The draft Law of Ukraine "On Amendments to the Law of Ukraine of 4 February 2021 No. 1206-IX on "Veterinary Medicine"" is developed in order to improve the current legislation in the field of animal health and welfare and remove inconsistencies with the legislation of the European Union.The draft Law suggests the comprehensive regulation of the key issues related to: 1) ensuring animal welfare in terms of improving the procedure for financing veterinary and sanitary measures; 2) improvement of state veterinary and sanitary control (supervision) measures to ensure animal welfare and marketing of veterinary drugs;  3) production, marketing, registration and use of veterinary drugs; 4) issuance of accompanying veterinary documents and international veterinary certificates;5) the activities of licensed veterinarians and veterinarians of licensed veterinary establishments; 6) alignment of licensing of business activities relating to veterinary practice, production of veterinary medicinal drugs, wholesale and retail sale of veterinary medicinal drugs, import of veterinary medicinal drugs with the requirements of the licensing legislation;7) empowering the central executive body that implements the state policy in the field of veterinary medicine and animal welfare to approve:- criteria, the compliance with which will give educational institutions as well as organisations (unions, associations) of the relevant field the opportunity to be authorised to train specialists on the issues of compliance with the requirements of the animal welfare legislation;  - training programmes for specialists on the issues of compliance with the requirements of the animal welfare legislation;  - the form of the certificate to be issued to confirm that the relevant persons have sufficient knowledge acquired as a result of the training;8) authorisation of the central executive body that implements the state policy in the field of veterinary medicine and animal welfare to ensure the organisation of training for specialists on the issues of compliance with the requirements of the animal welfare legislation.

The draft Order provides for the approval of the requirements of good practice for distribution of active substances used in veterinary medicinal products. These requirements will apply to importers and market operators, as well as to manufacturers who distribute the active substances they have manufactured with the aim of using them as starting material in veterinary medicinal products.The adoption of the Order will ensure compliance with the basic principles and rules, which guarantee that the distributed active substances are registered in accordance with the established law; their storage conditions are constantly observed, including during transportation; contamination of one with another is excluded; and delivery of goods is ensured within the specified time limits.The draft Order is aimed at improving the production of veterinary medicinal products and implementing into Ukrainian legislation the provisions of Commission Implementing Regulation (EU) 2021/1280 of 2 August 2021 as regards measures on good distribution practice for active substances used as starting materials in veterinary medicinal products in accordance with Regulation (EU) 2019/6 of the European Parliament and of the Council.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine of 2 June 2023 No. 1228 "On Approval of the Requirements for Hatching Eggs and Chicks of Poultry". The Order was registered  in the Ministry of Justice of Ukraine on 19 June 2023 and published on 18 July 2023.The Order will enter into force on 18 January 2024.

The draft Order provides for the approval of Requirements for certain types of partially or wholly dehydrated preserved milk intended for human consumption in order to ensure its free circulation and provide consumers with relevant information on the characteristics of such milk, in particular by means of its labelling. These requirements will apply to the types of partially or wholly dehydrated preserved milk for human consumption, listed in Annex 1  to these Requirements, that is produced in Ukraine or imported into the territory of Ukraine, at all stages of circulation.  Requirements contain general provisions, certain requirements and labelling conditions, as well as Annex 1 on the types of partially or wholly dehydrated preserved milk  and Annex 2 on the list of specific designations for certain food products.The draft Order also provides that partially or wholly dehydrated preserved milk that meets  the requirements of the legislation on food safety and certain quality indicators  in force before the entry into force of this Order, but does not meet all or some  provisions of Requirements for certain types of partially or wholly dehydrated preserved milk intended for human consumption approved by this Order, may be in circulation until the final date of consumption or the expiration of the minimum shelf life.The draft Order is developed  to implement EU legislation.The draft Order is also notified under the TBT Agreement.

