The Draft determines the requirements for nutrition and health claims made on food products, used in marking, presentation or advertising, intended for the final consumer of food products, produced, put into circulation, or imported (shipped) to the customs territory of Ukraine. The Draft is also notified under the TBT Agreement requirements.
The draft Order establishes the maximum levels for certain contaminants in food products. Food products that meet the requirements that were in force before the entry into force of this Order, but do not meet the requirements of this Order, may be in circulation on the market until their expiry date.
The Draft determines the list of vitamins, minerals and certain other substances intended for use in foods, their permissible norms in food products, and also approves the list of prohibited substances for use in food production. The Draft also regulates the issues on sale, labeling and advertising of food products, according to which the labeling and advertising shall be true and contain comprehensive information that would not mislead consumers. Food products that meet the requirements that were in force before the entry into force of this Order, but do not meet the requirements of this Order, may be imported to the customs territory of Ukraine, produced and/or put into circulation within three years after this Order comes into force. Such food products may be in circulation until their final date of consumption, or the expiry date, or the minimum expiry date.
There is an addendum to notification G/SPS/N/UKR/138, dated 20 December 2019: Five new forms of international certificates have been added to the draft Order. Such forms of international certificates are related to introduction (sending) into the customs territory of Ukraine of : - highly refined chondroitin sulphate, hyaluronic acid, other hydrolysed cartilage products, chitosan, glucosamine, rennet, isinglass and amino acids intended for human consumption - rendered animal fats and greaves, intended for human consumption - reptile meat, intended for human consumption - insects intended for human consumption other products of animal origin intended for human consumption The link to the draft Order and its attachments has been changed. Draft Resolution of the Cabinet of Ministers of Ukraine "On amendments to the Resolution of the Cabinet of Ministers of Ukraine of 15 November 2019 No. 1177" provides for amendments to item 88 of the Procedure of inspection, survey, phytosanitary examination, supervision, monitoring, disinfection of regulated objects, issuance of certificates in accordance with the Law of Ukraine "On Plant Quarantine", control of inspections in terms of sampling and selective control over the conduct of phytosanitary examination, approved by the Resolution of the Cabinet of Ministers of Ukraine of 15 November 2019 No. 1177 (notified as G/SPS/N/UKR/136/Add.1) Currently, there is a requirement to carry out fumigation with the use of recirculation system during transportation of regulatory objects loaded into the vessels holds over 12 meters deep together with coamings. Taking into account the speed of penetration of fumigant into the thickness of the grain (2-3 meters per day), it is not expedient to carry out fumigation in this way during export grains to distant foreign countries. Thus the draft Resolution proposes to simplify phytosanitary measures with regard to fumigation, which will correspond to the best international practice of grain trade. In particular, it stipulates that fumigation will be carried out in accordance with international agreements, the requirements of importing countries, or the terms of a foreign economic agreement (contract).
Ukraine informs that the draft Resolution of the Cabinet of Ministers of Ukraine "On approval of the Regulation on state registration of feed additives" (G/SPS/N/UKR/139) was adopted on 3 March 2020 (Resolution No. 210) and was entered into force on 20 March 2020.The Resolution is available at: https://zakon.rada.gov.ua/laws/show/210-2020-%D0%BF.
The Order intended to control and regulate issues on the turnover of food products of animal origin and/or their ingredients, in case such products contain residues of veterinary preparations active substances.The Order approves maximum residue levels of veterinary preparations active substances in food of animal origin, forms the List of veterinary preparations active substances with undefinable maximum residue levels and their classification.The adoption of the Order harmonizes Ukrainian legislation with EU's, in particular by establishing similar veterinary requirements for the maximum residue levels of veterinary preparations active substances in food products.
Final date for comments to notification G/SPS/N/UKR/143 on the Draft Law of Ukraine "On amendments to certain Laws of Ukraine concerning foodstuffs and other objects of sanitary measures" is extended by 19 April 2020.

