Ukraine informs that the draft Order of the Ministry for Development of Economy, Trade and Agriculture of Ukraine "On Approval of the Procedure and Special Requirements for Labelling and the List of Foodstuff for which Indication of Country of Origin or Place of Origin is Mandatory" (G/SPS/N/UKR/145) was adopted on 01 April 2021 (Order No. 679), registered with the Ministry of Justice of Ukraine on 06 May 2021 and enters into force on 18 May 2021. The draft Order sets the maximum residue level for chlorpyrifos and chlorpyrifos-methyl in agricultural products and food products at 0.01 mg/kg (mg/l).

The draft Law aims: - to consolidate, as well as to improve legal regulation of certain laws of Ukraine regarding the circulation and use of plant protection products into a single law; - to enhance the protection and safety of the territory of Ukraine from the entry of regulated pests; to improve the system of laboratory facilities in accordance with EU approaches; - to strengthen state control over the circulation and use of plant protection products, including its illicit trafficking; - to develop transparent rules of doing business as well as of state control measures; - to stimulate the adoption of new technologies in agriculture that can reduce and/or minimize the negative impact of plant protection products on the environment, people, animals; - to minimize losses and risks of agricultural producers and exporters of products of plant origin.

Ukraine informs that the Law of Ukraine "On Veterinary Medicine" (notified in G/SPS/N/UKR/154) was adopted on 4 February 2021 (Law No. 1206), published on 20 March 2021, entered into force on 21 March 2021 and will be fully enacted on 21 March 2023.   Selected provisions of the Law are enacted immediately. Provisions of paragraphs four and five of subchapter 1.4 of chapter 1, chapter 5, subchapter 11.47 of chapter 11, paragraphs four of subchapter 12 of chapter 10, chapter 11 of the Section XV "Final and transitional provisions" of the Law entered into force on 21 March 2021. The draft Law provides for the introduction of procedures to regulate the content of trans-fatty acids in food products offered to the final consumer by amending the Laws of Ukraine "On Basic Principles and Requirements to Food Safety and Quality", "On Information for Consumers regarding Food Products".The provisions of this draft Law do not apply to trans fatty acids naturally found (present) in foods. The draft Law stipulates that food products that meet the requirements in effect prior to the entry into force of this Law, but do not meet the requirements of this Law, may be in circulation on the market of Ukraine until the end of their shelf life.

The draft Law provides for:- the adjustment of the terms and definitions, the classification of grape varieties and the requirements for the production of wine products made from the respective grape varieties, as well as some enological practices and restrictions, to be in conformity with the classifications adopted in the EU countries; - the introduction of registration, reporting and production of wine products with the use in the names of geographical indications and wines of controlled designation of origin similar to those used in the EU countries; - the introduction of new terms and definitions in accordance with the categories of European legislation; - the implementation of the rules of labeling and presentation of wine products; - the establishment of principles for inspections of the production of wine products from the vineyard to the final product, to determine the controlling institutions and their powers etc.This draft Law is also notified in accordance with the provisions of the TBT Agreement.

The draft Order aims to create unified requirements for the production and circulation of natural mineral waters and spring water.The draft Order provides for the establishment of:- requirements for the treatment of natural mineral water;- requirements for areas, premises, equipment, technological equipment, storage and transportation of natural mineral water;- additional markings for labelling of natural mineral water as defined by the Law of Ukraine "On Information for Consumers regarding Food Products";- requirements for spring water.The draft Order also stipulates that natural mineral waters that meet the safety legislation requirements and certain food quality indicators in effect prior to the entry into force of this Order, but do not meet the requirements of this Order, may be produced and/or put into circulation for three years after the entry into force of this Order and remain in circulation until the minimum shelf life or "use before" date expires.This draft Order is also notified in accordance with the provisions of the TBT Agreement.

The draft Order provides for amendments to the food safety indicators "Maximum residue limits (levels) of veterinary active substances in foodstuffs of animal origin", approved by the Order of the Ministry of Health of Ukraine, On approval of food safety indicators "Maximum residue limits (levels) of veterinary active substances in foodstuffs of animal origin" No. 2646 of 23 December 2019 (notified as G/SPS/N/UKR/146), by adding a new Table 4 "Maximum residue levels of coccidiostatics and histomonostatics (used to control coccidiosis in animals) in foodstuffs of animal origin".

