The purpose of this Regulation is to determine the flavourings and food ingredients with flavouring properties used in and on foods, the source materials used in their production, their conditions of use and labelling rules, taking into account consumer and human health, consumer rights, ensuring fairness in food sales and protecting the environment.This Regulation has been prepared for compliance with EU Regulation (EC) No 1334/2008, EU Regulation (EC) No 2065/2003 and Commission Implementing Regulation (EU) No 872/2012.

"Turkish Food Codex - Communiqué on Infant Formula and Follow-on Formula and Requirements on Information Relating to Infant and Young Child Feeding" was notified through G/SPS/N/TUR/99 on 19 July 2018. Three amendments for the aforementioned regulation were notified through G/SPS/N/TUR/99/Add.1 on 23 July 2019, G/SPS/N/TUR/99/Add.2 on 11 August 2022 and G/SPS/N/TUR/99/Add.3 on 23 August 2023.An amendment has been proposed by means of “Turkish Food Codex Communiqué - Amending Turkish Food Codex Communiqué on Infant Formula and Follow-on Formula”.The amendment concerns protein requirements for infant and follow-on formula manufactured from protein hydrolysates. This Communiqué will enter into force on 15 January 2025.

This Regulation covers the procedures and principles related to the self-checks conducted by food business operators, as well as the specific hygiene requirements and the responsibilities of food business operators producing unprocessed and processed food of animal origin.  This Regulation does not apply to food containing both products of plant origin and processed products of animal origin. However, processed products of animal origin used to prepare such food shall be obtained and handled in accordance with the requirements stated in this Regulation. The Regulation repeals the Specific Hygiene Rules for Foods of Animal Origin, which was published in the Official Gazette dated 27 December 2011 and numbered 28155.The main amendments include following issues:The requirement to apply a special health mark has been abolished;The collagen and gelatine production process, for gelatine and collagen are regulated;Specific hygiene requirements have been established for some highly refined products (such as chondroitin sulphate, hyaluronic acid, other hydrolysed cartilage products, chitosan, glucosamine, rennet, amino acids permitted as food additives);Regulations have been made regarding special requirements for echinoderms by excluding the classified production areas of echinoderms that do not filter feed from the relevant provisions;An exemption from the obligation to cool carcasses to 7 °C in the slaughterhouse before transport has been provided and additional rules have been introduced regarding the conditions of this exemption;Young cattle and young sheep for rennet production without cleaning after emptying their rumen has been introduced, and transporting the feet and heads from the slaughterhouse to an approved facility without skinning or boiling to remove hair to be converted into food has been introduced;Regulations and slaughter rules have been introduced regarding the number of animals slaughtered on the farm;Rules have been determined for retail food business operators to be able to freeze meat for food donation purposes in accordance with the specified conditions;The bodies of hunted wild game animals must be transported to a collection centre before being transported to a game processing facility, and special hygiene rules have been introduced for the procedures at collection centres;The intermediary operator definition has been made and rules have been regulated regarding the model of the shipping document for the movement of live bivalve molluscs between enterprises and the application that batches of bivalve molluscs can also be sent to intermediate operators;Health standards for live bivalve molluscs have been regulated;Sale of farm-slaughtered poultry to the end consumer or local retailer;An amendment was made to increase the delivery time of eggs to the end consumer from 21 days to 28 days;Fat derivatives and sweeteners obtained from products of animal origin have been added to the list as highly refined products and certain special hygiene rules have been regulated;The infrastructure and imaging systems required to digitally track slaughtered animals have been added to the requirements section for slaughterhouses.This Regulation has been prepared for the compliance with the EU legislation (853/2004/EC).

Regulation on Food Hygiene Revision to Regular Notification

This Regulation involves the procedures and principles for the general hygiene rules and responsibilities to be fulfilled by food business operators to provide for food hygiene at all stages of production, processing and distribution including primary production stage.This Regulation repeals the Food Hygiene Regulation, which was published in the Official Gazette dated 17 December 2011 and numbered 28145.The main amendments include following issues: Code of practice for the reduction of food allergens in the food chain, starting from primary production;Code of practice for retail operators to redistribute food for human consumption for food donations;Rules regarding understanding of food safety  to increase the awareness of employees and to improve their behaviour in food businesses;Within the scope of harmonization of the European Union's acquis No. 931/2011 on ensuring traceability in foods of animal origin, rules regarding the traceability of foods have been introduced.This Regulation has been prepared for the compliance with the EU legislation (852/2004/EC).

The Turkish Food Codex Communiqué on Sugar was notified in G/SPS/N/TUR/101 and was amended with the notification G/SPS/N/TUR/101/Add.1. Now, this Communiqué has been amended in content about the labelling requirements relating the notification of source which the sugar has obtained from.

