The draft Law of Ukraine "On Amendments to Certain Laws of Ukraine on Improving the Regulation of Production and Circulation of Dietary Supplements" aims to improve the regulation of production and circulation of dietary supplements on the market of Ukraine and state control over their circulation, considering the requirements of EU legislation. The draft Law introduces a procedure for submitting notifications on the circulation of dietary supplements, maintaining a list of such notifications, which will be publicly accessible on the official website of the competent authority.  In addition, the draft Law empowers the central executive body authority that responsible for formulating and implementing state healthcare policy to approve lists specifying permitted nutrients, other substances and their maximum residue levels for use in dietary supplements, as well as prohibited substances for use in dietary supplements. The draft Law also aims to strengthen responsibility for the production and sale of dietary supplements that that do not meet the requirements of the law. The draft Law requires market operators to notify the competent authority within six months from the date of its entry into force of their intention to circulate dietary supplements that were marketed in Ukraine before the entry into force of this Law and that are expected to be marketed after its entry into force. The draft Law establishes that dietary supplements that met the requirements of the legislation on safety and certain indicators of food quality, which were in force before the entry into force of this Law, but do not meet the requirements of this Law, may be in circulation until their consumption end date, expiry of the shelf life, minimum shelf life or the designated "use before..." date. The draft Law is also notified under the TBT Agreement.

Ukraine notifies the adoption of the Order of the Ministry of Health of Ukraine  No. 2104 "On Approval of Special Requirements for Plastic Materials and Articles Intended to Come into Contact with Foodstuffs" of 11 December 2023. The Order was registered with the Ministry of Justice of Ukraine on 27 December 2023 and will enter into force on 19 November 2025 - simultaneously with the entry into force of the Law of Ukraine No 2718-IX "On Materials and Articles Intended to Come into Contact with Food" of 3 November 2022 (document G/SPS/N/UKR/150/Rev.1/Add.1). The Order stipulates that products made of plastic materials and articles intended for come into contact with food, manufactured before the entry into force of this Order, may be in circulation until their expiry date.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1843 "On Approval of the Requirements of Good Practice for Distribution of Active Substances used in Veterinary Medicinal Products" of 20 October 2023.The Order was registered in the Ministry of Justice of Ukraine on 14 December 2023, published and entered into force on 16 January 2024.The Order will be enacted simultaneously with the Law of Ukraine "On Veterinary Medicine" No. 1206-IX of 4 February 2021 (to be enacted one year after the termination or cancellation of the martial law).

Ukraine notifies that the draft Resolution was adopted as the Resolution of the Cabinet of Ministers of Ukraine No. 22 "On Amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 398 of 1 April 2022" of 9 January 2024. The Resolution was published and entered into force on 12 January 2024.

The draft Order provides for the approval of requirements for fruit jams, jellies, marmalades and sweetened chestnut puree, including the procedure of methods of preparation and processing of fruit raw materials for the production of fruit jams, jellies and marmalades and chestnut purees with added sugar intended for human consumption.According to these requirements, certain quality indicators for fruit jams, jellies, marmalades, sweetened chestnut puree are established in order to ensure that consumers are properly informed about the properties of these food products, including their labelling, and to prevent business practices that mislead consumers.These requirements do not apply to ingredients intended for the manufacture of bakery products, pastries or biscuits.The draft Order also stipulates that fruit jams, jellies, marmalades and sweetened chestnut puree that comply with the requirements in force before the entry into force of this Order, but do not meet the requirements for fruit jams, jellies, marmalades and sweetened chestnut puree approved by this Order, may be placed on the market for three years from the date of entry into force of this Order. Such food products may be placed on the market until the final date of consumption or the expiry of the minimum shelf life.The draft Order developed in order to implement EU legislation.The draft Order is also notified under the TBT Agreement.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1743 "On approval of the Requirements for a written declaration of the conformity of materials and articles intended to come into contact with food and a list of documents confirming the information specified in the declaration" of 2 October 2023. The Order was registered in the Ministry of Justice of Ukraine on 13 November 2023 and published on 19 December 2023. The Order entered into force on 19 December 2023 and will be enacted on 19 November 2025 (simultaneously with the entry into force of the Law of Ukraine No. 2718-IX "On Materials and Articles Intended to Come into Contact with Food" of 3 November 2022 (notified in document G/SPS/N/UKR/150/Rev.1/Add.1). The Order also stipulates that materials and articles intended to come into contact with foodstuffs produced before the entry into force of this Order may be in circulation until the expiry date.