The draft Resolution provides for approval of the Procedure defining the conditions and procedure for importing into the territory of Ukraine and exporting outside Ukraine seeds and planting material of a variety not included in the Register of Plant Varieties Suitable for Distribution in Ukraine, but included in the OECD List of Varieties, of those agricultural plants to the variety certification schemes of which Ukraine has joined.In particular, the draft Resolution is aimed at regulating the import of planting material of components (parental components) of first-generation hybrids of the OECD variety and the export of the breeding of the OECD variety outside the territory of Ukraine. Currently, it is impossible to import parental components to produce a first-generation hybrid and export it, since the components of such a hybrid, namely parental components, are not included in the OECD List, and there is only information available on the OECD variety of the first-generation hybrid. At the same time, subparagraph 3.2. of paragraph 3 of Common Rules and Regulations, Section A, Part II, Annex V to the Decision of the Council “Revising the OECD schemes for the varietal certification or the control of seed moving in international trade” states, in particular, that for hybrid varieties, listing is considered to include parental components.The draft Resolution also establishes certain deadlines for the implementation of certain procedures under the Procedure.Upon the entry into force of this Resolution, the Resolution of the Cabinet of Ministers of Ukraine No. 762 of 26 October 2016 "On Approval of the Procedure for Importation into the Territory of Ukraine and Exportation Outside of Ukraine of Seeds and Planting Material of Varieties Not Included in the State Register of Plant Varieties Suitable for Distribution in Ukraine, but Included in the List of Varieties of the Organisation for Economic Cooperation and Development, of Those Agricultural Plants to the Variety Certification Schemes of which Ukraine has Joined" will become invalid.

The draft Order provides for the approval of requirements for terminology, quality characteristics, marking, labeling of fruit juices and certain similar food products in order to ensure the smooth functioning of the market as well as to create conditions for informing consumers about the characteristics of these products, in particular by means of their labeling.The draft Order also provides that fruit juices and some similar food products that meet the requirements that were in force before the entry into force of this Order, but do not meet the provisions of the Requirements for fruit juices and some similar food products approved by this Order, may be in circulation for three years from the date of entry into force of this Order. Such food products may be in circulation until the final date of consumption or the expiration of the minimum shelf life.The draft Order developed in order to implement EU legislation.The draft Order is also notified under the TBT Agreement.

The draft Order provides for the approval of the Requirements for foods and food ingredients treated with ionising radiation.The adoption of the draft Order will bring the legislation of Ukraine concerning the food safety and quality in line with EU legislation and will facilitate the implementation of Directive 1999/2/EC of the European Parliament and of the Council of 22 February 1999 on the approximation of the laws of the Member States concerning foods and food ingredients treated with ionising radiation and Directive 1999/3/EC of the European Parliament and of the Council of 22 February 1999 on the establishment of a Community list of foods and food ingredients treated with ionising radiation.Given the existence of provisions concerning the specifics of the labelling of foods treated with ionising radiation, the draft Order is also notified in accordance with the requirements of the Agreement on Technical Barriers to Trade.

The draft Resolution provides for the establishment of welfare requirements for the transportation of farm animals, bees and bumblebees, as well as related activities, including loading, unloading, reloading and resting at places of stopping, in accordance with the requirements of EU legislation in force in this sphere.Actual Resolution of the Cabinet of Ministers of Ukraine No. 1402 "On Approval of the Rules for Transportation of Animals" of 16 November 2011 does not fully comply with the requirements of the Law of Ukraine No. 1206-IX "On Veterinary Medicine" of 4 February 2021 on ensuring the welfare of animals while transporting them. In addition, Resolution No. 1402 does not contain requirements for the transportation of bees.The draft Resolution also provides for the implementation of the requirements of Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health ('Animal Health Law') and Commission Delegated Regulation (EU) 2020/688 of 17 December 2019 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council, as regards animal health requirements for movements within the Union of terrestrial animals and hatching eggs in the legislation of Ukraine.