In order to prevent the entry of Tomato brown rugose fruit virus (Tobamovirus, ToBRFV) into Türkiye, an additional declaration was introduced in the phytosanitary certificates for  the import of tomato (Solanum lycopersicum L.) and capsicum (Capsicum spp.) seeds and plants for planting purposes from countries, which were notified through G/SPS/N/TUR/109, G/SPS/N/TUR/109/Add.1, G/SPS/N/TUR/109/Add.2, G/SPS/N/TUR/109/Add.3, G/SPS/N/TUR/109/Add.4, G/SPS/N/TUR/109/Add.5 and G/SPS/N/TUR/109/Add.5/Corr.1.As of 1 September 2024, the phytosanitary requirements for tomato and pepper seeds and plants for planting purposes from all countries entering Türkiye are set out below.Article 1. Introduction into Türkiye of the tomato (Solanum lycopersicum L.) and hybrids thereof, and of pepper (Capsicum spp.) plants (hereinafter referred to as specified plants) for planting Specified plants  for planting, other than the ones belonging to varieties which are known to be resistant to ToBRFV, may only be introduced if they are accompanied by a phytosanitary certificate which, under the heading “Additional declaration” includes the following elements: (a)  an official statement that the specified plants for planting in the Additional declaration derive from seeds which comply with the requirements laid down in Article 2;(b) an official statement that the specified plants for planting in the Additional declaration have been produced in a production site which is registered and supervised by the national plant protection organisation in the country of origin and known to be free from the ToBRFV on the basis of official inspections, sampling and testing carried out at the appropriate time to detect that pest;(c) the name of the registered production site. 2. Specified plants for planting of varieties which are known to be resistant to ToBRFV may only be introduced if they are accompanied by a phytosanitary certificate, which, under the heading “Additional Declaration”, confirms that resistance.Article 2. Introduction into Türkiye of the tomato (Solanum lycopersicum L.) and hybrids thereof, and of pepper (Capsicum spp.) seeds (hereinafter referred to as specified seeds) 1. Specified seeds, other than the ones belonging to varieties which are known to be resistant to ToBRFV, may only be introduced into Türkiye if they are accompanied by a phytosanitary certificate, which, under the heading “Additional Declaration” contains all of the following:(a) an official statement that all of the following conditions have been fulfilled: (i) The mother plants of the specified seeds concerned have been produced in a production site where the ToBRFV is known not to occur, on the basis of official inspections carried out at the appropriate time to detect ToBRFV;(ii) in the case of a specified seed lot originating from more than 30 mother plants, that specified seed lot ,prior to processing, has been analysed using the RT-PCR method and found to be free from the ToBRFV according to these tests;(iii) in the case of a specific seed lot originating from less than or equal to 30 mother plants, analyses using the RT-PCR method have been carried out on the specified seeds, or on each individual mother plant of those specified seeds and specified seeds or mother plants have been found, according to those analyses, to be free from the ToBRFV; (b) information ensuring the traceability of the production site of the mother plants.2. Specified seeds of varieties, which are known to be resistant to ToBRFV, originating from all countries, may only be introduced if they are accompanied by a phytosanitary certificate, which, under the heading “Additional Declaration”, confirms that resistance.3. By way of derogation from paragraph 1, point (a), specified seeds that have been harvested prior to 31 August 2023 and before their introduction into Türkiye have been found to comply with the requirements of Implementing Regulation (EU) 2020/1191, may be introduced into Türkiye accompanied by a phytosanitary certificate indicating under the heading “Additional Declaration”, the following statement: "These seeds have been harvested before 31 August 2023 and have been found to be free from the ToBRFV using RT-PCR method".Article 3. The analysis of the specified plants and specified seeds referred to in Articles 1 and 2 above must be carried out using the real-time RT-PCR method as described in the Annex to EU directive 2023/1032. Under the heading “Additional Declaration” of the Phytosanitary Certificate, it shall state that “it has been found to be free from the ToBRFV using the real-time RT-PCR analysis method”.

Regulation Concerning The Subjection Of Wooden Package Materials To Heat Treatment Process And Their Marking, which was notified through G/SPS/N/TUR/131 (10 January 2023), was now adopted and published in the Official Gazette dated 26 July 2024 and numbered 32613.Articles 1, 2 and 3, the seventh paragraph of Article 5, subparagraphs (a) and (b) of the first paragraph of Article 14 and subparagraphs (3) and (4) of paragraph (c), subparagraph (a) and the fifth paragraph of the first paragraph of Article 16, Articles 24 and 25 shall enter into force on 01/01/2025. The other provisions shall enter into force on 01/07/2025.