The draft Resolution provides for amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 398 of 1 April 2022 "On Some Issues of Phytosanitary Measures and Procedures under Martial Law" and the Resolution of the Cabinet of Ministers of Ukraine No. 960 of 24 October 2018 "On Some Issues of Official Control of Goods Imported into the Customs Territory of Ukraine (including for the Purpose of Transit)", such as:1)ensuring the possibility of carrying out phytosanitary procedures by the State Phytosanitary Inspector in the territories included in paragraph 1 of Section I of the List of territories where military operations are (were) being conducted or which are temporarily occupied by the Russian Federation, subject to the availability of a document confirming the absence of risks associated with explosive objects in such territories;2) ensuring the possibility of cargo inspection and sampling by officials of the State Service of Ukraine for Food Safety and Consumer Protection outside the customs territory of Ukraine for the purpose of carrying out the necessary laboratory tests for the purpose of issuing the certificates provided for by the Laws of Ukraine "On Plant Quarantine" and "On State control over compliance with the legislation on food, feed, animal by-products, health and safety products of animal origin, animal health and welfare";3) establishing the specifics (simplified procedure) for the import (shipment) of samples of agricultural products of plant origin taken outside the customs territory of Ukraine.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1592  "On approval of Requirements for certain types of partially or wholly dehydrated preserved milk intended for human consumption" of 25 August 2023.The Order was registered in the Ministry of Justice of Ukraine on 12 September 2023 and published on 10 November 2023.The Order entered into force on 10 November 2023 and will be enacted on 10 November 2026.

The draft Order is developed in order to align Ukrainian legislation in the sphere of food safety and quality of products with the EU legislation.The amendments that are being implemented are compliant with the provisions of Regulation (EC) No. 853/2004 of the European Parliament and of the Council of 29 April 2004 laying downspecific hygiene rules for food of animals origin, Commission Implementing Regulation (EU) 2019/627 of 15 March 2019 laying down uniform practical arrangements for the performance of official controls on products of animal origin intended for human consumption in accordance with Regulation (EU) 2017/625 of the European Parliament and of the Council and amending Commission Regulation (EC) No. 2074/2005 as regards official controls.The draft Order also provides for the repeal of the Order of the Ministry of Health of Ukraine No. 197 of 6 May 2003 "On Approval of the State Sanitary Regulations and Norms for Enterprises and Vessels Producing Products from Fish and Other Aquatic Species" and the Order of the Ministry of Health of Ukraine  No. 811 of 11 December 2007 "On Approval of the State Sanitary Norms and Regulations for Enterprises Producing Malt, Beer and Soft Drinks".

Ukraine notifies the adoption of the Order of the Ministry of Health of Ukraine No. 1280 "On Approval of the Requirements for Foods and Food Ingredients Treated with Ionising Radiation" on July 15, 2023.The Order was registered with the Ministry of Justice of Ukraine on August 25, 2023 and published on October 13, 2023.The Order will enter into force on April 13, 2024.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 1450 "On Approval of Requirements for Fruit Juices and Certain Similar Products" of 31 July 2023.The Order was registered in the Ministry of Justice of Ukraine on 14 August 2023 and published on 5 October 2023.The Order will enter into force on 5 April 2024.The Order also provides that fruit juices and some similar food products that meet the requirements that were in force before the entry into force of this Order, but do not meet the provisions of the Requirements for fruit juices and some similar food products approved by this Order, may be in circulation for three years from the date of entry into force of this Order. Such food products may be in circulation until the final date of consumption or the expiration of the minimum shelf life.