The draft Order aims to approve the requirements for hatching eggs and chicks of poultry in terms of:- stamping and use of incubated eggs;- packaging for hatching eggs and boxes/cartons for chicks;- labelling of packages and containers for hatching eggs and boxes/cartons for chicks;- records to be kept by operators of hatcheries.Hatching eggs and chicks of poultry imported (sent) into the customs territory of Ukraine have to comply with: the requirements as defined in paragraph 3 of Chapter 1 of Section II of these requirements (in case of importation (sending) of hatching eggs into the customs territory of Ukraine), the requirements for importing (sending) into the customs territory of Ukraine of live animals and their reproductive material, approved by the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 553 of 16 November 2018 (notified as G/SPS/N/UKR/111/Add.1), or equivalent requirements of the exporting country.The draft Order also stipulates that the placing on the market of hatching eggs and chicks of poultry that were put into circulation before the entry into force of this Order may not be prohibited or restricted due to the non-compliance of hatching eggs and chicks of poultry with all or some provisions of the requirements approved by this Order.The draft Order developed in order to implement EU legislation.The draft Order is also notified under the TBT Agreement.

The Law defines the legal and organisational framework for the operation of the hop and hop products market, requirements for their production, processing, labelling and certification, as well as the state authorities' competences, rights and obligations of business entities in the hop industry, state policy directions in this branch and state control.In particular, the draft Law provides for regulation of the hop industry, which will ensure:bringing the terminology for hops and hop products in line with the EU legislation;development of regulations necessary for determining the certification rules of hops and hop products and their quality indicators;development of regulations necessary for the implementation of hop labelling rules, setting requirements for information to be contained on the packaging of hop products;setting out obligations to provide a conformity assessment and declaration of equivalence as a document certifying the compliance of hops and hop products imported from third countries with the requirements of the European Union;establishing principles for conducting inspections of production from the hop stem to the finished product, defining the control institutions and their authority, specifying the sanctions imposed for violations of the law.The draft Law is also notified under the TBT Agreement.

The draft Law provides for:· to bring the terms and definitions, classification of grape varieties and requirements for the production of viticulture and winemaking products, flavoured wine products, as well as some oenological practices and restrictions in line with requirements adopted in the EU countries;· to introduce requirements for the production and circulation of wines, viticulture and winemaking products, flavoured wine products with geographical indications similar to the current rules in the European Union;· to define the mechanism of protection of geographical indications in Ukraine;· to introduce new terms and definitions in accordance with the categories of European legislation;· to establish a unified state information system "Viticulture and Winemaking Register";· to provide for the possibility of state support for viticulture and winemaking;· to implement rules of labelling and presentation of wine products;· to establish principles for inspections of the production of wine products from the vineyard to the final product, to determine the controlling institutions and their powers, to specify sanctions for violation of the requirements established by law.This draft Law is also notified in accordance with the provisions of the TBT Agreement.

The draft Order provides for the approval of requirements for food flavors, food additives and food enzymes in food products.

The Order approves the hygienic norms and regulations for safe usage of pesticides and agrochemicals.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine No 261 "On Amendments to Some Orders on Importing (Sending) into the Customs Territory of Ukraine of Fishery Products Intended for Human Consumption". The Order was adopted on 24 February 2023, registered in the Ministry of Justice of Ukraine on 27 March 2023 and published on 11 April 2023.The Order becomes effective since 11 October 2023.

Ukraine notifies the adoption of Order of the Ministry of Agrarian Policy and Food of Ukraine No. 625 "On Amendments to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 813 of 20 October 2022 and Approval of the Requirements for Certain Quality Indicators for Poultry Meat" on 27 March 2023. The Order was registered with the Ministry of Justice of Ukraine on 5 April 2023, published and  entered into force on 7 April 2023, except for paragraphs 3-5, which will enter into force on 1 January 2024.

Ukraine notifies the adoption of the Order of the Ministry of Agrarian Policy and Food of Ukraine  No 360 “On the Approval of the Requirements for Chicken Eggs”.The Order was adopted on 7 March 2023, registered in the Ministry of Justice of Ukraine on 23 March 2023 and published on 7 April 2023.The Order will enter into force on 7 October 2023 and become effective on 1 January 2028.