The purpose of this Communiqué is to determine the features to be taken into account in packaging, preservation, storage, transportation and marketing of shell eggs obtained from laying hens in a technical and hygienic manner. This Communiqué covers eggs obtained from chicken (Gallus gallus var. domesticus). It does not cover eggs and egg products from other poultry and incubated and cooked eggs.The Communiqué is largely compatible with the relevant EU legislation.This Communiqué repeals the Turkish Food Codex Communiqué on Eggs (Communiqué No: 2014/55) published in the Official Gazette dated 20.12.2014 and numbered 29211.

Turkish Food Codex Communiqué on Cheese Revision to Regular Notification

The purpose of this Communiqué is to determine the characteristics of cheeses supplied for direct consumption or further processing in order to ensure that they are produced, processed, preserved, transported and placed on the market in a technical and hygienic manner.This Communiqué covers all cheeses that are supplied directly for human consumption and/or used as raw materials or semi-products for processing into other products following the production.The Turkish Food Codex Communiqué on Cheese (Communiqué No: 2015/6) published in the Official Gazette dated 08/05/2015 and numbered 29261 will be repealed by this Communiqué.This communiqué contains changes to product specifications and labelling provisions.

Regulation on Plant Quarantine Addendum to Regular Notification

The comment period for the updated Draft Regulation on Plant Quarantine  has been extended by 30 days upon request. Due to the wide scope and length of the Draft Plant Quarantine Regulation and the fact that the language of the Draft is Turkish, it has been decided to extend the comment period. The last comment date for the Draft Regulation on Plant Quarantine has been updated to 3 September 2024.

Regulation on Plant Quarantine Revision to Regular Notification

The “Plant Quarantine Regulation” was reviewed and updated in order to modernise measures taking into account the current findings made in Türkiye and international plant protection organizations on phytosanitary and quarantine issues, to prevent problems that may arise due to harmful organisms in import and export, to eliminate the problems seen in practice and ensure uniformity, to adapt to developing technologies and changing Quarantine conditions, to enhance more effective measures for the protection of human, animal and environmental health.The purpose of this Regulation is to regulate the procedures and principles regarding the phytosanitary and quarantine measures of plants, plant products and other substances entering and exiting Türkiye.This Regulation covers the harmful organisms that are banned to enter into Türkiye and official controls to be carried out for phytosanitary purposes during the entry and exit of plants, plant products and other substances to and from the Customs Territory of the Republic of Türkiye.Products brought into a free zone from another country or sent from a free zone to another country shall be subject to the provisions of this Regulation.The Regulation includes definitions, Official Controls, Registration to the Plant Quarantine Registration and Tracking System, main issues related to entry and exit customs authorities, exports, plant health certificates, sampling and analysis, administrative sanctions, harmful organisms that are subject to quarantine and that hinder importation, harmful organisms that have limited existence in Türkiye, that are subject to quarantine and that hinder importation, harmful organisms that are subject to quarantine and that hinder importation in case they are found on some plants or plant products, specific requirements for importation of plants and plant products, quarantined harmful organisms that constitute an obstacle to import, quarantined harmful organisms that are found limited in Türkiye and constitute an obstacle to import, plants, plant products and other substances prohibited from entering Türkiye, specific conditions required for the import of plants and plant products.The main changes throughout the Draft Regulation are set out in the following issues:Registration in the Plant Quarantine Registration and Tracking System;Products subject to a pest risk analysis;Restrictions on the entry of high-risk plants, plant products and other substances;Re-export controls.In addition, the annexes of the Draft Regulation were updated and new harmful organisms were added.Draft Regulation:Annex-1/ Harmful Organisms Subject to Quarantine that Hinder to Import, A-Pest Organisms Subject to Quarantine whose Existence in Turkey is Unknown and Constitutes an Obstacle to Import;Annex-2/ Pest Organisms Subject to Quarantine which are Found in Turkey in a Restricted Manner and which Hinder to Import;Annex-4/Special Requirements for the Import of Plants and Herbal Products have been updated according to today's phytosanitary conditions;Annex-11- Free Zone Circulation Form has been added to the Draft Regulation.

Due to its negative effect on the ozone layer, efforts are being made to reduce and completely terminate the usage of Methyl bromide (MeBr). Türkiye became a party to the Montreal Protocol on 19 December 1991 and accepted all amendments of the Protocol to date.In order to reduce the usage of MeBr, which is among the ozone depleting substances under the Montreal Protocol, the Regulation on Reducing the Use of Methyl Bromide in Agriculture has been published in Türkiye on 23 June 2000.Considering the risks of MeBr on human and environmental health, in order to reduce the use of MeBr, "Fumigation application with MeBr for products to be re-exported is prohibited" as of 1 April 2024.