The draft Order provides for the approval of requirements for food flavors, food additives and food enzymes in food products.After the adoption of this Order, the Order of the Ministry of Health of Ukraine of 23 July 2012 No. 222 "On Approval of Sanitary Rules and Norms for the Use of Food Additives" will become invalid.

The draft Law provides for the regulation of legal relations with regard to the approval of active substances of biocidal products, obtaining a permission for placing on the market of biocidal products, production, trade and safe application of biocidal products for human, animal and environmental health, as well as placement of treated articles on the market, defines the rights and obligations of enterprises, institutions, organisations and individuals, as well as the authority of state bodies and officials in this area.In order to achieve a high level of protection of human health, animal health and the environment, active substances with the worst hazard profiles should not be approved for use in biocidal products, except in specific situations. This should include situations where approval is justified because of the low risk from exposure to the substance, for human health, animal health or environmental reasons, or for disproportionate adverse effects reasons or disproportionate negative impact on society in case of non-approval. When deciding on the approval of such active substances,  the availability of suitable and sufficient alternative substances or technologies should also be taken into account.The provisions of Law will not apply to medicinal feeds; medical devices; medicinal products and veterinary drugs; feed additives for animals and feed; food hygiene products; food additives; food flavourings and ingredients with flavouring properties intended for use in and on food products; phytosanitary products; plant protection products; cosmetic products; toy safety.The draft Law is developed to implement Regulation (EU) No. 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products.The draft Law is also notified in accordance with the requirements of the TBT Agreement.

Ukraine notifies the adoption of the Resolution of the Cabinet of Ministers of Ukraine  No. 1041 "On Amendments to the Rules for Transportation of Animals" of September 29, 2023. The Resolution was published and enacted on October 4, 2023.

The draft Order provides for the approval of special requirements for plastic materials and articles intended for contact with food, as well as a list of substances authorized for use in the production of such materials and articles. It is also established that products made of plastic materials and articles intended to come into contact with foodstuffs produced before the entry into force of this Order may be in circulation until their expiry date. The draft Order is also notified in accordance with the requirements of the TBT Agreement.

The Resolution provides for amendments to the Resolution of the Cabinet of Ministers of Ukraine No. 398 "Some Issues of Phytosanitary Measures and Procedures under Martial Law" of 1 April 2022 by:1) Clarification of the title of the Resolution No. 398  in view of the expansion of its scope to veterinary and sanitary measures for products of plant origin;2) Exclusion of provisions on the implementation of the Initiative for the Safe Transportation of Grain and Food Products from Ukrainian Ports, signed in accordance with the Order of the Cabinet of Ministers of Ukraine No. 626 of 22 July 2022, as such, which has already become irrelevant due to the expiration of the Grain Initiative;3) Supplementing subparagraph 1 of the Resolution No. 398 with new subparagraphs 4 and 5, which define the procedure for processing documents for cargoes with products of plant origin, including international certificates, and carrying out the necessary procedures by officials of the State Service of Ukraine on Food Safety and Consumer Protection outside the customs territory of Ukraine, as well as regulating the issue of business trips abroad of such officials for this purpose;4) Increase the amount of payment for carrying out the necessary procedures for issuing relevant international documents by officials of the State Service of Ukraine on Food Safety and Consumer Protection assigned to business trips abroad.

