We are proposing to amend the regulations governing the importation of cut flowers to remove requirements for the importation of specific types of cut flowers from the regulations, and to list them in the U.S. Department of Agriculture database called the Agricultural Commodity Import Requirements instead. Updates to these requirements would occur through a noticed-based process rather than rulemaking. We are also proposing to remove entirely any restrictions on the importation of cut flowers of the genera Chrysanthemum, Leucanthemella, and Nipponanthemum from countries in which chrysanthemum white rust ( Puccinia horiana P. Henn., CWR) is known to exist. For this latter proposed action, we have prepared an analysis, which we are making available for public review and comment, that evaluates the efficacy of the current regulatory requirements in precluding the spread of CWR and the possible economic impacts associated with removing these requirements. These changes would allow us to use a notice-based, streamlined approach to update the import requirements for cut flowers, and it would remove CWR-specific restrictions on the importation of cut flowers.  [Federal Register Vol. 88, No. 73, Monday 17 April 2023, pp. 23365-23368]

This regulation establishes tolerances for residues of ethalfluralin in or on multiple crops: in or on Hemp, seed at 0.05 ppm; Onion, bulb, subgroup 3-07A at 0.01 ppm; Stevia, dried leaves at 0.05 ppm; Stevia, fresh leaves at 0.05 ppm; Vegetable, legume, pulse, bean, dried shelled, except soybean, subgroup 6-22E at 0.05 ppm; Vegetable, legume, pulse, pea, dried shelled, subgroup 6-22F at 0.05 ppm; and Vegetable, tuberous and corm, subgroup 1C at 0.01 ppm.  Additionally, the following tolerances are removed as unnecessary: Bean, dry, seed at 0.05 ppm; pea, dry, seed at 0.05 ppm; and potato at 0.01 ppm. Finally, EPA is removing the tolerance on potato at 0.05 ppm as a housecleaning measure, since that tolerance expired on 28 January 2021.

This regulation establishes tolerances for residues of deltamethrin in or on the raw agricultural commodities, Vegetable, legume, pulse, bean, dried shelled, except soybean, subgroup 6-22E and Vegetable, legume, pulse, pea, dried shelled, subgroup 6-22F.

The Food and Drug Administration (FDA or we) is confirming the effective date of 13 December 2022 for the final rule that appeared in the Federal Register of 10 November 2022, and that amended the color additive regulations to provide for the safe use of spirulina (Arthrospira platensis) extract as a color additive in alcoholic beverages with less than 20 percent alcohol-by-volume content, non-alcoholic beverages, condiments and sauces, dips, dairy product alternatives (identified as non-dairy yogurt alternatives, non-dairy frozen desserts, and non-dairy puddings), salad dressings, and seasoning mixes (unheated).The effective date of final rule published in the Federal Register of 10 November 2022 (87 FR 67785) is confirmed as 13 December 2022.

The Food and Drug Administration (FDA or we) is extending the comment period for the color additive petition for which we published a notice of filing in the Federal Register of 17 February 2023. In the notice, FDA requested comments on a filed color additive petition submitted by Center for Science in the Public Interest, et al., proposing that FDA repeal the color additive regulations providing for the use of FD&C Red No. 3 in foods (including dietary supplements) and in ingested drugs. We are taking this action in response to a request for an extension to allow interested persons additional time to submit comments.

We are proposing to amend the regulations governing the importation of certain animals, meat, and other animal products by allowing, under certain conditions, the importation of fresh (chilled or frozen) beef from Paraguay. Based on the evidence from a risk analysis, we have determined that fresh beef can safely be imported from Paraguay, provided certain conditions are met. This action would provide for the importation of fresh beef from Paraguay into the United States while continuing to protect the United States against the introduction of foot-and-mouth disease.
