chapter 1 of Section III of the Requirements apply to all slaughterhouses, but not before the entry into force of this Order and its enforcement; - the requirements of Chapter 5 of Section II of the Requirements apply from 1 January 2027, but not earlier than the entry into force of this Order and its enforcement.The Order is available at:

The Order of the Ministry of Agrarian Policy and Food of Ukraine of 12 March 2019 No. 118 "On Approval of the Requirements for the Safety and Quality of Milk and Dairy Products" (hereinafter the Order, notified as G/SPS/N/UKR/192) establishes unified requirements for raw milk at the place of primary production and/or storage of milk in terms of permissible levels of criteria. These requirements foresee that the number of microorganisms do not exceed more than 500 ths. cfu/ml and the number of somatic cells do not exceed 500 ths./ml, and shall apply to all operators of the milk and dairy products market since 1 January 2020.On 1 January 2023, the current version of the Order provided for the next stage and revision of existing levels of these criteria till 300 ths. cfu/ml and 400 ths. cfu/ml respectively. In order to comply with the Requirements of the Order, milk processing enterprises must refuse to accept and purchase first-class milk beginning from 1 January 2023.Today, according to the statistical data of the State Statistics Service of Ukraine, the share of first-class milk is 34.6%. In terms of raw milk suppliers, the share of first-class milk is significant - from agricultural enterprises - 24.8%, from households - 75.2%.To avoid potential increase in prices for dairy products caused by the shortage of raw materials, the Ministry of Agrarian Policy and Food developed the draft Order "On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine of 12 March 2019 No. 118", which provides for the postponement of the phased application of the permissible levels of criteria for the relevant periods from the date of termination or cancellation of martial law. Namely, the deadline from 1 January 2023 is postponed for one year from the date of termination or cancellation of martial law, and the deadline for full compliance with the requirements from 1 January 2024 is postponed for two years from the date of termination or cancellation of martial law.

The draft Orderprovides for the approval of safety indicators for materials and articles which contain vinyl chloride and are intended to come into contact with foodstuffs.According to the Requirements to be approved by the draft Order, materials and articles must not contain vinyl chloride monomer in an amount that exceeds the maximum permissible level, which is no more than one milligram per kilogram of material or article.Materials and articles shall not transfer to the foodstuffs with any vinyl chloride detectable by a method which meets the following criteria:1.      The level of vinyl chloride in materials and articles and the level of vinyl chloride released by materials and articles to foodstuffs are determined by means of gas-phase chromatography using the "headspace" method;2.      For the purposes of determining vinyl chloride released by materials and articles to foodstuffs, the detection limit shall be 0.01 mg/kg;3.      Vinyl chloride released by materials and articles to foodstuffs is in principle determined in the foodstuffs. When the determination in certain foodstuffs is shown to be impossible for technical reasons, it is performed using simulants for these particular foodstuffs.The draft Order is designed to implement Council Directive 78/142/EEC of 30 January 1978 on the approximation of the laws of the member States relating to materials and articles which contain vinyl chloride monomer and are intended to come into contact with foodstuffs.

The Order of the Ministry of Agrarian Policy and Food of Ukraine No. 118 of 12 March 2019 (as amended) approved the Requirements for safety and quality of milk and dairy products (entered into force on 12 July 2019). This Order defines the requirements for the safety and quality of milk and dairy products while their production, processing and placing on the market, introduces good manufacturing practices for the production, processing and placing on the market of milk and dairy products.The Order of the Ministry of Agrarian Policy and Food of Ukraine of 22 August 2022 No. 595 "On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine of 12 March 2019 No. 118" provides for the improvement of measures for good manufacturing practice in milk production and circulation, in particular the introduction of clear mechanisms for conducting laboratory research (testing) of veterinary drug residues and inhibitors, establishing the frequency and methods of such research, as well as correcting inconsistencies and technical errors identified in the text in force. The Order also details the requirements and criteria for the suitability of milk that can be used for human consumption and the handling of milk that does not meet the requirements of this Order.

The draft Order:1) introduces the definition of quick-frozen food products in the legislation of Ukraine;2) establishes general principles that have to be met by quick-frozen food products;3) determines the level of temperature that has to be maintained at the facilities engaged in handling, storage, warehousing, transportation and/or circulation of quick-frozen food products;4) establishes the requirements for freezing equipment and the list of cryogenic substances (liquids) allowed to be used for quick freezing of food products;5) establishes the peculiarities of labeling of quick-frozen food products.Food products that complied with the requirements of the legislation on safety and certain food quality indicators, which was in force before the entry into force of this order, but do not meet the requirements of this order, may be produced and/or put into circulation within three years after the entry into force of this order and be in circulation until the minimum expiration date.The draft Order is designed to implement Commission Regulation (EC) No 37/2005 of 12 January 2005 on the monitoring of temperatures in the means of transport, warehousing and storage of quick-frozen foodstuffs intended for human consumption, Council Directive 89/108/EEC of 21 December 1988 on the approximation of the laws of the Member States relating to quick-frozen foodstuffs for human consumption.Given the existence of provisions on the labelling of quick-frozen food products, the draft Order is also notified in accordance with the requirements of the Agreement on Technical Barriers to Trade.