The draft Order has been developed to fulfil the requirements of Articles 23 and 25 of the Law of Ukraine "On Basic Principles and Requirements for Food Safety and Quality".Part eight of Article 20 of the above-mentioned Law prohibits business operators from trading of food products obtained from food establishments that have not been state registered or have not received an operational permission in accordance with the Law, and/or using such food products in the production of other food products.According to the Law, an operational permission is issued to business operators engaged in activities related to the production and/or storage of food products of animal origin by the territorial body of the State Service of Ukraine on Food Safety and Consumer Protection. The information contained in the operating permission is recorded in the Register of business operators and food establishments for which the operating permission has been issued and maintained by the State Service of Ukraine on Food Safety and Consumer Protection.Thus, the draft Order has been developed to implement the provisions of the Law of Ukraine "On Basic Principles and Requirements for Food Safety and Quality" and provides for:1) approval of the updated procedure for state registration of food establishments;2) establishing a unified mechanism for maintaining the State register of business operators and their food establishments, such as:business operators engaged in activities related to the production and/or storage of food products of animal origin, for food establishments of which an operating permission has been obtained;business operators that use their food establishments at any stage of production and/or trading of food products and do not require an operational permission.In addition, the following Orders of the Ministry of Agrarian Policy and Food of Ukraine will become invalid upon adoption of this draft Order:"On Approval of the Procedure for Approval of Export Food Establishments, Inclusion and Exclusion from the Register of Approved Export Food Establishments" No. 38 of 10 February 2016;"On Approval of the Procedures for the State Registration of Food Establishments, Maintenance of the State Register of Food Business Operators' Establishments and Provision of Information from the State Register to the Stakeholders" No. 39 of 10 February 2016 (notified in document G/SPS/N/UKR/169);"On Approval of the Procedure for Maintaining the Register of Business Operators and Food Establishments for which an Operating Permission was Issued" No. 40 of 10 February 2016.

The draft Resolution establishes rules for: - the welfare of bees during transportation;  - the welfare of bees during operations related to their transportation. The draft Resolution provides for the implementation of Ukrainian legislation in accordance with the requirements of Regulation (EU) No. 2016/429, Regulation (EU) No. 2020/688 and Regulation (EU) No. 2020/692.

The draft Order is developed in order to confirm by the market operator of materials and articles intended for contact with food compliance with the requirements for the relevant material or article, as well as to implement the provisions of the EU food legislation.Approval of the Requirements is provided for by the Law of Ukraine of 3 November 2022 No. 2718-IX "On Materials and Articles Intended to Come into Contact with Food", notified in document G/SPS/N/UKR/150/Rev.1.Materials and articles intended to come into contact with foodstuffs, as well as products of intermediate stages of their processing, and their components and/or substances, should be accompanied by a written declaration, which confirms the fulfillment of the requirements for the relevant material or article at all stages of its circulation, except at the points of sale to end consumers.The purpose of the declaration of conformity is to demonstrate that materials and articles meet the requirements of the law and are safe for use.The draft Order suggests approving the Requirements to the declaration of conformity in terms of:- General provisions;- Requirements to the information to be contained in the declaration of conformity;- List of supporting documents.The Requirements cover the following materials and articles: active materials and articles, intellectual materials and articles, glues, ceramics, cork, rubber, glass, ion exchange resins, metals and alloys, paper and cardboard, plastic, printing inks, regenerated cellulose, silicon, textile, varnishes and coatings, wax, wood.The draft Order also stipulates that materials and articles intended to come into contact with foodstuffs produced before the entry into force of this Order may be in circulation until the expiry date.The draft Order is also notified under the TBT Agreement.

Ukraine notifies the adoption of the Resolution of the Cabinet of Ministers of Ukraine No 964 of 8 September 2023 "On approval of the Procedure for importation into the territory of Ukraine of seeds and planting material of a variety not included in the Plant Varieties Register of Ukraine, but included in the OECD List of Varieties, of those agricultural plants, to the variety certification schemes of which Ukraine has joined, for the purposes of breeding and further export outside of Ukraine, and repeal of the Resolution of the Cabinet of Ministers of Ukraine of 26 October 2016 No. 762". The Resolution was published and entered into force on 13 September 2023.
