The draft Order provides for a new version of the State sanitary standards and regulations "Hygienic requirements for drinking water for human consumption" State sanitary rules and norms 2.2.4-171-10, approved by the Order of the Ministry of Health of Ukraine of 12 May 2010 No. 400 (with amendments) and notified to the WTO by the documents G/SPS/N/UKR/49 and G/SPS/N/UKR/70. The relevant amendments also include introduction of new indicators of quality and safety of drinking water; approval of indicative parameters of quality and safety of drinking water; drafting of production control (monitoring) program based on risk assessment.The draft Order is intended to improve the legal requirements for quality and safety of drinking water in accordance with the requirements of the EU legislation, in particular the Directive (EU) 2020/2184 of 16 December 2020 on the quality of water intended for human consumption.
The Resolution provides:1. Introduction of the extraterritoriality principle for realization of powers of territorial bodies of the State Service of Ukraine on Food Safety and Consumer Protection. From now on, the business entity at its choice has the right to:apply for and receive documents, administrative services and phytosanitary procedures in any territorial body of the State Service of Ukraine on Food Safety and Consumer Protection;apply for phytosanitary examination (analysis) to any phytosanitary laboratory of the State Service of Ukraine on Food Safety and Consumer Protection;2. Simplification of phytosanitary control of imported goods belonging to UKTZED groups 07-12, by carrying out inspections only without sampling and phytosanitary examination (analysis).As an exception, full phytosanitary control is carried out if:phytosanitary certificates (phytosanitary certificates for re-export) are missing or invalid;the consignment does not match the information specified in the phytosanitary certificate (phytosanitary certificate for re-export);the inspection revealed infection (signs) or damage by regulated pests;3. Elimination of the requirement to conduct phytosanitary control of the accompanying wooden packaging material (pallets, packing boxes, boxes, etc.), which imports goods of not plant origin;4. Abolition of the compulsory movement though the territory of Ukraine of imported regulated products, including seeds, accompanied by a quarantine certificate;5. Issuance of a quarantine certificate only upon the request of the person.As an alternative, for the purpose of control, it is proposed to keep records of regulatory objects and provide information upon the request of the State Service of Ukraine on Food Safety and Consumer Protection (not more than once a month).Government simplifies the requirements for the import and movement of agricultural products of plant origin, including seeds, under martial law.Appropriate measures have been introduced to simplify phytosanitary measures for the import of agricultural products of plant origin and to create an uninterrupted supply of such products during martial law is in power.
Ukraine informs that the draft Resolution of the Cabinet of Ministers of Ukraine "On Approval of the Procedures for Establishing of Livestock Farms with the aim of Export, Import and Carrying Out High-Risk Activities" (notified in G/SPS/N/UKR/167) was adopted on 19 April 2022 (Resolution No. 478), published on 27 April 2022 and will be effective since 21 March 2023.The text of the Resolution is available at
The amendments to the Procedures for the State Registration of food establishments include:- a new version of the application form for the state registration of food establishments;- provisions on the cumulative state registration of vehicles used by food business operators exclusively for transportation of food products and conditions under which these vehicles are exempt from the state registration;- clarification of the deadline for food business operators to apply for the state registration of food establishments, change in the deadline for taking a decision to register food establishments or to refuse such registration (10 calendar days instead of 15 working days);- the right of food business operators to start the operations of food establishments based on the principle of tacit consent, if within 15 working days following the application for the state registration of the food establishment the competent authority has neither taken the decision to refuse the state registration of the food establishment nor provided the copy of such decision to the food business operator;- provisions on the maintenance of the State Register and introduction of changes to the State Register by the competent authority in electronic format using its own material and technical resources.The competent authority provides open and free access to the State Register by publishing it on its official website. The relevance and feasibility of amendments to the Procedures for the state registration of food establishments is related to the need to bring it into line with the provisions of the Law of Ukraine "On the Basic Principles and Requirements for Food Safety and Quality" and to eliminate differences in the interpretation of the legislation in the process of the state registration of food establishments.
The draft Order defines the mechanism and procedure for approving a decision on recognition of equivalence of state control system of the exporting country. The State Service of Ukraine for Food Safety and Consumer Protection is the responsible state body for conducting the equivalence recognition procedure.