Draft Order approves the procedure for establishing the mechanism and special labelling requirements of foodstuff for which the indication of country of origin or place of origin is mandatory. Such food products are meat of bovine animals, fresh, chilled and frozen, edible offal of bovine animals, fresh or chilled, and natural honey.It is also foreseen that established mandatory labelling procedure and its requirements will also apply to the List of food product that were specified in Annex 7 of the earlier adopted Law of Ukraine "On Consumer Information on Food". Thus, mandatory labelling rules will also apply to meat of swine, sheep or goat, fresh, chilled and frozen, meat and edible offal of the poultry of heading 0105, fresh, chilled and frozen.The purpose for developing such measures is to protect population from zoonotic diseases, prevent fraud and unfair competition. This draft Order was also notified under the TBT Agreement.
The Draft Order establishes the mechanism for recognition of certificates of organic production and/or organic products turnover that have been issued under the legislation other than Ukraine's. Thus, the certificate approving the production and/or turnover of organic products under the legislation other than the legislation of Ukraine that had been issued by foreign certification authority for the purpose of import or export will be recognized in Ukraine if such authority listed in the foreign certification authority List, that is conducted by the State Service of Ukraine on Food Safety and Consumer Protection. To be included in the foreign certification authority List the importer or exporter shall submit a free-form application for registration in the abovementioned List to the the State Service of Ukraine on Food Safety and Consumer Protection.
The Draft Law establishes preconditions for reducing the risks associated with the production and circulation of foodstuffs of improper quality and those that may endanger consumers' life and health.The Draft Law amends, inter alia, the following Laws of Ukraine "On basic principles and requirements for safety and quality of food products"; "On state control to check compliance with the legislation on food, feed, animal by-products, animal health and welfare"; "On basic principles and requirements for organic production, circulation and labelling of organic products"; "On consumer rights protection", "On consumer information on foodstuffs" etc.For market operators the draft Law establishes additional requirements to ensure food traceability; requirements for state registration of food additives, food enzymes and flavours, newest food products, health benefits claims; simplification of conditions for obtaining, replacement of operating permits, which are issued by territorial authorities of the competent authority for each individual capacity prior to its operation; requirements for state registration/operating permit for market operators importing food products into the customs territory of Ukraine.

The draft Order regulates the procedure for handling products imported (shipped) to the customs territory of Ukraine as trade (exhibition) samples or objects of scientific research due to the lack of such provisions in Ukrainian legislation. The provisions of the draft Order are also intended to prevent the risk of spreading infectious animal diseases due to improper handling of products imported (shipped) to the customs territory of Ukraine as trade (exhibition) samples or objects of scientific research.

The Draft Law of Ukraine "On Amendments to the Law of Ukraine "On Seeds and Planting Material" regulates the following issues:- production of perennial planting material by stages of reproduction in accordance with international requirements;- determination of phytosanitary qualities of planting material;- use of planting material of varieties, clones, species, forms not listed in the State Register of Plant Varieties, in accordance with commonly accepted international practice;- export of planting material of domestic breeding varieties outside the customs territory of Ukraine;- use of perennial planting material for the creation of industrial plantations, provided the availability of design estimates.
The Draft Order specifies the provisions which allow the release into free circulation of cargoes with food and feed of non-animal origin (except for those that are subject to enhanced state control while imported (shipped) to the customs territory of Ukraine) and cargoes with composite products (except for those subject to state control at the designated border inspection posts), the labelling of which does not meet the requirements of the legislation.

The draft Resolution provides the procedure for the state registration of feed additives, the form of the application, the form and procedure of the expert report preparation including the recommendations for the state registration of feed additives or its rejection, simplified procedure for the state registration, the form and procedure for managing the State Register of feed additives, maximum allowed volume of import (sending) of feed additives unscheduled in the State Register.
The Draft Order approves the forms of international certificates, which regulate the issues of import (shipment) to the territory of Ukraine of products, the list of which is approved by the Order of the Ministry of Agrarian Policy and Food of Ukraine of 26 March 2018 No. 159 "On approval of the products subject to state control in the designated inspection points"