The Law regulates the following issues:- the welfare of farm animals and the creation of appropriate conditions for their keeping and slaughter;- registration and circulation of veterinary drugs;- the use of antimicrobial drugs that will prevent the antibiotic resistance among animals and improve the epizootic situation in Ukraine, and facilitate minimization of the use of antibiotics in animal husbandry.The law introduces the following:- reduction of the number of veterinary documents, which will simplify doing business in the field of animal husbandry, the issuance of appropriate veterinary documents and prescriptions both in paper and electronic forms;- introduction of indefinite (perpetual) registration of veterinary medicines;- simplification of import of live animals into the territory of Ukraine in certain cases;- application of a risk-based approach to the planning and implementation of state control of livestock facilities;- increasing responsibility in case of violations of legislation in the field of veterinary medicine and animal welfare;- development of veterinary practice.

Ukraine informs that the draft Order of the Ministry of Health of Ukraine "On Approval of the Rules on the addition of vitamins, minerals and certain other substances to foods" (G/SPS/N/UKR/147) was adopted on 16 July 2020 (Order No. 1613), registered with the Ministry of Justice of Ukraine on 16 September 2020 and entered into force on 2 October 2020. The draft Law of Ukraine "On amendments to certain legislative acts of Ukraine on harmonization of Ukrainian legislation in the field of food for infants and young children  with the requirements of the EU legislation" provides for amendments to the Laws of Ukraine "On basic principles and requirements for food safety and quality", "On information for consumers on food products", "On state control over compliance with legislation on food, feed, animal by-products, animal health and welfare", "On the fundamentals of healthcare legislation of Ukraine" by supplementing their provisions with norms relating to food for infants and young children as well as the invalidation of the Law of Ukraine "On child nutrition".Such amendments, in particular, relate to the terms of types of baby food products and their definition in accordance with their purpose and composition, requirements for baby food products, requirements for information on baby food, labelling requirements.This draft Law is also notified according to the norms of the TBT Agreement.

The draft Law provides for mechanisms, in particular, regarding processes of plastics processing; state regulation of production and circulation of materials and articles intended to come into contact with food; procedure of state registration of objects, registration of which is stipulated by the legislation; labelling, declaration of compliance and requirements for ensuring traceability; Good Manufacturing Practice (GMP); state control and responsibility of market operators.The draft Law is also notified in accordance with the requirements of the TBT Agreement.

Ukraine informs that the draft Order of the Ministry of Health of Ukraine "On Approval of the Requirements for nutrition and health claims made on food products" (G/SPS/N/UKR/149) was adopted on 15 May 2020 (Order No. 1145), registered with the Ministry of Justice of Ukraine on 4 August 2020 and entered into force on 21 August 2020. Ukraine informs that the draft Order of the Ministry for Development of Economy, Trade and Agriculture of Ukraine "On Approval of the List of substances (ingredients, components) that are allowed to be used in organic production process and allowed to be used in maximum permissible quantities" (G/SPS/N/UKR/137) was adopted on 9 June 2020 (Order No. 1073), registered with the Ministry of Justice of Ukraine on 7 August 2020 and entered into force on 21 August 2020. The proposal notified in G/SPS/N/UKR/148 was adopted as the Order of the Ministry of Health of Ukraine of 25 May 2020 No. 1238 "On amendments to the State Hygiene Regulations and Norms "Regulation on the maximum levels for certain contaminants in food products" and registered in the Ministry of Justice of Ukraine on 21July 2020. The Order approves the Hygienic norms and regulations for safe usage of pesticides and agrochemicals

The draft Order establishes detailed hygiene requirements for the production and circulation of processed and unprocessed food products of animal origin in line with Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin.

The draft Law defines the legal and organizational framework to ensure the safety of materials and articles intended for direct or indirect contact with foodstuffs in the process of their production, circulation and use, namely:general provisions;general and special requirements for materials and articles intended to come into contact with food;state regulation of production and circulation of materials and articles intended to come into contact with food;labelling, declaration of compliance and requirements for ensuring traceability of materials and articles intended to come into contact with food;Good Manufacturing Practice (GMP) in the production of materials and articles intended to come into contact with food;state control and responsibility of market operators. The draft Law is also notified in accordance with the requirements of the TBT Agreement.