Ukraine informs that the draft Order of the Ministry of Agrarian Policy and Food of Ukraine "On approval of the criteria for determining the existence of a significant impact of the proposed veterinary and sanitary measure or approved emergency veterinary and sanitary measure on export capacity of foreign countries; approval of types of terrestrial livestock establishments, establishments for keeping and raising aquatic animals that pose a high risk of animal diseases spreading, and maximum volumes of aquatic animals husbandry that do not require approval of establishments" was adopted on 2 August 2022 (Order No. 511), registered with the Ministry of Justice on 16 August 2022, published and entered into force on 6 September 2022.The Order will be enacted simultaneously with the Law of Ukraine "On Veterinary Medicine" No. 1206-IX of 4 February 2021 (to be enacted one year after the termination or cancellation of the martial law).The Order is available at:

Ukraine informs that the Resolution of the Cabinet of Ministers of Ukraine No. 1088 "On Amendment to Paragraph 1 of the Resolution of the Cabinet of Ministers of Ukraine of 1 April 2022 No. 398" was adopted on 27 September 2022, published on 30 September and entered into force on 30 September 2022.Thus, the paragraph 1 of the Resolution of the Cabinet of Ministers of Ukraine of 1 April 2022 No. 398 "Some issues of implementation of phytosanitary measures and procedures under martial law" is supplemented with a new paragraph as follows:  "- the consignment owner or his authorized person may submit a letter of guarantee to the state phytosanitary inspector, according to which the owner or his authorized person undertakes to fumigate the consignment with regulated objects outside the customs territory of Ukraine before the arrival of such consignment to the importing country. In this case, the letter of guarantee is the basis for issuing a phytosanitary certificate by the state phytosanitary inspector;".

The requirements establish the rules for the marketing of meat of bovine animals aged up to 12 months.These requirements will apply to meat of bovine animals aged up to 12 months slaughtered from 1 January 2026 intended for the marketing, export and import to the customs territory of Ukraine.Meat of bovine animals aged up to 12 months slaughtered before 1 January 2026 can be placed on the market according to the rules effective before these requirements come into effect, but not longer than the expiry of the minimum shelf life.The age limits for labelling provided in the requirements are brought in line with the requirements of Commission Regulation (EC) No 566/2008. Thus, the draft Order is also notified under the TBT Agreement.

The draft Resolution is developed in accordance with part four and part ten of Article 54 of the Law of Ukraine of 4 February 2021 No. 1206 "On Veterinary Medicine" that establishes new requirements for state registration of veterinary medicinal products. The draft Resolution provides for approval of the Regulation on state registration of veterinary medicinal products that defines, in particular:procedure for state registration of veterinary medicinal products;requirements for the application for state registration, registration dossier and other documents submitted for state registration of veterinary medicinal products;requirements for tests necessary for state registration of veterinary medicinal products;specifics of state registration of certain types of veterinary medicinal products;the procedure for granting permission for the production, import and use of unregistered veterinary medicinal products for scientific research (testing);the procedure for payment for post-registration monitoring.The draft Resolution aims to bring Ukrainian legislation in terms of registration of veterinary medicinal products in line with EU requirements.

The draft Order approves the hygienic requirements for the production and placing on the market of  food products of animal origin (processed and unprocessed), in particular:- meat of domestic ungulates, hares, wild animals and wild animals raised on farms;- minced or chopped meat (minced meat), meat semi-finished products and meat of mechanical rolling;- meat products;- live bivalve molluscs, live echinoderms, live gastropods and live marine gastropods;- fish products;- eggs and egg products;- frog legs and snails;- melted animal fats and crackers;- processed stomachs, bladders and intestines;- highly purified chondroitin sulfate, hyaluronic acid, other hydrolyzed cartilage products, chitosan, glucosamine, rennet, fish glue and amino acids;- gelatin and collagen.The requirements establish rules for food market operators on the hygiene of food products of animal origin, their production and placing on the market.The draft Order is developed based on the requirements of the EU legislation,  namely Regulation (EC) No. 853/2004 of the European Parliament and of the Council of  29 April 2014 laying down specific hygiene rules for on the hygiene of foodstuffs, Regulation (EC) No 852/2004 of the European Parliament and of the Council of 29 April 2004 on the hygiene of foodstuffs.Hygienic requirements for the production and placing on the market of food products of animal origin, approved by this Order, shall be applied to food market operators who export or have declared to the competent authority their intention to carry out such export from the date of entry into force of this Order.Hygienic requirements for the production and placing on the market of food products of animal origin, approved by this Order, will be applied to all other operators of the food market in three years from the date of termination or cancellation of martial law.