The draft Order provides for amendments  to the Order of the Ministry of Agrarian Policy and Food of Ukraine No. 813 "On Approval of Hygienic Requirements for the Production and Circulation of Food Products of Animal Origin" of 20 October 2022 (notified as G/SPS/N/UKR/151) and approves requirements for certain quality indicators for poultry meat.The draft Order is developed with consideration of the amendments made to Regulation (EC) No. 853/2004 by the Commission Delegated Regulation (EU) No. 2022/2258, which entered into force on 8 December 2022 and provide, in particular:establishing  new requirements for the transportation and storage of fish products in the case of using "supercooling" and three-layer polyethylene containers filled with water and ice;updating approaches to the requirements for the production and circulation of eggs. In particular, the minimum shelf life is established for eggs obtained from Gallus gallus chickens and the deadline for delivery of eggs to the consumer is changed  (21 days is replaced by 28 days);establishing new requirements for the production of highly purified animal products (in terms of requirements for fat processing products, flavors, and methods of processing raw materials).The draft Order also establishes that:1) hygienic requirements for the production and circulation of food products of animal origin, approved by this Order, will apply to food market operators  engaged in export or have declared to the competent authority their intension to export, from the date of entry into force of this Order;2) for food market operators engaged in the production and circulation of poultry meat, including chopped (minced or chopped) meat (minced meat), semi-finished meat products and mechanically deboned meat, as well as meat products made from poultry meat, the hygienic requirements for the production and circulation of food products of animal origin, approved by this Order, will apply from 1 January 2024; 3) for all other food market operators, Hygienic requirements for the production and circulation of food products of animal origin, approved by this Order, will apply in three years from the date of termination or cancellation of martial law.It is also established that poultry meat, which meets the requirements of the legislation on safety and certain food quality indicators that entered in force before 1 January 2024, but does not meet all or some of provisions of the Requirements approved by paragraph 3 of this Order, may be placed on the market  before the expiration of the minimum shelf life or the expiration date (the "use by" date).

Ukraine notifies the adoption of the Order of the Ministry of Health No. 2374 "On approval of the Requirements for materials and articles made of regenerated cellulose film intended for contact with foodstuffs" of 29 December 2022 that establishes the requirements for materials and articles made of regenerated cellulose film intended for contact with food.The requirements apply to regenerated cellulose film which is intended to come into contact with foodstuffs or which does come into such contact and:- constitutes a finished product in itself; or- forms part of a finished product that contains other materials.The requirements do not apply to synthetic casings made from regenerated cellulose.With the adoption of the Order Ukraine implements norms specified by the Commission Directive 2007/42/EC of 29 June 2007 relating to materials and articles made of regenerated cellulose film intended to come into contact with foodstuffs.The Order is also notified under the TBT Agreement.

Ukraine notifies the adoption of the Order of the Ministry of Health of Ukraine No. 2373 "On approval of the Requirements for ceramic articles intended to come into contact with foodstuffs" on 29 December 2022.The Order entered into force on 2 February 2023 and will become fully effective from 19 November 2025:

The draft Order provides for amendments to the import  requirements  and  the form of international certificate for fishery products in terms of: - fishery product categories that are not subject to animal health requirements; - requirements regarding the status of the areas of origin of molluscs from which fishery products are obtained.Requirements for importing (sending) into the customs territory of Ukraine of live animals, their reproductive material, food products of animal origin, feed, hay, straw, as well as animal by-products and derived products are stipulated by the Order of the Ministry of Agrarian Policy and Food of Ukraine of 16 November 2018 No. 553.The Order also provides for the approval of a new version of the form of international certificate for  importing (sending) into the customs territory of Ukraine of fishery products intended for human consumption, approved by the Order of the Ministry of Economic Development, Trade and Agriculture of Ukraine of 14 July 2020 No. 1329.The draft Order is developed taking into account the requirements of  Commission Implementing Regulation (EU) 2020/2235 of 16 December 2020 laying down rules for the application of Regulations (EU) 2016/429 and (EU) 2017/625 of the European Parliament and of the Council as regards model animal health certificates, model official certificates and model animal health/official certificates, for the entry into the Union and movements within the Union of consignments of certain categories of animals and goods, official certification regarding such certificates and repealing Regulation (EC) No 599/2004, Implementing Regulations (EU) No 636/2014 and (EU) 2019/628, Directive 98/68/EC and Decisions 2000/572/EC, 2003/779/EC and 2007/240/EC as well as updated  EU approaches to the requirements for the status of shellfish origin areas from which fish products are obtained.
