The notified amendment sets out the phytosanitary measures established by the Directorate-General of Plant Health (DGSV), which is responsible for plant protection, to mitigate the risk of the introduction and spread of regulated pests of plants and plant products and by-products. Legal basis − Articles 2, 3 and 6; Article 7, paragraphs XIII, XVIII, XIX and XXII; Article 8; and Article 19, paragraphs I (e) and IV, of the Federal Law on Plant Health; − Articles 1 and 54-56 of the Regulations implementing the Federal Law on Plant Health, and Article 1; Article 14, paragraph III; and Article 15, paragraphs I, X, XV and XIX, of the SENASICA Internal Regulations; − Articles 1-4 and 7 of the Decision establishing the module of phytosanitary requirements for the importation of goods regulated by the Ministry of Agriculture, Livestock, Rural Development, Fisheries and Food (SADER), in relation to plant health; − Articles 1, 5, 6 and 16 of the Decision announcing the general criteria applied by Mexico in establishing and amending animal, plant, aquatic and fisheries health and safety requirements for the importation of goods regulated by SADER through SENASICA, and establishing mandatory phytosanitary measures for the importation of plants and plant products and by-products. Grounds G/SPS/N/MEX/433 - 2 - Owing to the reclassification of the phytosanitary status of the light brown apple moth (Epiphyas postvittana) as a non-quarantine pest in the United States of America by the country's national plant protection organization (NPPO), the DGSV conducted negotiations on the applicable phytosanitary measures and, as a result, both NPPOs agreed to amend the established phytosanitary requirements for the importation into Mexico of the host products listed in Annex 1 from the United States. It was decided to: Amend the section regulating E. postvittana of the phytosanitary requirements for the importation into Mexico of host products of the pest, as indicated in Annex 1, originating in and coming from the United States, as follows: − The phytosanitary certificate issued by the plant health authority of the United States must indicate the following in the additional declaration section: "The product was inspected and found to be free of any biological stage of Epiphyas postvittana."