Ukraine informs that the draft Order of the Ministry of Health of Ukraine On approval of amendments to the food safety indicators "Maximum residue limits (levels) of veterinary active substances in foodstuffs of animal origin" (G/SPS/N/UKR/155) was adopted on 13 October 2021 (Order No. 2235), registered with the Ministry of Justice of Ukraine on 1 November 2021, published on 2 November 2021 and entered into force on 2 November 2021. Ukraine informs that the draft Law of Ukraine "On amendments to certain legislative acts of Ukraine on harmonization of Ukrainian legislation in the field of food for infants with the requirements of the EU legislation" was adopted on 21 October 2021 (Law No. 1822), published on 12 November 2021 and will enter into force on 13 May 2022. Adoption of the draft Resolution will allow to define a clear procedure for approval of livestock farms for the purpose of export, import and high-risk activities, as well as to ensure the approximation of Ukrainian legislation to the requirements of EU's acquis communautaire.
This addendum concerns the withdrawal of the previously notified draft regulation.
This addendum concerns the modification of the measure's validity period.
The draft Order approves the safety requirements and certain quality indicators for baby food. These requirements do not apply to baby food for special medical purposes. The requirements establish rules for the use of pesticides in the primary production of products that are used for the production of baby food, and their maximum residue limits.The adoption of the Order repeals the Order of the Ministry of Health of Ukraine No. 696 of 6 August 2013 "On approval of the hygienic requirements for baby food, safety requirements and certain indicators of their quality". Baby food that meets the requirements in force before the entry into force of this Order, but does not meet the requirements of this Order, may be imported to Ukraine, produced and/or put into circulation for three years after the entry into force of this Order. Such baby food may be in circulation until the expiration date, or the minimum shelf life or the "use before" date.
Ukraine informs that the draft Order of the Ministry of Health of Ukraine "On approval of the maximum residue levels (MRL) of the content of chlorpyrifos and chlorpyrifos-methyl in agricultural products and food products and On amending hygienic norms and regulations for safe usage of pesticides and agrochemicals" (G/SPS/N/UKR/160) was adopted on 18 May 2021 (Order No. 960), registered with the Ministry of Justice on 3 June 2021 and will come into force on 1 January 2022. The draft Law will be enacted on the day following the date of its publication and will enter into force one year from the date of its enactment, except for paragraphs 2-4 of Section II "Final and Transitional Provisions," which will be enacted and enter into force the day after the date of its publication. The draft Order lays down rules for the killing of animals bred or kept for the production of food, wool, skin, fur or other products as well as the killing of animals for the purpose of depopulation and for related operations. The Order has been drafted based on Council Regulation (EC) No 1099/2009 of 24 September 2009 on the protection of animals at the time of killing.
According to the draft Order, recognition of the equivalence of state control system of the exporting country and the state control system of Ukraine is possible upon receipt of a request from the competent authority of the exporting country in which it guarantees that the state control system provides equivalent results of food and feed safety, animal health and welfare in accordance with Ukrainian legislation and proposes to hold the verification of the compliance (equivalence) of the state control system of the exporting country according the legislation of Ukraine. In case of approval of the Report on conformity assessment based on the results of the inspection, the competent authority prepares a draft Agreement with the competent authority of the exporting country on recognition of equivalence of the state control system of the exporting country (separate part of such system) and the state control system of Ukraine. The decision to recognize the equivalence of the state control system of the exporting country, with which Ukraine doesn't have the relevant Agreement, is to be made exceptionally on the basis of the conducting of state control measures in exporting countries according to the Control Procedure.
The Order approves the hygienic norms and regulations for safe usage of pesticides and agrochemicals.
The draft Order establishes the requirements for the registration dossier, which is submitted along with an application for state registration of feed additives in Ukraine in accordance with Article 18 of the Law of Ukraine "On safety and hygiene of feeds", scientific information that is provided to identify and specify the feed additive, as well as research (tests) conducted to confirm its effectiveness and safety for humans, animals and the environment.
Ukraine informs that the draft Order of the Ministry for Development of Economy, Trade and Agriculture of Ukraine "On Approval of the Hygienic Requirements for the Production and Circulation of Natural Mineral Water and Spring Water" (G/SPS/N/UKR/156) was adopted on 12 April 2021 (Order No. 741), registered with the Ministry of Justice of Ukraine on 19 May 2021, published on 1 June 2021 and will enter into force on 1 September 2021. The draft Law refers to:- labelling requirements for pesticides and agrochemicals;- the procedure for state registration of preparations;- the removal of provisions for special raw material zones intended for the cultivation of products for children's and dietary nutrition;- harmonizing definitions of terms in accordance with the definitions under EU law;- eliminating duplication of authority and excessive government regulation; - strengthening the control over counterfeit pesticides and agrochemicals.The draft Law is also notified in accordance with the provisions of the TBT Agreement.
